Kontrata e pun\u00ebs me afat t\u00eb pjessh\u00ebm\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Me pun\u00eb me koh\u00eb t\u00eb pjesshme n\u00ebnkuptohet marr\u00ebdh\u00ebnia e pun\u00ebs n\u00eb vart\u00ebsi t\u00eb kryer me or\u00eb t\u00eb reduktuara n\u00eb krahasim me at\u00eb t\u00eb vendosur nga kjo kontrat\u00eb C.C.N.L. dhe mund t\u00eb kryhet me tipologjit\u00eb, mund\u00ebsit\u00eb e p\u00ebrdorimit dhe metodologjit\u00eb e pun\u00ebsimit q\u00eb paraqiten m\u00eb posht\u00eb:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>horizontale,<\/em> kur reduktimi i orarit n\u00eb krahasim me koh\u00ebn e plot\u00eb parashikohet n\u00eb lidhje me orarin normal t\u00eb pun\u00ebs ditore;<\/li>\n\n\n\n<li><em>vertikale<\/em>, kur rezulton e parashikuar q\u00eb aktiviteti i pun\u00ebs t\u00eb kryhet me koh\u00eb t\u00eb plot\u00eb, por t\u00eb kufizuar n\u00eb periudha t\u00eb paracaktuara gjat\u00eb jav\u00ebs, muajit ose vitit;<\/li>\n\n\n\n<li><em>e p\u00ebrzier<\/em>, kur sh\u00ebrbimi realizohet sipas nj\u00eb kombinimi t\u00eb modaliteteve t\u00eb treguara m\u00eb sip\u00ebr, q\u00eb p\u00ebrfshin dit\u00eb ose periudha me koh\u00eb t\u00eb plot\u00eb t\u00eb alternuara me dit\u00eb ose periudha me orar t\u00eb reduktuar ose jo n\u00eb pun\u00eb.<\/li>\n<\/ul>\n\n\n\n<p>Marr\u00ebdh\u00ebnia me koh\u00eb t\u00eb pjesshme do t\u00eb disiplinohet sipas parimeve t\u00eb m\u00ebposhtme:<\/p>\n\n\n\n<p>a) vullneti i pal\u00ebve;<\/p>\n\n\n\n<p>b) kthyeshm\u00ebria e sh\u00ebrbimit nga me koh\u00eb t\u00eb pjesshme n\u00eb me koh\u00eb t\u00eb plot\u00eb n\u00eb lidhje me k\u00ebrkesat e nd\u00ebrmarrjes dhe kur \u00ebsht\u00eb n\u00eb p\u00ebrputhje me detyrat e kryera dhe\/ose q\u00eb do t\u00eb kryhen, pa cenuar aspektin e vullnetsh\u00ebm t\u00eb pal\u00ebve;<\/p>\n\n\n\n<p>c) zbatueshm\u00ebria e normave t\u00eb k\u00ebsaj kontrate C.C.N.L. pasi ato jan\u00eb n\u00eb p\u00ebrputhje me vet\u00eb natyr\u00ebn e marr\u00ebdh\u00ebnies;<\/p>\n\n\n\n<p>d) mund\u00ebsia e modifikimit, me marr\u00ebveshje nd\u00ebrmjet pal\u00ebve, n\u00eb artikulimin strukturor t\u00eb orarit kontraktues.<\/p>\n\n\n\n<p>Personeli me koh\u00eb t\u00eb pjesshme mund t\u00eb pun\u00ebsohet sipas tipologjive specifike kontraktuese t\u00eb p\u00ebrmendura n\u00eb k\u00ebt\u00eb C.C.N.L. dhe nga marr\u00ebveshjet nd\u00ebrkonfederale.<\/p>\n\n\n\n<p>Krijimi i marr\u00ebdh\u00ebnies me koh\u00eb t\u00eb pjesshme do t\u00eb fiksohet nd\u00ebrmjet pun\u00ebdh\u00ebn\u00ebsit dhe punonj\u00ebsit dhe duhet t\u00eb rezultoj\u00eb n\u00eb nj\u00eb akt t\u00eb shkruar, n\u00eb t\u00eb cilin do t\u00eb tregohen:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>detyrat, shp\u00ebrndarja e or\u00ebve n\u00eb lidhje me dit\u00ebn, jav\u00ebn, muajin dhe vitin, koh\u00ebzgjatjen e sh\u00ebrbimit n\u00eb pun\u00eb me orar t\u00eb reduktuar, klauzolat eventuale elastike;<\/li>\n\n\n\n<li>periudha e prov\u00ebs p\u00ebr t\u00eb pun\u00ebsuarit e rinj.