punonj\u00ebsi nuk ka detyrim ta d\u00ebrgoj\u00eb certifikat\u00ebn, duke l\u00ebn\u00eb n\u00eb fuqi detyrimin e tij p\u00ebr t&#8217;i komunikuar menj\u00ebher\u00eb pun\u00ebdh\u00ebn\u00ebsit munges\u00ebn p\u00ebr shkak t\u00eb s\u00ebmundjes, sipas dy paragraf\u00ebve t\u00eb m\u00ebparsh\u00ebm.<\/p>\n\n\n\n<p>Punonj\u00ebsi do t&#8217;i jap\u00eb nd\u00ebrmarrjes numrin e protokollit t\u00eb identifikimit t\u00eb certifikat\u00ebs s\u00eb d\u00ebrguar nga mjeku n\u00eb m\u00ebnyr\u00eb telematike.<\/p>\n\n\n\n<p>Mbetet n\u00eb fuqi \u00e7far\u00eb \u00ebsht\u00eb vendosur p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje nga ligjet dhe marr\u00ebveshjet n\u00eb nivel nd\u00ebrkonfederal.<\/p>\n\n\n\n<p>E drejta p\u00ebr t\u00eb mbajtur vendin e pun\u00ebs pushon n\u00ebse punonj\u00ebsi, edhe me disa periudha s\u00ebmundjesh, arrin gjithsej 12 muaj mungesa gjat\u00eb nj\u00eb periudhe prej 36 muajsh radhazi. P\u00ebr q\u00ebllimet e trajtimit t\u00eb m\u00ebsip\u00ebrm, b\u00ebhet shuma e periudhave t\u00eb mungesave p\u00ebr shkak t\u00eb s\u00ebmundjes q\u00eb kan\u00eb ndodhur gjat\u00eb nj\u00eb periudhe t\u00eb 36 muajve t\u00eb fundit radhazi, p\u00ebrpara dit\u00ebs s\u00eb fundit t\u00eb s\u00ebmundjes q\u00eb merret n\u00eb konsiderat\u00eb.<\/p>\n\n\n\n<p>Dispozita e p\u00ebrmendur n\u00eb paragrafin e m\u00ebparsh\u00ebm \u00ebsht\u00eb e vlefshme edhe n\u00ebse 36 muajt radhazi jan\u00eb arritur n\u00ebp\u00ebrmjet disa marr\u00ebdh\u00ebnieve n\u00eb pun\u00eb t\u00eb nj\u00ebpasnj\u00ebshme n\u00eb sektor.<\/p>\n\n\n\n<p>P\u00ebr k\u00ebt\u00eb q\u00ebllim, pun\u00ebdh\u00ebn\u00ebsi \u00ebsht\u00eb i detyruar q\u00eb n\u00eb momentin e p\u00ebrfundimit t\u00eb marr\u00ebdh\u00ebnies s\u00eb pun\u00ebs t\u00eb l\u00ebshoj\u00eb nj\u00eb deklarat\u00eb p\u00ebrgjegj\u00ebsie, n\u00eb t\u00eb cil\u00ebn rezulton numri i dit\u00ebve t\u00eb s\u00ebmundjes t\u00eb kompensuara n\u00eb periudhat e m\u00ebparshme t\u00eb pun\u00ebs deri n\u00eb maksimumi 3 vjet. Pasi t\u00eb jen\u00eb tejkaluar limitet e mbajtjes s\u00eb vendit t\u00eb pun\u00ebs, nd\u00ebrmarrja, me k\u00ebrkes\u00eb t\u00eb punonj\u00ebsit, do t\u00eb jap\u00eb nj\u00eb periudh\u00eb pezullimi jo m\u00eb shum\u00eb se 4 muaj gjat\u00eb s\u00eb cil\u00ebs marr\u00ebdh\u00ebnia e pun\u00ebs mbetet e pezulluar p\u00ebr \u00e7do efekt pa vazhduar pages\u00ebn dhe t\u00eb asnj\u00eb instituti kontraktues.