Gjat\u00eb faz\u00ebs s\u00eb par\u00eb t\u00eb zbatimit, detyrat e sekretaris\u00eb s\u00eb Zyr\u00ebs do t\u00eb zhvillohen pran\u00eb Shoqat\u00ebs s\u00eb pun\u00ebdh\u00ebn\u00ebsve t\u00eb sip\u00ebrp\u00ebrmendur. Punonj\u00ebsi ose, n\u00eb rast t\u00eb disa mosmarr\u00ebveshjeve, punonj\u00ebsit, t\u00eb cil\u00ebt synojn\u00eb t\u00eb b\u00ebjn\u00eb rekurs p\u00ebrpara Gjykat\u00ebsit t\u00eb pun\u00ebs, mund t\u00eb b\u00ebjn\u00eb nj\u00eb k\u00ebrkes\u00eb me shkrim me let\u00ebr rekomande me p\u00ebrgjigje n\u00eb sekretarin\u00eb e zyr\u00ebs p\u00ebr eksperimentin e tentativ\u00ebs s\u00eb detyrueshme t\u00eb pajtimit brenda sindikat\u00ebs. Nj\u00eb kopje e k\u00ebrkes\u00ebs s\u00eb lartp\u00ebrmendur duhet t&#8217;i d\u00ebrgohet nj\u00ebkoh\u00ebsisht me let\u00ebr rekomande me p\u00ebrgjigje nd\u00ebrmarrjes s\u00eb interesuar. Instanca duhet t\u00eb p\u00ebrmbaj\u00eb p\u00ebrcaktimin e pal\u00ebve, objektin e mosmarr\u00ebveshjes me paraqitjen e detajuar dhe t\u00eb plot\u00eb t\u00eb fakteve, p\u00ebrmbledhjen e dokumenteve bashk\u00eblidhur, zgjedhjen e vendbanimit (adres\u00ebs) p\u00ebr komunikimet n\u00eb sekretari, si dhe emrin e p\u00ebrfaq\u00ebsuesit t\u00eb organizat\u00ebs sindikale t\u00eb p\u00ebrmendur n\u00eb pik\u00ebn 1 t\u00eb cilit i \u00ebsht\u00eb dh\u00ebn\u00eb prokura e posa\u00e7me. T\u00eb nj\u00ebjtat p\u00ebrmbushje duhet t\u00eb kryhen n\u00eb rast se pala padit\u00ebse \u00ebsht\u00eb pun\u00ebdh\u00ebn\u00ebsi.<\/p>\n\n\n\n<p>Pal\u00ebt, me p\u00ebrfaq\u00ebsuesit e caktuar dhe, n\u00ebse \u00ebsht\u00eb komunikuar m\u00eb par\u00eb, me pranin\u00eb e mundshme t\u00eb ekspert\u00ebve q\u00eb i p\u00ebrkasin organizatave sindikale p\u00ebrkat\u00ebse, duhet t\u00eb mblidhen brenda 20 dit\u00ebve nga marrja e k\u00ebrkes\u00ebs s\u00eb m\u00ebsip\u00ebrme p\u00ebr t\u00eb proceduar me shqyrtimin e mosmarr\u00ebveshjes dhe p\u00ebr tentativ\u00ebn e pajtimit.<\/p>\n\n\n\n<p>P\u00ebrpjekja p\u00ebr pajtim kryhet me forma t\u00eb lira, qoft\u00eb edhe me disa mbledhje dhe duhet t\u00eb p\u00ebrfundoj\u00eb brenda 60 dit\u00ebve nga data e marrjes s\u00eb k\u00ebrkes\u00ebs.<\/p>\n\n\n\n<p>N\u00ebse pajtimi ka rezultat pozitiv, hartohet nj\u00eb procesverbal duke u bazuar dhe n\u00eb p\u00ebrputhje me nenin 411, paragraf\u00ebt 1 e 3 , K.p.c.<\/p>\n\n\n\n<p>Procesverbali i pajtimit i n\u00ebnshkruar nga pal\u00ebt b\u00ebhet i zbatuesh\u00ebm dhe ekzekutiv n\u00eb p\u00ebrputhje me at\u00eb \u00e7far\u00eb parashikohet nga neni 411 i K.p.c.