<\/li>\n<\/ul>\n\n\n\n<p>Pa cenuar k\u00ebrkesat tekniko-organizative, nd\u00ebrmarrja do t\u00eb vler\u00ebsoj\u00eb pranimin e k\u00ebrkesave p\u00ebr transformimin e marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs me koh\u00eb t\u00eb pjesshme (orar t\u00eb reduktuar). Pal\u00ebt bien dakord q\u00eb n\u00eb k\u00ebt\u00eb kontekst, nd\u00ebrmarrjet do t\u00eb ken\u00eb prirje p\u00ebr t&#8217;u dh\u00ebn\u00eb p\u00ebrpar\u00ebsi k\u00ebrkesave p\u00ebr transformimin e marr\u00ebdh\u00ebnies s\u00eb pun\u00ebs nga me koh\u00eb t\u00eb plot\u00eb n\u00eb me koh\u00eb t\u00eb pjesshme t\u00eb motivuara nga probleme serioze dhe t\u00eb v\u00ebrtetuara sh\u00ebndet\u00ebsore t\u00eb aplikuesit ose nga nevoja e provuar p\u00ebr ndihm\u00eb t\u00eb vazhdueshme t\u00eb prind\u00ebrve, bashk\u00ebshortit ose bashk\u00ebjetuesit, f\u00ebmij\u00ebve ose an\u00ebtar\u00ebve t\u00eb tjer\u00eb t\u00eb familjes q\u00eb jetojn\u00eb s\u00eb bashku pa asnj\u00eb mund\u00ebsi asistence alternative, t\u00eb s\u00ebmur\u00eb r\u00ebnd\u00eb ose me aft\u00ebsi t\u00eb kufizuara ose q\u00eb hyjn\u00eb n\u00eb programet terapeutike dhe t\u00eb rehabilitimit p\u00ebr narkoman\u00eb, ose p\u00ebr t&#8217;u kujdesur p\u00ebr f\u00ebmij\u00ebt deri n\u00eb tet\u00eb vje\u00e7 ose p\u00ebr pjes\u00ebmarrje t\u00eb certifikuar n\u00eb kurse formimi dhe\/ose studimi.<\/p>\n\n\n\n<p>N\u00eb rast t\u00eb transformimit t\u00eb marr\u00ebdh\u00ebnies s\u00eb pun\u00ebs nga me koh\u00eb t\u00eb plot\u00eb n\u00eb me koh\u00eb t\u00eb pjesshme, ajo mund t\u00eb ket\u00eb edhe nj\u00eb koh\u00ebzgjatje t\u00eb paracaktuar e cila, si rregull, nuk do t\u00eb jet\u00eb m\u00eb e vog\u00ebl se 6 muaj dhe m\u00eb shum\u00eb se 24 muaj. Komunikimi p\u00ebrkat\u00ebs p\u00ebr t\u00eb interesuarin do t\u00eb b\u00ebhet sa m\u00eb shpejt t\u00eb jet\u00eb e mundur dhe n\u00eb \u00e7do rast brenda 30 dit\u00ebve nga k\u00ebrkesa. N\u00eb k\u00ebt\u00eb rast, lejohet marrja n\u00eb pun\u00eb e personelit me kontrat\u00eb me afat t\u00eb caktuar, ose rritja e p\u00ebrkohshme e or\u00ebve p\u00ebr personelin me koh\u00eb t\u00eb pjesshme i cili ka b\u00ebr\u00eb k\u00ebrkes\u00eb, p\u00ebr t\u00eb plot\u00ebsuar orarin normal t\u00eb pun\u00ebs ditore, javore, mujore ose vjetore derisa i interesuari t\u00eb respektoj\u00eb orarin e pun\u00ebs me koh\u00eb t\u00eb pjesshme.