<\/p>\n\n\n\n<p>Kjo periudh\u00eb pushimi do t\u00eb mund t\u00eb k\u00ebrkohet vet\u00ebm nj\u00eb her\u00eb gjat\u00eb periudh\u00ebs s\u00eb pun\u00ebsimit n\u00eb t\u00eb nj\u00ebjt\u00ebn nd\u00ebrmarrje.<\/p>\n\n\n\n<p>Pasi t\u00eb ken\u00eb skaduar limitet e m\u00ebsip\u00ebrme, nd\u00ebrmarrja, n\u00ebse vazhdon me largimin nga puna t\u00eb punonj\u00ebsit, do t\u00eb paguaj\u00eb trajtimin (sigurimin) p\u00ebr p\u00ebrfundimin e pun\u00ebsimit dhe shtes\u00ebn z\u00ebvend\u00ebsuese t\u00eb paralajm\u00ebrimit dhe \u00e7do gj\u00eb tjet\u00ebr q\u00eb mund t\u00eb jet\u00eb maturuar.<\/p>\n\n\n\n<p>N\u00ebse punonj\u00ebsi nuk \u00ebsht\u00eb n\u00eb gjendje t\u00eb rikthehet n\u00eb sh\u00ebrbim pas afateve t\u00eb lartp\u00ebrmendura, ai mund t\u00eb zgjidh\u00eb kontrat\u00ebn e pun\u00ebs me t\u00eb drejt\u00eb vet\u00ebm p\u00ebr pages\u00ebn e p\u00ebrfundimit t\u00eb marr\u00ebdh\u00ebnies n\u00eb pun\u00eb. N\u00ebse kjo nuk ndodh dhe nd\u00ebrmarrja nuk vazhdon me pushimin nga puna, marr\u00ebdh\u00ebnia mbetet e pezulluar, me p\u00ebrjashtim t\u00eb vazhdimit t\u00eb periudh\u00ebs s\u00eb vjet\u00ebrsis\u00eb n\u00eb pun\u00eb.<\/p>\n\n\n\n<p>P\u00ebr rastet e t.b.c.-s\u00eb &#8211; duke l\u00ebn\u00eb n\u00eb fuqi at\u00eb \u00e7far\u00eb parashikohet nga ky nen &#8211; i referohemi dispozitave ligjore n\u00eb fuqi.<\/p>\n\n\n\n<p>P\u00ebr trajtimin e s\u00ebmundjeve dhe aksidenteve vlejn\u00eb normat me karakter t\u00eb p\u00ebrgjithsh\u00ebm.<br><\/p>\n\n\n\n<p>Duke mbetur n\u00eb fuqi \u00e7far\u00eb \u00ebsht\u00eb vendosur nga neni 5, ligji 20.5.1970 n. 300, p\u00ebr sa i p\u00ebrket kontrollit t\u00eb mungesave p\u00ebr shkak t\u00eb s\u00ebmundjes, pal\u00ebt bien dakord si m\u00eb posht\u00eb:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>punonj\u00ebsi q\u00eb mungon \u00ebsht\u00eb i detyruar q\u00ebndroj\u00eb n\u00eb sht\u00ebpin\u00eb e tij, n\u00eb dispozicion p\u00ebr vizitat e kontrollit n\u00eb oraret e p\u00ebrcaktuara nga normat n\u00eb fuqi, dhe pik\u00ebrisht nga ora 10.00 deri n\u00eb or\u00ebn 12.00 dhe nga ora 17.00 deri n\u00eb 19.00;<\/li>\n\n\n\n<li>p\u00ebrve\u00e7 rastit kur largohet p\u00ebr nevoja eventuale t\u00eb dokumentuara, duke munguar nga sht\u00ebpia p\u00ebr vizita, sh\u00ebrbime dhe kontrolle te specialisti si dhe p\u00ebr vizita kontrolli, p\u00ebr t\u00eb cilat punonj\u00ebsi do t&#8217;i jap\u00eb informacion paraprak nd\u00ebrmarrjes.