punonj\u00ebsi q\u00eb:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>n\u00eb lidhje me orarin e tij ditor, kryen n\u00eb m\u00ebnyr\u00eb jo t\u00eb jasht\u00ebzakonshme t\u00eb pakt\u00ebn tre or\u00eb nga koha e tij e pun\u00ebs, n\u00eb regjim normal t\u00eb vazhduesh\u00ebm t\u00eb pun\u00ebs, gjat\u00eb periudh\u00ebs nd\u00ebrmjet or\u00ebs 22.00 dhe or\u00ebs 5.00 t\u00eb m\u00ebngjesit; p\u00ebrfshirja e p\u00ebrkohshme n\u00eb nj\u00eb orar gjat\u00eb nat\u00ebs si\u00e7 specifikohet k\u00ebtu konsiderohet &#8220;detyr\u00eb e jasht\u00ebzakonshme&#8221; dhe p\u00ebr k\u00ebt\u00eb arsye nuk n\u00ebnkupton marrjen e kualifikimit si &#8220;punonj\u00ebs nate&#8221;;<\/li>\n\n\n\n<li>n\u00eb lidhje me orarin e tij t\u00eb p\u00ebrgjithsh\u00ebm vjetor t\u00eb pun\u00ebs, kryen n\u00eb m\u00ebnyr\u00eb jo t\u00eb jasht\u00ebzakonshme detyr\u00ebn e tij p\u00ebr t\u00eb pakt\u00ebn tre or\u00eb gjat\u00eb periudh\u00ebs q\u00eb p\u00ebrfshihet nd\u00ebrmjet or\u00ebs 22:00 dhe 5:00 t\u00eb m\u00ebngjesit p\u00ebr nj\u00eb minimum prej 80 dit\u00ebsh pune n\u00eb vit, q\u00eb rip\u00ebrpjes\u00ebtohet p\u00ebr <em>part-time<\/em> (orar t\u00eb reduktuar) vertikal dhe t\u00eb p\u00ebrzier, sipas nenit. 1, paragrafi 2, germa e) e Dekretit legjislativ n. 66\/2003.<\/li>\n<\/ul>\n\n\n\n<p>Nuk konsiderohet pun\u00eb nate n\u00eb baz\u00eb t\u00eb Dekretit legjislativ n. 66\/2003 por i jep t\u00eb drejt\u00ebn e rritjeve t\u00eb parashikuara nga C.C.N.L n\u00eb fuqi, asaj q\u00eb parashikohet n\u00eb lidhje me rastet e m\u00ebposhtme t\u00eb jasht\u00ebzakonshme:<\/p>\n\n\n\n<p>a) pushime q\u00eb p\u00ebrcaktohen nga dor\u00ebheqja e papritur e nj\u00eb punonj\u00ebsi;<\/p>\n\n\n\n<p>b) nevoja p\u00ebr z\u00ebvend\u00ebsim q\u00eb p\u00ebrcaktohet nga mungesa p\u00ebr nj\u00eb afat t\u00eb shkurt\u00ebr e personelit p\u00ebr shkak t\u00eb s\u00ebmundjes, aksidentit dhe\/ose forc\u00ebs madhore;<\/p>\n\n\n\n<p>c) nevoja p\u00ebr t\u00eb z\u00ebvend\u00ebsuar personelin p\u00ebr periudha t\u00eb shkurtra (pushime, leje me pages\u00eb dhe pa pages\u00eb t\u00eb \u00e7do lloji);<\/p>\n\n\n\n<p>d) p\u00ebr kryerjen e pun\u00ebve urgjente dhe t\u00eb jasht\u00ebzakonshme p\u00ebr nj\u00eb koh\u00eb t\u00eb shkurt\u00ebr.<\/p>\n\n\n\n<p>Caktohen n\u00eb pun\u00eb nate me prioritet absolut, punonj\u00ebsit dhe punonj\u00ebset q\u00eb b\u00ebjn\u00eb k\u00ebrkes\u00eb duke marr\u00eb parasysh nevojat organizative t\u00eb nd\u00ebrmarrjes.<br><\/p>\n\n\n\n<p>N\u00eb baz\u00eb t\u00eb nenit 13, paragrafi 1, i Dekretit legjislativ n 66\/2003, n\u00eb rastin e adoptimit t\u00eb nj\u00eb orari t\u00eb artikuluar n\u00eb disa jav\u00eb, periudha e referimit n\u00eb t\u00eb cil\u00ebn duhet llogaritur limiti prej 8 or\u00ebsh n\u00eb 24 or\u00eb, n\u00eb munges\u00eb t\u00eb nj\u00eb rregullimi specifike n\u00eb nivel nd\u00ebrmarrje, p\u00ebrcaktohet si mesatare mbi baz\u00eb tremujore.<\/p>\n\n\n\n<p>N\u00eb baz\u00eb t\u00eb nenit 15 t\u00eb Dekretit legjislativ n. 66\/2003, i cili garanton transferimin nga puna e nat\u00ebs n\u00eb pun\u00ebn e dit\u00ebs, parashikohet q\u00eb n\u00eb rast t\u00eb paaft\u00ebsis\u00eb p\u00ebr t\u00eb b\u00ebr\u00eb pun\u00eb nate t\u00eb konfirmuar nga mjeku kompetent dhe n\u00eb munges\u00eb t\u00eb zgjidhjeve brenda t\u00eb t\u00eb nj\u00ebjtit nivel, pun\u00ebtori mund t\u00eb zhvendoset n\u00eb detyra me nj\u00eb nivel m\u00eb t\u00eb ul\u00ebt me q\u00ebllim p\u00ebr t\u00eb leht\u00ebsuar zgjidhjet q\u00eb synojn\u00eb mbrojtjen e pun\u00ebsimit.<\/p>\n\n\n\n<p>N\u00eb p\u00ebrputhje me parashikimet e nenit 13, paragrafi 2, i Dekretit legjislativ n. 66\/2003, konfirmohen parashikimet n\u00eb k\u00ebt\u00eb fush\u00eb nga kontrata e m\u00ebparshme C.C.N.L.<\/p>\n\n\n\n<p>Fillimi e pun\u00ebs s\u00eb nat\u00ebs paraprihet nga konsultimi i R.S.U.-ve ose, n\u00eb rast se nuk \u00ebsht\u00eb krijuar, t\u00eb R.S.A.-ve ose, n\u00eb munges\u00eb t\u00eb tyre, t\u00eb Sindikatave Territoriale (OO.SS), konsultimi kryhet dhe p\u00ebrfundon brenda dhjet\u00eb dit\u00ebve duke filluar nga komunikimi i pun\u00ebdh\u00ebn\u00ebsit.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tKthehu lart\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Neni 39 &#8211;
