T\u00eb drejtat sindikale\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p><strong>A) LEJE P\u00cbR POSTET SINDIKALE DHE LEJA E P\u00cbRKOHSHME<\/strong><\/p>\n\n\n\n<p>Punonj\u00ebsve q\u00eb jan\u00eb an\u00ebtar\u00eb t\u00eb komiteteve drejtuese t\u00eb Konfederatave sindikale, t\u00eb komiteteve drejtuese t\u00eb Federatave komb\u00ebtare t\u00eb kategoris\u00eb q\u00eb kan\u00eb n\u00ebnshkruar k\u00ebt\u00eb kontrat\u00eb C.C.N.L. dhe t\u00eb Sindikatave provinciale q\u00eb aderojn\u00eb n\u00eb to, mund t\u2019u jepen n\u00eb p\u00ebrputhje me nevojat e sh\u00ebrbimit leje t\u00eb shkurtra me pages\u00eb p\u00ebr shk\u00ebputjen nga funksionet e tyre, kur mungesa nga puna k\u00ebrkohet shprehimisht me shkrim nga Organizatat e sip\u00ebrp\u00ebrmendura.<\/p>\n\n\n\n<p>K\u00ebto leje do t\u00eb jepen p\u00ebr nj\u00eb maksimum prej 25 dit\u00ebsh n\u00eb vit p\u00ebr \u00e7do organizat\u00eb sindikale.<br><\/p>\n\n\n\n<p>Aty ku ka shum\u00eb pun\u00ebtor\u00eb t\u00eb pun\u00ebsuar nga e nj\u00ebjta nd\u00ebrmarrje q\u00eb mund t\u00eb p\u00ebrfitojn\u00eb nga ajo, lejet q\u00eb do t&#8217;u jepen individ\u00ebve shtohen dhe n\u00eb p\u00ebrgjith\u00ebsi nuk mund t\u00eb tejkalojn\u00eb maksimumi 60 dit\u00eb n\u00eb vit.<\/p>\n\n\n\n<p>Lejet p\u00ebr an\u00ebtar\u00ebt e organeve drejtuese t\u00eb sindikat\u00ebs do t\u00eb jepen me paraqitjen e letr\u00ebs s\u00eb thirrjes n\u00eb nd\u00ebrmarrje t\u00eb pakt\u00ebn 24 or\u00eb p\u00ebrpara.<\/p>\n\n\n\n<p>Kategorit\u00eb e p\u00ebrmendura m\u00eb sip\u00ebr dhe variacionet p\u00ebrkat\u00ebse duhet t&#8217;u komunikohen me shkrim nga Organizatat e sip\u00ebrp\u00ebrmendura, Shoqatave t\u00eb pun\u00ebdh\u00ebn\u00ebsve territoriale q\u00eb do t\u00eb marrin masa t&#8217;ia komunikojn\u00eb nd\u00ebrmarrjes s\u00eb cil\u00ebs punonj\u00ebsi i p\u00ebrket.<\/p>\n\n\n\n<p>P\u00ebr p\u00ebrmbushjen e funksioneve sindikaliste t\u00eb p\u00ebrmendura m\u00eb sip\u00ebr, si dhe p\u00ebr funksionet publike t\u00eb zgjedhjeve, mund t&#8217;u jepet nj\u00eb periudh\u00eb pushimi p\u00ebr t\u00eb gjith\u00eb koh\u00ebzgjatjen e mandatit t\u00eb tyre, gjat\u00eb s\u00eb cil\u00ebs marr\u00ebdh\u00ebnia e pun\u00ebs mbetet e pezulluar p\u00ebr t\u00eb gjitha efektet.<\/p>\n\n\n\n<p>Drejtuesit e p\u00ebrfaq\u00ebsive t\u00eb sindikatave t\u00eb nd\u00ebrmarrjes kan\u00eb t\u00eb drejt\u00eb t\u00eb kryejn\u00eb mandatin e tyre, me leje t\u00eb paguara.<\/p>\n\n\n\n<p>Ata kan\u00eb t\u00eb drejt\u00eb p\u00ebr leje t\u00eb tilla t\u00eb pakt\u00ebn:<\/p>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-container-core-group-is-layout-990f8f10 wp-block-group-is-layout-constrained\">\n<ol class=\"wp-block-list\" style=\"list-style-type:lower-alpha\">\n<li>1 drejtues p\u00ebr \u00e7do p\u00ebrfaq\u00ebsi sindikale t\u00eb nd\u00ebrmarrjes n\u00eb nj\u00ebsit\u00eb prodhuese q\u00eb kan\u00eb n\u00eb pun\u00eb deri n\u00eb 200 punonj\u00ebs t\u00eb kategoris\u00eb p\u00ebr