<\/li>\n<\/ul>\n\n\n\n<p>N\u00eb munges\u00eb t\u00eb komunikimeve t\u00eb tilla ose n\u00eb rast vonese p\u00ebrtej afateve t\u00eb p\u00ebrcaktuara m\u00eb sip\u00ebr, p\u00ebrve\u00e7 rasteve kur ka arsye t\u00eb drejta q\u00eb pengojn\u00eb, mungesa konsiderohet e pajustifikuar. \u00c7do ndryshim adrese gjat\u00eb periudh\u00ebs s\u00eb s\u00ebmundjes ose aksidentit joprofesional duhet t&#8217;i komunikohet menj\u00ebher\u00eb nd\u00ebrmarrjes.<\/p>\n\n\n\n<p>N\u00eb p\u00ebrfundim t\u00eb s\u00ebmundjes ose aksidentit, punonj\u00ebsi duhet t\u00eb paraqitet menj\u00ebher\u00eb n\u00eb vendin e tij t\u00eb zakonsh\u00ebm t\u00eb pun\u00ebs.<\/p>\n\n\n\n<p>Punonj\u00ebsi q\u00eb mungon n\u00eb vizitat e kontrollit q\u00eb kryhen n\u00eb oraret e paracaktuara humbet t\u00eb drejt\u00ebn e integrimit nga ana e nd\u00ebrmarrjes p\u00ebr t\u00eb nj\u00ebjt\u00ebn periudh\u00eb p\u00ebr t\u00eb cil\u00ebn INPS (Instituti komb\u00ebtar i sigurimeve shoq\u00ebrore) nuk do t\u00eb paguaj\u00eb pages\u00ebn e s\u00ebmundjes.<\/p>\n\n\n\n<p>P\u00ebrb\u00ebn shkelje t\u00eb r\u00ebnd\u00eb t\u00eb kontrat\u00ebs kryerja e aktiviteteve n\u00eb pun\u00eb edhe n\u00ebse jan\u00eb pa pages\u00eb gjat\u00eb munges\u00ebs.<\/p>\n\n\n\n<p>N\u00eb rast se pun\u00ebtori ka penguar pa nj\u00eb arsye t\u00eb justifikuar sanitare n\u00eb koh\u00ebn e duhur v\u00ebrtetimin e gjendjes s\u00eb s\u00ebmundjes, ai \u00ebsht\u00eb i detyruar t\u00eb kthehet menj\u00ebher\u00eb n\u00eb nd\u00ebrmarrje.<\/p>\n\n\n\n<p>N\u00eb t\u00eb kund\u00ebrt mungesa do t\u00eb konsiderohet e pajustifikuar.<\/p>\n\n\n\n<p>Kuptohet se normativa e sip\u00ebrp\u00ebrmendur do t\u00eb p\u00ebrshtatet n\u00eb lidhje me masat ligjore t\u00eb cilat, n\u00eb vijim t\u00eb k\u00ebsaj marr\u00ebveshjeje, do t\u00eb vendosin n\u00eb lidhje me k\u00ebt\u00eb argument.<\/p>\n\n\n\n<p><strong>TRAJTIMI EKONOMIK P\u00cbR S\u00cbMUNDJE DHE AKSIDENTE P\u00cbR N\u00cbPUN\u00cbSIT<\/strong><\/p>\n\n\n\n<p>N\u00eb rast t\u00eb nd\u00ebrprerjes s\u00eb sh\u00ebrbimit p\u00ebr shkak aksidenti ose s\u00ebmundje, q\u00eb nuk shkaktohen nga ngjarje serioze t\u00eb neglizhenc\u00ebs q\u00eb i atribuohen n\u00ebpun\u00ebsit, p\u00ebr n\u00ebpun\u00ebsin jo n\u00eb prov\u00eb do t\u00eb vendoset trajtimi i m\u00ebposht\u00ebm:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>pages\u00eb, si integrim i trajtimeve INPS, t\u00eb t\u00eb gjith\u00eb pag\u00ebs (rroga dhe kompensimi) p\u00ebr 5 muaj dhe gjysm\u00ebn e saj p\u00ebr 7 muajt e tjer\u00eb. T\u00eb drejta t\u00eb barabarta i takojn\u00eb n\u00ebpun\u00ebsit gjat\u00eb periudh\u00ebs s\u00eb paralajm\u00ebrimit dhe deri n\u00eb skadimin e periudh\u00ebs s\u00eb tij.
