Orari i pun\u00ebs\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>P\u00ebr koh\u00ebzgjatjen e orarit t\u00eb pun\u00ebs i referohemi normave ligjore dhe derogimeve (kufizim i norm\u00ebs) dhe p\u00ebrjashtimeve p\u00ebrkat\u00ebse.<\/p>\n\n\n\n<p>Koh\u00ebzgjatja e orarit sipas kontrat\u00ebs s\u00eb pun\u00ebs \u00ebsht\u00eb 40 or\u00eb n\u00eb jav\u00eb, me p\u00ebrjashtim t\u00eb rasteve t\u00eb parashikuara n\u00eb nenet e m\u00ebposhtme 32 e 33.<\/p>\n\n\n\n<p>Sipas nenit 4, paragrafi i kat\u00ebrt, i Dekretit legjislativ n. 66\/2003, koh\u00ebzgjatja mesatare javore e koh\u00ebs s\u00eb pun\u00ebs, duke p\u00ebrfshir\u00eb pun\u00ebn jasht\u00eb orarit, llogaritet duke iu referuar nj\u00eb periudhe jo m\u00eb t\u00eb gjat\u00eb se gjasht\u00eb muaj.<\/p>\n\n\n\n<p>Ky afat mund t\u00eb rritet deri n\u00eb dymb\u00ebdhjet\u00eb muaj me marr\u00ebveshje t\u00eb nivelit t\u00eb dyt\u00eb, n\u00eb lidhje me nevojat q\u00eb lidhen me ndryshimet n\u00eb intensitetin e aktivitetit t\u00eb pun\u00ebs si dhe me nevojat teknike, prodhuese dhe organizative sektoriale.<\/p>\n\n\n\n<p>P\u00ebr sa i p\u00ebrket orarit t\u00eb pun\u00ebs me shum\u00eb periudha sipas nenit 31 t\u00eb kontrat\u00ebs C.C.N.L. periudha e referimit \u00ebsht\u00eb megjithat\u00eb dymb\u00ebdhjet\u00eb muaj.<\/p>\n\n\n\n<p>Sh\u00ebrbimi shp\u00ebrndahet n\u00eb 5 dit\u00eb pune radhazi.<\/p>\n\n\n\n<p>2 dit\u00ebt e pushimit duhet t\u00eb p\u00ebrfshijn\u00eb t\u00eb diel\u00ebn, me p\u00ebrjashtim t\u00eb rasteve t\u00eb veprimtarive t\u00eb pun\u00ebs n\u00eb sektor\u00ebt e sh\u00ebrbimeve publike dhe atyre t\u00eb aktiviteteve me cik\u00ebl t\u00eb vazhduesh\u00ebm.<\/p>\n\n\n\n<p>N\u00eb p\u00ebrjashtim nga sa m\u00eb sip\u00ebr, p\u00ebr nevoja teknike ose prodhuese apo organizative, duke l\u00ebn\u00eb n\u00eb fuqi pushimin e s\u00eb diel\u00ebs, dita tjet\u00ebr e pushimit mund t\u00eb shfryt\u00ebzohet gjat\u00eb gjith\u00eb jav\u00ebs.<\/p>\n\n\n\n<p>Zbatimi i asaj q\u00eb u tha m\u00eb sip\u00ebr dhe programimi i pushimeve do t\u00eb b\u00ebhet pas diskutimit nd\u00ebrmjet pal\u00ebve dhe do t&#8217;u b\u00ebhet i njohur punonj\u00ebsve t\u00eb interesuar t\u00eb pakt\u00ebn 15 dit\u00eb p\u00ebrpara, brenda afatit t\u00eb duhur ose sidoqoft\u00eb paraprakisht.\u00a0<\/p>\n\n\n\n<p>Me p\u00ebrfaq\u00ebsuesit e sindikatave t\u00eb nd\u00ebrmarrjes, ose me p\u00ebrfaq\u00ebsimin sindikal unitar, t\u00eb asistuara nga Organizatat sindikale territoriale, mund t\u00eb bihet dakord p\u00ebr nj\u00eb shp\u00ebrndarje n\u00eb 6 dit\u00eb n\u00eb lidhje me nevojat e nd\u00ebrmarrjes.