t\u00eb cil\u00ebn ajo \u00ebsht\u00eb organizuar;<\/li>\n\n\n\n<li>1 drejtues p\u00ebr \u00e7do 300 ose fraksion prej 300 punonj\u00ebsish p\u00ebr \u00e7do p\u00ebrfaq\u00ebsi sindikale t\u00eb nd\u00ebrmarrjes n\u00eb nj\u00ebsit\u00eb prodhuese q\u00eb kan\u00eb n\u00eb pun\u00eb deri n\u00eb 3.000 punonj\u00ebs t\u00eb kategoris\u00eb p\u00ebr t\u00eb cil\u00ebn ajo \u00ebsht\u00eb organizuar;<\/li>\n\n\n\n<li>1 drejtues p\u00ebr \u00e7do 500 ose fraksione prej 500 punonj\u00ebsish t\u00eb kategoris\u00eb p\u00ebr t\u00eb cil\u00ebn \u00ebsht\u00eb i organizuar p\u00ebrfaq\u00ebsimi sindikal i nd\u00ebrmarrjes n\u00eb nj\u00ebsit\u00eb prodhuese me dimensione m\u00eb t\u00eb m\u00ebdha, p\u00ebrve\u00e7 numrit minimal t\u00eb p\u00ebrmendur n\u00eb germ\u00ebn e m\u00ebparshme b).<\/li>\n<\/ol>\n<\/div>\n\n\n\n<p>Lejet me pages\u00eb p\u00ebr drejtuesit e sindikatave t\u00eb nd\u00ebrmarrjeve nuk mund t\u00eb jet\u00eb m\u00eb pak se 10 or\u00eb n\u00eb muaj n\u00eb nd\u00ebrmarrjet e p\u00ebrmendura n\u00eb germat b) dhe c) t\u00eb paragrafit t\u00eb m\u00ebparsh\u00ebm; n\u00eb shoq\u00ebrit\u00eb e p\u00ebrmendura n\u00eb germ\u00ebn a) pushimet me pages\u00eb nuk mund t\u00eb jet\u00eb m\u00eb pak se 2 or\u00eb e gjysm\u00eb n\u00eb vit p\u00ebr \u00e7do punonj\u00ebs.<\/p>\n\n\n\n<p>Punonj\u00ebsi q\u00eb synon t\u00eb ushtroj\u00eb t\u00eb drejt\u00ebn e p\u00ebrmendur n\u00eb paragrafin 7 duhet t\u00eb njoftoj\u00eb me shkrim nd\u00ebrmarrjen, zakonisht 24 or\u00eb p\u00ebrpara, n\u00ebp\u00ebrmjet p\u00ebrfaq\u00ebsive t\u00eb sindikatave t\u00eb nd\u00ebrmarrjes. Drejtuesit e sindikatave t\u00eb nd\u00ebrmarrjeve kan\u00eb t\u00eb drejt\u00ebn e lejeve pa pages\u00eb p\u00ebr pjes\u00ebmarrje n\u00eb negociatat e sindikatave dhe n\u00eb kongreset e konferencat e natyr\u00ebs sindikale, n\u00eb nj\u00eb mas\u00eb jo m\u00eb t\u00eb vog\u00ebl se 8 dit\u00eb n\u00eb vit.<\/p>\n\n\n\n<p>Punonj\u00ebsit q\u00eb synojn\u00eb t\u00eb ushtrojn\u00eb t\u00eb drejt\u00ebn e p\u00ebrmendur n\u00eb paragrafin e m\u00ebparsh\u00ebm, duhet t\u00eb njoftojn\u00eb me shkrim nd\u00ebrmarrjen zakonisht 3 dit\u00eb p\u00ebrpara, n\u00ebp\u00ebrmjet p\u00ebrfaq\u00ebsuesve t\u00eb sindikatave t\u00eb nd\u00ebrmarrjes.<\/p>\n\n\n\n<p><strong>B) ASAMBLEJA<\/strong><\/p>\n\n\n\n<p>N\u00eb p\u00ebrputhje me nenin 20 t\u00eb ligjit n. 300\/1970, nd\u00ebrmarrjet garantojn\u00eb ushtrimin e t\u00eb drejt\u00ebs s\u00eb asambleve n\u00eb vendet e pun\u00ebs.<\/p>\n\n\n\n<p>N\u00eb rast t\u00eb munges\u00ebs s\u00eb d\u00ebshmuar t\u00eb lokaleve n\u00eb vendin e pun\u00ebs, nd\u00ebrmarrja do t\u00eb v\u00ebr\u00eb n\u00eb dispozicion nj\u00eb lokal tjet\u00ebr ose nj\u00eb hap\u00ebsir\u00eb tjet\u00ebr t\u00eb p\u00ebrshtatshme q\u00eb do t\u00eb vendoset me strukturat sindikale t\u00eb nd\u00ebrmarrjes.<\/p>\n\n\n\n<p>Asambleja mund t\u00eb mblidhet edhe nga organizatat sindikale territoriale t\u00eb federatave t\u00eb punonj\u00ebsve q\u00eb kan\u00eb n\u00ebnshkruar kontrat\u00ebn C.C.N.L.