<\/p>\n\n\n\n<p>N\u00ebse pajtimi nuk arrihet, hartohet nj\u00eb proces verbal, duke treguar kushtet e mosmarr\u00ebveshjes, t\u00eb propozimeve eventuale p\u00ebr p\u00ebrcaktimin dhe arsyet e munges\u00ebs s\u00eb marr\u00ebveshjes.<\/p>\n\n\n\n<p>Pal\u00ebt mund t\u00eb tregojn\u00eb zgjidhjen, qoft\u00eb edhe t\u00eb pjesshme, p\u00ebr t\u00eb cil\u00ebn bien dakord, duke specifikuar, kur \u00ebsht\u00eb e mundur, shum\u00ebn e kreditit q\u00eb i takon ankuesit. N\u00eb k\u00ebt\u00eb rastin e fundit procesverbali b\u00ebhet i vlefsh\u00ebm p\u00ebr ekzekutim, n\u00eb p\u00ebrputhje me dispozitat e nenit 411 t\u00eb K.p.c.<br><\/p>\n\n\n\n<p>Vet\u00eb sekretaria merr masa, me k\u00ebrkes\u00ebn e pal\u00ebve, q\u00eb t\u00eb l\u00ebshoj\u00eb nj\u00eb kopje t\u00eb procesverbalit t\u00eb pajtimit ose t\u00eb munges\u00ebs s\u00eb marr\u00ebveshjes.<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\" style=\"list-style-type:upper-alpha\">\n<li><strong>ARBITRAZHI JO RITUAL<\/strong><\/li>\n<\/ol>\n\n\n\n<p>N\u00ebse p\u00ebrpjekja e pajtimit nuk arrihet, ose n\u00eb \u00e7do rast ka skaduar afati i p\u00ebrmendur n\u00eb pik\u00ebn 4 t\u00eb germ\u00ebs A t\u00eb k\u00ebsaj marr\u00ebveshjeje, pal\u00ebt individuale t\u00eb interesuara mund t\u00eb bien dakord t&#8217;ia referojn\u00eb zgjidhjen e mosmarr\u00ebveshjes vendimit t\u00eb Kolegjit t\u00eb arbitrazhit t\u00eb parashikuar nga neni 412 ter i K.p.c.<\/p>\n\n\n\n<p>Duke mbetur n\u00eb fuqi \u00e7far\u00eb \u00ebsht\u00eb vendosur nga neni 412 ter, paragrafi 1, K.p.c., instancat territoriale t\u00eb organizatave sindikale n\u00ebnshkruese t\u00eb k\u00ebsaj kontrate dhe shoqatat e pun\u00ebdh\u00ebn\u00ebsve territoriale do t\u00eb marrin masa p\u00ebr krijimin e Kolegjit t\u00eb arbitrazhit, qoft\u00eb edhe n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrhershme, sipas kritereve t\u00eb m\u00ebposhtme.<\/p>\n\n\n\n<p>Kolegji p\u00ebrb\u00ebhet nga nj\u00eb p\u00ebrfaq\u00ebsues i sindikat\u00ebs s\u00eb caktuar nga punonj\u00ebsi, nga nj\u00eb p\u00ebrfaq\u00ebsues i Shoqat\u00ebs s\u00eb pun\u00ebdh\u00ebn\u00ebsve territoriale t\u00eb caktuar nga nd\u00ebrmarrja dhe nga Presidenti i zgjedhur me marr\u00ebveshje t\u00eb p\u00ebrbashk\u00ebt.<\/p>\n\n\n\n<p>N\u00ebse Kolegji i Arbitrazhit \u00ebsht\u00eb krijuar n\u00eb form\u00eb t\u00eb p\u00ebrhershme, caktimi i Presidentit \u00ebsht\u00eb p\u00ebrgjegj\u00ebsi e instancave territoriale t\u00eb Organizatave sindikale n\u00ebnshkruese t\u00eb k\u00ebsaj marr\u00ebveshjeje dhe t\u00eb Shoqatave t\u00eb pun\u00ebdh\u00ebn\u00ebsve territoriale q\u00eb e kan\u00eb krijuar at\u00eb.