<\/p>\n\n\n\n<p>N\u00eb rastin e sh\u00ebrbimit n\u00eb dit\u00ebn e 6<sup>t\u00eb<\/sup>, do t\u00eb paguhet paga e p\u00ebrgjithshme orare, p\u00ebr or\u00ebt e pun\u00ebs s\u00eb b\u00ebr\u00eb, me nj\u00eb rritje prej 25%, e llogaritur mbi pag\u00ebn baz\u00eb. Duke filluar nga hyrja n\u00eb fuqi e k\u00ebsaj kontrate C.C.N.L., n\u00eb marr\u00ebveshjet e nivelit t\u00eb dyt\u00eb, t\u00eb n\u00ebnshkruara n\u00eb p\u00ebrputhje me nenin 3 t\u00eb k\u00ebsaj C.C.N.L., pal\u00ebt n\u00ebnshkruese mund t\u00eb bien dakord t\u00eb mos e aplikojn\u00eb k\u00ebt\u00eb rritje n\u00ebse sh\u00ebrbimi n\u00eb dit\u00ebn e gjasht\u00eb \u00ebsht\u00eb vendosur n\u00eb zbatim t\u00eb nj\u00eb rritje strukturore, m\u00eb t\u00eb lart\u00eb se minimumi kontraktues sipas nenit 33 t\u00eb k\u00ebsaj kontrate C.C.N.L., i or\u00ebve individuale kontraktuese t\u00eb pun\u00ebs p\u00ebr t\u00eb cilat pal\u00ebt kan\u00eb r\u00ebn\u00eb dakord nd\u00ebrmjet tyre; kjo nuk do t\u00eb zbatohet m\u00eb n\u00eb rastin e nj\u00eb reduktimi t\u00eb m\u00ebvonsh\u00ebm t\u00eb orarit p\u00ebr t\u00eb cilin \u00ebsht\u00eb r\u00ebn\u00eb dakord.<\/p>\n\n\n\n<p>Shp\u00ebrndarja ditore e orarit t\u00eb pun\u00ebs mund t\u00eb artikulohet n\u00eb jo m\u00eb shum\u00eb se dy fraksione. N\u00eb baz\u00eb t\u00eb asaj q\u00eb \u00ebsht\u00eb parashikuar nga neni 7 i Dekretit legjislativ n. 66\/2003 pushimi ditor prej 11 or\u00ebsh duhet t\u00eb shfryt\u00ebzohet n\u00eb m\u00ebnyr\u00eb t\u00eb nj\u00ebpasnj\u00ebshme, me p\u00ebrjashtim t\u00eb aktiviteteve t\u00eb karakterizuara nga dy fraksione pune gjat\u00eb dit\u00ebs. N\u00eb \u00e7do rast, do t\u00eb garantohet nj\u00eb pushim ditor prej t\u00eb pakt\u00ebn 8 or\u00ebsh radhazi. Ajo p\u00ebr t\u00eb cil\u00ebn \u00ebsht\u00eb r\u00ebn\u00eb dakord n\u00eb k\u00ebt\u00eb paragraf \u00ebsht\u00eb vendosur n\u00eb zbatim t\u00eb nenit 17, paragrafi 4, i Dekretit legjislativ n. 66\/2003.<\/p>\n\n\n\n<p>Duke l\u00ebn\u00eb n\u00eb fuqi situatat aktuale, me efekt nga data 2 maj 1980, \u00ebsht\u00eb shfuqizuar mund\u00ebsia p\u00ebr t\u00eb r\u00ebn\u00eb dakord p\u00ebr nj\u00eb turn t\u00eb 3<sup>t\u00eb<\/sup> ditor ish-neni 22, paragrafi 8 i kontrat\u00ebs C.C.N.L. (Kontrata Kolektive Komb\u00ebtare e Pun\u00ebs) 13 dhjetor 1977.<\/p>\n\n\n\n<p>Or\u00ebt e pun\u00ebs t\u00eb kryera n\u00eb mbi 40 or\u00eb n\u00eb jav\u00eb do t\u00eb kompensohen me nj\u00eb rritje prej 25% t\u00eb llogaritura mbi pag\u00ebn baz\u00eb.<\/p>\n\n\n\n<p>P\u00ebrqindjet e rritjes, t\u00eb p\u00ebrmendura n\u00eb paragraf\u00ebt 11 dhe 14 (sh\u00ebrbimi n\u00eb dit\u00ebn e 6<sup>t\u00eb<\/sup> t\u00eb jav\u00ebs dhe zgjatja e orarit) nuk mund t\u00eb grumbullohen bashk\u00eb me nj\u00ebra-tjetr\u00ebn (n\u00eb kuptimin q\u00eb m\u00eb e madhja p\u00ebrjashton m\u00eb t\u00eb vogl\u00ebn) dhe nuk mund t\u2019i shtohen nj\u00ebra tjetr\u00ebs gjithashtu rritjet e parashikuara n\u00eb nenin e m\u00ebposht\u00ebm 38 (pun\u00eb jasht\u00eb orarit, turne nate, gjat\u00eb festave).