<br><\/p>\n\n\n\n<p><strong>C) DERDHJA E KONTRIBUTEVE SINDIKALE<\/strong><\/p>\n\n\n\n<p>Nd\u00ebrmarrja do t\u00eb marr\u00eb masa q\u00eb t\u00eb mbaj\u00eb nga paga mujore e punonj\u00ebsit, i cili e k\u00ebrkon me an\u00ebn e delegimit me shkrim, shum\u00ebn e kontributeve t\u00eb shoqat\u00ebs q\u00eb do t\u2019i derdhen organizat\u00ebs sindikale q\u00eb ka firmosur k\u00ebt\u00eb kontrat\u00eb, e p\u00ebrcaktuar nga vet\u00eb punonj\u00ebsi, n\u00eb mas\u00ebn prej 1% t\u00eb rrog\u00ebs baz\u00eb dhe kompensimin e kostos s\u00eb jetes\u00ebs p\u00ebr 14 muaj.<\/p>\n\n\n\n<p>Nd\u00ebrmarrja nuk do t\u00eb zbatoj\u00eb ato delegime q\u00eb nuk p\u00ebrmbajn\u00eb elementet e dh\u00ebn\u00eb n\u00eb formularin standard t\u00eb p\u00ebrmendur n\u00eb letr\u00ebn e bashk\u00eblidhur me k\u00ebt\u00eb kontrat\u00eb.<\/p>\n\n\n\n<p>Delegimi, me dat\u00eb dhe i n\u00ebnshkruar nga punonj\u00ebsi, duhet t\u00eb tregoj\u00eb muajin e fillimit t\u00eb pages\u00ebs.<\/p>\n\n\n\n<p>N\u00eb rast se paga mujore nuk paguhet, nuk do t\u00eb ket\u00eb asnj\u00eb mbajtje dhe as rikuperim t\u00eb m\u00ebvonsh\u00ebm.<\/p>\n\n\n\n<p>N\u00ebse delegimi do t\u00eb arrij\u00eb n\u00eb nd\u00ebrmarrje pas dat\u00ebs 5 t\u00eb muajit e fillimit t\u00eb pages\u00ebs s\u00eb treguar nga punonj\u00ebsi, mbajtja n\u00eb burim do t\u00eb b\u00ebhet vet\u00ebm nga muaji q\u00eb vjen pas muajit t\u00eb marrjes, pa zbatuar asnj\u00eb rikuperim p\u00ebr periudh\u00ebn e m\u00ebparshme.<\/p>\n\n\n\n<p>Revokimi eventual i delegimit gjat\u00eb vitit kalendarik do t\u00eb duhet t\u00eb hartohet edhe ai me shkrim dhe t\u00eb tregoj\u00eb muajin nga i cili nuk duhet t\u00eb b\u00ebhet m\u00eb mbajtja nga rroga.<\/p>\n\n\n\n<p>N\u00ebse revokimi do t\u00eb merret pas dat\u00ebs 5 t\u00eb muajit t\u00eb treguar nga punonj\u00ebsi, nd\u00ebrprerja e mbajtjes n\u00eb rrog\u00eb do t\u00eb hyj\u00eb n\u00eb fuqi nga muaji pasardh\u00ebs pa asnj\u00eb barazim.<\/p>\n\n\n\n<p>Si delegimi ashtu edhe revokimi jan\u00eb akte t\u00eb shprehjes s\u00eb lir\u00eb t\u00eb vullnetit dhe p\u00ebr rrjedhoj\u00eb rrept\u00ebsisht personale, p\u00ebr rrjedhoj\u00eb ato duhet t\u00eb jen\u00eb individuale dhe jo kolektive.<\/p>\n\n\n\n<p>Kur revokimi shoq\u00ebrohet nga nj\u00eb delegim i ri i n\u00ebnshkruar n\u00eb favor t\u00eb nj\u00eb Organizate tjet\u00ebr sindikale, data e s\u00eb par\u00ebs duhet t\u00eb jet\u00eb p\u00ebrpara ose e nj\u00ebkohshme me at\u00eb t\u00eb s\u00eb dyt\u00ebs.<\/p>\n\n\n\n<p>Delegimi dhe revokimi do t\u00eb dor\u00ebzohen, ose d\u00ebrgohen, nga i interesuari te nd\u00ebrmarrja.<\/p>\n\n\n\n<p>Kontributet e mbajtura n\u00eb rrog\u00eb do t&#8217;i paguhen \u00e7do muaj nga nd\u00ebrmarrja Organizat\u00ebs sindikale p\u00ebrkat\u00ebse.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tKthehu lart\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Neni 61 &#8211;