<\/p>\n\n\n\n<p>N\u00eb rast t\u00eb munges\u00ebs s\u00eb marr\u00ebveshjes p\u00ebr em\u00ebrimin e Presidentit, ai do t\u00eb zgjidhet pas shprehjes s\u00eb vullnetit t\u00eb pal\u00ebve sipas paragrafit t\u00eb tret\u00eb dhe t\u00eb kat\u00ebrt t\u00eb pik\u00ebs 4 &#8211; me rotacion ose kritere t\u00eb tjera q\u00eb do t\u00eb identifikohen n\u00eb nivel territori, nga nj\u00eb list\u00eb, q\u00eb revizionohet normalisht \u00e7do dy vjet, q\u00eb p\u00ebrmban emrat e t\u00eb pakt\u00ebn 10 jurist\u00ebve, t\u00eb identifikuar me marr\u00ebveshje t\u00eb p\u00ebrbashk\u00ebt nga instancat territoriale t\u00eb organizatave sindikale n\u00ebnshkruese t\u00eb k\u00ebsaj marr\u00ebveshjeje dhe nga Shoqatat e pun\u00ebdh\u00ebn\u00ebsve territoriale.<\/p>\n\n\n\n<p>Presidentit, p\u00ebr \u00e7do mosmarr\u00ebveshje, do t&#8217;i paguhet nj\u00eb kompensim, shuma e t\u00eb cilit do t\u00eb p\u00ebrcaktohet nga pal\u00ebt n\u00eb nivel territori.<\/p>\n\n\n\n<p>\u00c7do gjasht\u00eb muaj, shpenzimet e sekretaris\u00eb do t\u00eb llogariten dhe shp\u00ebrndahen nd\u00ebrmjet Organizatave kontraktuese.<\/p>\n\n\n\n<p>Presidenti ka detyr\u00eb t\u00eb deklaroj\u00eb her\u00eb pas here, me shkrim, se nuk ndeshet asnj\u00eb nga rastet e parashikuara nga neni 51 i K.p.c.<\/p>\n\n\n\n<p>K\u00ebrkesa q\u00eb mosmarr\u00ebveshja t&#8217;i kalohet Kolegjit t\u00eb arbitrazhit duhet t\u00eb p\u00ebrmbaj\u00eb sh\u00ebnimin e pal\u00ebs q\u00eb ka b\u00ebr\u00eb instanc\u00ebn, zgjedhjen e vendbanimit n\u00eb sekretarin\u00eb e Kolegjit dhe paraqitjen e fakteve.<\/p>\n\n\n\n<p>K\u00ebrkesa e n\u00ebnshkruar nga pala e interesuar duhet t\u00eb d\u00ebrgohet me an\u00ebn e post\u00ebs rekomande me p\u00ebrgjigje n\u00eb sekretarin\u00eb e Kolegjit dhe t\u00eb pal\u00ebs tjet\u00ebr, n\u00ebp\u00ebrmjet Organizat\u00ebs sindikale ose Shoqat\u00ebs s\u00eb pun\u00ebdh\u00ebn\u00ebsve t\u00eb cil\u00ebs i ka dh\u00ebn\u00eb mandatin, brenda afatit prej 30 dit\u00ebsh duke filluar nga dita e l\u00ebshimit t\u00eb procesverbalit t\u00eb p\u00ebrmendur n\u00eb pik\u00ebn 6., pjesa a) e k\u00ebtij neni ose nga dita e skadimit t\u00eb periudh\u00ebs brenda s\u00eb cil\u00ebs mund t\u00eb ishte b\u00ebr\u00eb demonstrimi i p\u00ebrpjekjes.