<\/p>\n\n\n\n<p>Pal\u00ebt n\u00eb kontrat\u00ebn e pun\u00ebs me koh\u00eb t\u00eb pjesshme mund t\u00eb bien dakord p\u00ebr klauzola elastike n\u00eb lidhje me ndryshimin e caktimit t\u00eb koh\u00ebs s\u00eb sh\u00ebrbimit dhe, n\u00eb marr\u00ebdh\u00ebniet me koh\u00eb t\u00eb pjesshme vertikale ose t\u00eb p\u00ebrzier, mund t\u00eb vendosen gjithashtu edhe klauzola q\u00eb lidhen me ndryshimin n\u00eb rritje t\u00eb koh\u00ebzgjatjes s\u00eb sh\u00ebrbimit. Miratimi i punonj\u00ebsit p\u00ebr klauzolat elastike duhet t\u00eb rezultoj\u00eb n\u00eb nj\u00eb akt t\u00eb shkruar edhe pas vendosjes s\u00eb marr\u00ebdh\u00ebnies s\u00eb pun\u00ebs.<\/p>\n\n\n\n<p>Ushtrimi, nga ana e pun\u00ebdh\u00ebn\u00ebsit, i kompetenc\u00ebs p\u00ebr t\u00eb ndryshuar vendin e kryerjes s\u00eb pun\u00ebs ose p\u00ebr t\u00eb rritur koh\u00ebzgjatjen e saj b\u00ebhet me nj\u00eb njoftim, n\u00eb favor t\u00eb punonj\u00ebsit, jo m\u00eb pak se 48 or\u00eb p\u00ebrpara.<\/p>\n\n\n\n<p>Vet\u00ebm p\u00ebr or\u00ebt e pun\u00ebs t\u00eb b\u00ebra jasht\u00eb orarit p\u00ebr t\u00eb cilin \u00ebsht\u00eb r\u00ebn\u00eb dakord n\u00eb momentin e vendosjes s\u00eb marr\u00ebdh\u00ebnies me koh\u00eb t\u00eb pjesshme, sipas regjimit t\u00eb klauzol\u00ebs elastike (ish-klauzola fleksib\u00ebl), punonj\u00ebsi ka t\u00eb drejt\u00eb p\u00ebr nj\u00eb rritje prej 10% t\u00eb pag\u00ebs orare globale <em>de facto.<\/em><\/p>\n\n\n\n<p>P\u00ebr kryerjen e or\u00ebve shtes\u00eb t\u00eb pun\u00ebs t\u00eb k\u00ebrkuara sipas regjimit t\u00eb klauzolave elastike, jasht\u00eb orareve t\u00eb kontraktuara, punonj\u00ebsit i takon ajo q\u00eb p\u00ebrshkruhet n\u00eb paragrafin 14 t\u00eb k\u00ebtij neni, t\u00eb rritur me 1,5% m\u00eb shum\u00eb.<\/p>\n\n\n\n<p>N\u00eb rastin e arsyeve t\u00eb r\u00ebnda personale, ose arsyeve t\u00eb v\u00ebrtetuara teknike, organizative dhe t\u00eb prodhimit t\u00eb nd\u00ebrmarrjes, mund t\u00eb arrihet n\u00eb nj\u00eb pezullim t\u00eb p\u00ebrkohsh\u00ebm t\u00eb klauzol\u00ebs elastike.<\/p>\n\n\n\n<p>Akti me shkrim i pranimit t\u00eb klauzolave elastike duhet t\u00eb parashikoj\u00eb t\u00eb drejt\u00ebn e punonj\u00ebsit p\u00ebr t\u00eb denoncuar vet\u00eb marr\u00ebveshjen, gjat\u00eb rrjedh\u00ebs s\u00eb marr\u00ebdh\u00ebnies s\u00eb pun\u00ebs me koh\u00eb t\u00eb pjesshme n\u00eb rastet e m\u00ebposhtme:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>fillim i v\u00ebrtetuar i nj\u00eb aktiviteti tjet\u00ebr pune;<\/li>\n\n\n\n<li>nevoja p\u00ebr mbrojtjen e sh\u00ebndetit, t\u00eb certifikuara nga sh\u00ebrbimi sanitar publik;<\/li>\n\n\n\n<li>nevoja q\u00eb lidhen me lejen e lindjes dhe lejen e