<\/p>\n\n\n\n<p>Orari i pun\u00ebs duhet t\u00eb llogaritet nga koha e caktuar m\u00eb par\u00eb e vendosur nga nd\u00ebrmarrja p\u00ebr fillimin e aktivitetit t\u00eb pun\u00ebs.<\/p>\n\n\n\n<p>N\u00ebse pun\u00ebtori, duke u paraqitur n\u00eb or\u00ebn e caktuar m\u00eb par\u00eb, p\u00ebr fillimin e sh\u00ebrbimit ditor, nuk do t\u00eb ishte i p\u00ebrshtatsh\u00ebm p\u00ebr pun\u00eb ose do t\u2019i k\u00ebrkohej t\u00eb kryej\u00eb nj\u00eb sh\u00ebrbim me koh\u00ebzgjatje m\u00eb t\u00eb vog\u00ebl se orari i caktuar, ai ka t\u00eb drejt\u00ebn e trajtimit t\u00eb pages\u00ebs q\u00eb do t\u2019i kishte takuar nj\u00ebsoj sikur t\u00eb kishte punuar.<\/p>\n\n\n\n<p>Gjat\u00eb dit\u00ebs dhe gjat\u00eb or\u00ebve m\u00eb pak t\u00eb ngarkuara me pun\u00eb, punonj\u00ebsi ka t\u00eb drejt\u00eb p\u00ebr t\u00eb pakt\u00ebn nj\u00eb or\u00eb pushim pa pages\u00eb, p\u00ebr t\u00eb konsumuar ushqimin e dit\u00ebs.<\/p>\n\n\n\n<p>Nd\u00ebrmarrja n\u00eb vendosjen e turneve t\u00eb pun\u00ebs ose t\u00eb pushimit nd\u00ebrmjet personelit me t\u00eb nj\u00ebjtat kategori, do t\u00eb ket\u00eb kujdes q\u00eb, n\u00eb p\u00ebrputhje me k\u00ebrkesat e nd\u00ebrmarrjes, t\u00eb koordinohen n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb dielat dhe or\u00ebt e nat\u00ebs t\u00eb ndahen n\u00eb m\u00ebnyr\u00eb t\u00eb barabart\u00eb nd\u00ebrmjet vet\u00eb personelit, duke i garantuar secilit, p\u00ebrve\u00e7 pushimit ditor, 24 or\u00eb pushim t\u00eb pand\u00ebrprer\u00eb p\u00ebr \u00e7do jav\u00eb.<\/p>\n\n\n\n<p>Orari i pun\u00ebs dhe turnet duhet t\u00eb p\u00ebrgatiten nga nd\u00ebrmarrja n\u00eb m\u00ebnyr\u00eb q\u00eb personeli t\u00eb ket\u00eb dijeni menj\u00ebher\u00eb p\u00ebr to.<\/p>\n\n\n\n<p>N\u00eb rastin e pun\u00ebs me turne, personeli i turnit q\u00eb ka p\u00ebrfunduar nuk mund t\u00eb largohet nga sh\u00ebrbimi n\u00ebse nuk \u00ebsht\u00eb z\u00ebvend\u00ebsuar nga personeli i turnit pasardh\u00ebs, brenda nj\u00eb limiti prej 2 or\u00ebsh.<\/p>\n\n\n\n<p>Koha e shpenzuar n\u00eb dispozicion t\u00eb nd\u00ebrmarrjes &#8211; n\u00eb pritje t\u00eb pun\u00ebsimit, p\u00ebr zhvendosje nga nj\u00eb vend pune n\u00eb tjetrin edhe sikur t\u00eb ishin ato t\u00eb zakonshmit, dhe p\u00ebr \u00e7do q\u00ebndrim pa pun\u00eb gjat\u00eb orarit t\u00eb pun\u00ebs p\u00ebr shkak t\u00eb nevojave t\u00eb nd\u00ebrmarrjes &#8211; llogaritet n\u00eb orarin efektiv t\u00eb pun\u00ebs si sh\u00ebrbim pune dhe paguhet si i till\u00eb.<br><\/p>\n\n\n\n<p>Shpenzimet e udh\u00ebtimit q\u00eb punonj\u00ebsi p\u00ebrballon p\u00ebr arsye pune gjat\u00eb sh\u00ebrbimit t\u00eb tij ditor &#8211; duke p\u00ebrfshir\u00eb edhe ato q\u00eb rrjedhin nga zhvendosjet nga nj\u00eb vend pune n\u00eb tjetrin, edhe n\u00ebse jan\u00eb ata t\u00eb zakonshmit &#8211; rimbursohen nga nd\u00ebrmarrja.