<\/p>\n\n\n\n<p>Pala q\u00eb ka b\u00ebr\u00eb instanc\u00ebn, brenda 15 dit\u00ebve n\u00eb vijim, duke filluar nga d\u00ebrgimi i letr\u00ebs rekomande me p\u00ebrgjigje t\u00eb p\u00ebrmendur n\u00eb paragrafin e m\u00ebparsh\u00ebm, duhet t&#8217;i jap\u00eb Sekretaris\u00eb konfirmimin me shkrim n\u00eb lidhje me d\u00ebshir\u00ebn p\u00ebr t&#8217;u ankuar te vet\u00eb Kolegji, duke d\u00ebrguar nj\u00ebkoh\u00ebsisht nj\u00eb kopje t\u00eb lajm\u00ebrimit t\u00eb komunikimit q\u00eb i \u00ebsht\u00eb d\u00ebrguar pal\u00ebs tjet\u00ebr. N\u00ebse konfirmimi nuk arrin brenda k\u00ebtij afati, k\u00ebrkesa p\u00ebr arbitrazh konsiderohet e revokuar. K\u00ebrkesa mund t\u00eb kusht\u00ebzohet nga detyrimi i arbitrave p\u00ebr t\u00eb respektuar normat e detyrueshme t\u00eb ligjit dhe t\u00eb k\u00ebsaj kontrate C.C.N.L.<br><\/p>\n\n\n\n<p>N\u00ebse pala tjet\u00ebr synon t\u00eb pranoj\u00eb k\u00ebrkes\u00ebn, ajo duhet t&#8217;ia komunikoj\u00eb k\u00ebt\u00eb sekretaris\u00eb s\u00eb Kolegjit brenda nj\u00eb afati prej 15 dit\u00ebsh nga data e marrjes s\u00eb instanc\u00ebs.<\/p>\n\n\n\n<p>K\u00ebrkesa dhe pranimi duhet t\u00eb p\u00ebrmbaj\u00eb deklarat\u00ebn me shkrim t\u00eb pal\u00ebve q\u00eb pranojn\u00eb emrat e Kolegjit gjykues q\u00eb p\u00ebrfaq\u00ebson pal\u00ebt, si dhe t\u00eb Presidentit q\u00eb do t\u00eb caktohet sipas pik\u00ebs 2, si dhe t\u00eb dh\u00ebnies s\u00eb t\u00eb nj\u00ebjtit kolegj kompetenc\u00ebn p\u00ebr t\u00eb vendosur me paan\u00ebsi, p\u00ebrve\u00e7 rastit q\u00eb parashikohet n\u00eb paragrafin e tret\u00eb t\u00eb m\u00ebparsh\u00ebm.<\/p>\n\n\n\n<p>Pranimi i arbitrave p\u00ebr t\u00eb trajtuar mosmarr\u00ebveshjen duhet t\u00eb rezultoj\u00eb me shkrim. Vler\u00ebsimi paraprak eventual i mosmarr\u00ebveshjes kryesisht do t\u00eb zhvillohet n\u00eb form\u00eb verbale (me goj\u00eb), sipas modaliteteve q\u00eb do t\u00eb fiksohen nga Kolegji n\u00eb mbledhjen e par\u00eb.<\/p>\n\n\n\n<p>Kolegji do t\u00eb mund t\u00eb pyes\u00eb lirisht pal\u00ebt e interesuara, si dhe personat q\u00eb rezultojn\u00eb t\u00eb informuar p\u00ebr faktet.<\/p>\n\n\n\n<p>Pal\u00ebt do t\u00eb mund t\u00eb asistohen nga Organizatat sindikale dhe\/ose nga ekspert\u00eb t\u00eb besuar. Brenda afateve t\u00eb prera t\u00eb fiksuara nga Kolegji, pal\u00ebt do t\u00eb mund t\u00eb depozitojn\u00eb n\u00eb sekretari dokumente, memorie dhe replika.<\/p>\n\n\n\n<p>Kolegji duhet t\u00eb jap\u00eb vendimin brenda 60 dit\u00ebve, duke filluar nga data e marrjes, pran\u00eb sekretaris\u00eb, t\u00eb konfirmimit me shkrim t\u00eb p\u00ebrmendur n\u00eb pik\u00ebn 4 m\u00eb sip\u00ebr.