at\u00ebsis\u00eb (leja e babait p\u00ebr nevoja t\u00eb f\u00ebmij\u00ebs);<\/li>\n\n\n\n<li>nevoja personale t\u00eb lidhura me arsye t\u00eb r\u00ebnda familjare t\u00eb p\u00ebrmendura n\u00eb ligjin n. 53\/2000;<\/li>\n\n\n\n<li>patologji t\u00eb r\u00ebnda ose onkologjike q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me: bashk\u00ebshortin, bashk\u00ebjetuesin n\u00eb p\u00ebrputhje me ligjin L. 76\/2016, f\u00ebmij\u00eb, prind\u00ebr;<\/li>\n\n\n\n<li>f\u00ebmij\u00eb bashk\u00ebjetues me mosh\u00eb jo m\u00eb t\u00eb madhe se 13 vje\u00e7;<\/li>\n\n\n\n<li>f\u00ebmij\u00eb bashk\u00ebjetues me handikap;<\/li>\n\n\n\n<li>pun\u00ebtor student.<\/li>\n<\/ul>\n\n\n\n<p>Ky denoncim, n\u00eb form\u00eb t\u00eb shkruar, duhet t\u00eb shoq\u00ebrohet me nj\u00eb paralajm\u00ebrim prej t\u00eb pakt\u00ebn 30 dit\u00ebsh, me p\u00ebrjashtim t\u00eb rasteve q\u00eb v\u00ebrtetohen sipas nevoj\u00ebs dhe urgjenc\u00ebs n\u00eb lidhje me gjendjen sh\u00ebndet\u00ebsore t\u00eb punonj\u00ebsit ose t\u00eb familjarit.<\/p>\n\n\n\n<p>Si rrjedhim i denoncimit t\u00eb p\u00ebrmendur n\u00eb paragrafin e m\u00ebparsh\u00ebm, pushon e drejta e pun\u00ebdh\u00ebn\u00ebsit p\u00ebr t\u00eb ndryshuar koh\u00ebn e kryerjes s\u00eb pun\u00ebs s\u00eb r\u00ebn\u00eb dakord fillimisht, ose rritjen e saj n\u00eb zbatimin t\u00eb klauzolave \u200b\u200belastike.<\/p>\n\n\n\n<p>Pun\u00ebdh\u00ebn\u00ebsi, nga ana tjet\u00ebr, mund t\u00eb t\u00ebrhiqet nga marr\u00ebveshja me nj\u00eb paralajm\u00ebrim me t\u00eb pakt\u00ebn nj\u00eb muaj p\u00ebrpara.<\/p>\n\n\n\n<p>Refuzimi eventual i punonj\u00ebsit p\u00ebr t\u00eb n\u00ebnshkruar klauzola elastike nuk integron t\u00eb dh\u00ebnat p\u00ebr nj\u00eb arsye t\u00eb justifikuar p\u00ebr pushim nga puna e as adoptimin e masave disiplinore. Ndryshimi i koh\u00ebs s\u00eb sh\u00ebrbimit nuk jep t\u00eb drejt\u00ebn e kompensimit t\u00eb p\u00ebrmendur n\u00eb pik\u00ebn 9 n\u00eb rastet kur ndryshimi i sip\u00ebrp\u00ebrmendur k\u00ebrkohet nga punonj\u00ebsi i interesuar p\u00ebr shkak t\u00eb nevojave apo zgjedhjeve t\u00eb tij.<\/p>\n\n\n\n<p>Puna shtes\u00eb \u00ebsht\u00eb ajo q\u00eb korrespondon me pun\u00ebn e kryer p\u00ebrtej orarit t\u00eb pun\u00ebs t\u00eb r\u00ebn\u00eb dakord nd\u00ebrmjet pal\u00ebve n\u00eb kontrat\u00ebn individuale dhe brenda limitit me koh\u00eb t\u00eb plot\u00eb.<\/p>\n\n\n\n<p>Duke marr\u00eb parasysh nevojat specifike teknike, organizative dhe prodhuese t\u00eb sektorit, lejohet kryerja e pun\u00ebs shtes\u00eb deri n\u00eb arritjen e orarit me koh\u00eb t\u00eb plot\u00eb ditore dhe\/ose javore sipas nenit 30 t\u00eb k\u00ebsaj kontrate kolektive. Refuzimi eventual i punonj\u00ebsit p\u00ebr t\u00eb b\u00ebr\u00eb or\u00eb pune shtes\u00eb nuk integron detajet e motivit s\u00eb justifikuar t\u00eb pushimit nga puna dhe as adoptimin e masave disiplinore. Or\u00ebt e pun\u00ebs shtes\u00eb paguhen si or\u00eb t\u00eb zakonshme, t\u00eb shtuara n\u00eb p\u00ebrputhje me nenin 6, paragrafi 2, i D.Lgjs. 81\/2015 t\u00eb p\u00ebrqindjes s\u00eb shp\u00ebrblimit t\u00eb or\u00ebve shtes\u00eb n\u00eb t\u00eb gjitha institutet e pagave indirekte dhe me shtyrje afati, p\u00ebrfshir\u00eb TFR, t\u00eb p\u00ebrcaktuar n\u00eb m\u00ebnyr\u00eb konvencionale dhe n\u00eb m\u00ebnyr\u00eb aforfe, nd\u00ebrmjet pal\u00ebve, n\u00eb mas\u00ebn 28%, t\u00eb llogaritur mbi pag\u00ebn baz\u00eb dhe t\u00eb paguar n\u00eb muajin pasues, pas kryerjes s\u00eb sh\u00ebrbimit. P\u00ebrkufizimi i sa m\u00eb sip\u00ebr \u00ebsht\u00eb n\u00eb p\u00ebrputhje me at\u00eb q\u00eb parashikohet n\u00eb nenin 6 t\u00eb D.Lgjs. 81\/2015. P\u00ebr koh\u00eb t\u00eb pjesshme vertikale dhe t\u00eb p\u00ebrziera, kjo vler\u00eb duhet t\u00eb jet\u00eb proporcionale n\u00eb nj\u00eb mas\u00eb prej 60 or\u00ebsh n\u00eb muaj dhe 600 or\u00ebsh n\u00eb vit. Sh\u00ebrbimi i pun\u00ebs ditore nuk mund t\u00eb jet\u00eb m\u00eb pak se dy or\u00eb. N\u00ebse nuk \u00ebsht\u00eb e mundur t\u00eb arrihen minimumet e p\u00ebrmendura n\u00eb nj\u00eb vendndodhje t\u00eb vetme sh\u00ebrbimi, pal\u00ebt pranojn\u00eb se respektimi i tij \u00ebsht\u00eb i mundur vet\u00ebm n\u00ebse punonj\u00ebsi \u00ebsht\u00eb i disponuesh\u00ebm p\u00ebr t\u00eb punuar me disa kontrata ku nd\u00ebrmarrja i ka ato n\u00eb t\u00eb nj\u00ebjt\u00ebn zon\u00eb territoriale dhe nuk ka pengesa t\u00eb natyr\u00ebs teknike-produktive dhe organizative q\u00eb rrjedhin nga kriteret dhe modalitetet e ekzekutimit t\u00eb sh\u00ebrbimeve.<\/p>\n\n\n\n<p>Trajtimi ekonomik dhe normativ i punonj\u00ebsit t\u00eb pun\u00ebsuar me koh\u00eb t\u00eb pjesshme p\u00ebrcaktohet n\u00eb baz\u00eb t\u00eb rregullit t\u00eb p\u00ebrpjes\u00ebtimit me orarin e kontraktuar n\u00eb lidhje me trajtimin kontraktues t\u00eb punonj\u00ebsve me koh\u00eb t\u00eb plot\u00eb.<\/p>\n\n\n\n<p>Punonj\u00ebsit me koh\u00eb t\u00eb pjesshme llogariten n\u00eb p\u00ebrpjes\u00ebtim me orarin e tyre kontraktues.<\/p>\n\n\n\n<p>N\u00eb rast se punonj\u00ebsi n\u00eb marr\u00ebdh\u00ebnie pune me koh\u00eb t\u00eb pjesshme ofron sh\u00ebrbimet tij p\u00ebr pun\u00eb n\u00eb 2 kontrata p\u00ebr t\u00eb arritur minimumin javor, nuk aplikohet normativa sipas paragrafit 21 t\u00eb nenit 30, p\u00ebr pjes\u00ebn q\u00eb ka t\u00eb b\u00ebj\u00eb me zhvendosjen nga nj\u00eb vend pune n\u00eb tjetrin.
