Kontrata e pun\u00ebs me afat t\u00eb caktuar\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Pal\u00ebt n\u00ebnshkruese t\u00eb kontrat\u00ebs bazohen te normat komunitare dhe komb\u00ebtare t\u00eb cilat p\u00ebrcaktojn\u00eb se kontratat e pun\u00ebsimit me koh\u00eb t\u00eb pacaktuar jan\u00eb dhe do t\u00eb vazhdojn\u00eb t\u00eb jen\u00eb forma e zakonshme e marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs vart\u00ebse dhe q\u00eb pohojn\u00eb se kontratat me afat t\u00eb caktuar p\u00ebrfaq\u00ebsojn\u00eb nj\u00eb karakteristik\u00eb t\u00eb pun\u00ebsimit n\u00eb disa sektor\u00eb, pun\u00ebsime dhe aktivitete q\u00eb synojn\u00eb plot\u00ebsimin e k\u00ebrkesave si t\u00eb nd\u00ebrmarrjeve ashtu edhe t\u00eb punonj\u00ebsve.<\/p>\n\n\n\n<p>Pun\u00ebsimi me kontrat\u00eb me afat t\u00eb caktuar b\u00ebhet n\u00eb p\u00ebrputhje me normativ\u00ebn n\u00eb fuqi.<\/p>\n\n\n\n<p>P\u00ebr kontrat\u00ebn e pun\u00ebs me afat t\u00eb caktuar, t\u00eb n\u00ebnshkruar n\u00eb baz\u00eb t\u00eb nenit 19 i D.Lgjs. 81\/2015 dhe ndryshimet dhe integrimet e m\u00ebvonshme, mund t\u00eb vendoset nj\u00eb afat p\u00ebr nj\u00eb koh\u00ebzgjatje jo m\u00eb shum\u00eb se 12 muaj pa motivim.<\/p>\n\n\n\n<p>Kontrata mund t\u00eb ket\u00eb nj\u00eb koh\u00ebzgjatje m\u00eb t\u00eb madhe, por n\u00eb \u00e7do rast jo m\u00eb shum\u00eb se 24 muaj, vet\u00ebm n\u00eb prani t\u00eb t\u00eb pakt\u00ebn nj\u00eb motivi nga ata q\u00eb parashikohen nga Ligji.<\/p>\n\n\n\n<p>Afati i kontrat\u00ebs mund t\u00eb zgjatet lirisht n\u00eb dymb\u00ebdhjet\u00eb muajt e par\u00eb dhe m\u00eb pas vet\u00ebm n\u00eb prani t\u00eb motiveve t\u00eb parashikuara n\u00eb ligj.<\/p>\n\n\n\n<p>Duke pasur parasysh ve\u00e7orit\u00eb e sektorit, n\u00eb p\u00ebrputhje me p\u00ebrmbajtjen e nenit 19, paragrafi 2, D.Lgjs. 81\/2015, koh\u00ebzgjatja e marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs me afat t\u00eb caktuar q\u00eb kalon nd\u00ebrmjet t\u00eb nj\u00ebjtit pun\u00ebdh\u00ebn\u00ebs dhe t\u00eb nj\u00ebjtit punonj\u00ebs, si rezultat i nj\u00eb s\u00ebr\u00eb kalime kontratash, t\u00eb lidhura p\u00ebr kryerjen e detyrave me nivel t\u00eb barabart\u00eb dhe kategori ligjore dhe pavar\u00ebsisht nga periudhat e nd\u00ebrprerjes nd\u00ebrmjet nj\u00eb kontrate dhe nj\u00eb tjetre, zgjatet n\u00eb 36 muaj.<\/p>\n\n\n\n<p>N\u00eb lidhje me pun\u00ebtor\u00ebt sipas paragrafit t\u00eb m\u00ebparsh\u00ebm, e drejta p\u00ebr t\u00eb pun\u00ebsuar me afat t\u00eb caktuar ose e zgjatjes dhe\/ose e rinovimit, q\u00eb e kalon afatin prej 24 muajsh, nuk mund t\u00eb ushtrohet nga pun\u00ebdh\u00ebn\u00ebsit t\u00eb cil\u00ebt n\u00eb at\u00eb koh\u00eb, nuk kan\u00eb shnd\u00ebrruar n\u00eb marr\u00ebdh\u00ebnie pune me koh\u00eb t\u00eb pacaktuar t\u00eb pakt\u00ebn 20% t\u00eb pun\u00ebtor\u00ebve, kontrata e t\u00eb cil\u00ebve me afat t\u00eb caktuar t\u00eb ket\u00eb skaduar n\u00eb 12 muajt e m\u00ebparsh\u00ebm.<\/p>\n\n\n\n<p>N\u00eb baz\u00eb t\u00eb nenit 19, paragrafi 3 t\u00eb D.Lgjs. n. 81\/2015, p\u00ebrve\u00e7 periudh\u00ebs maksimale, si\u00e7 p\u00ebrcaktohet m\u00eb sip\u00ebr, koh\u00ebzgjatja maksimale e kontrat\u00ebs s\u00eb m\u00ebtejshme pasuese me afat t\u00eb caktuar \u00ebsht\u00eb e barabart\u00eb me nj\u00eb periudh\u00eb jo m\u00eb t\u00eb gjat\u00eb se 6 muaj. Lidhja e k\u00ebsaj kontrate t\u00eb m\u00ebtejshme pasuese me afat t\u00eb caktuar do t\u00eb b\u00ebhet pran\u00eb Inspektoratit Territorial t\u00eb Pun\u00ebs kompetent dhe me asistenc\u00ebn e nj\u00eb p\u00ebrfaq\u00ebsuesi sindikal t\u00eb sindikatave (OO.SS.), n\u00ebnshkruese t\u00eb k\u00ebsaj kontrate C.C.N.L. n\u00eb t\u00eb cil\u00ebn punonj\u00ebsi \u00ebsht\u00eb i regjistruar dhe\/ose i jep mandatin.<\/p>\n\n\n\n<p>Pal\u00ebt bien dakord q\u00eb nuk mund t\u00eb pun\u00ebsohen punonj\u00ebs me kontrat\u00eb me afat t\u00eb caktuar m\u00eb shum\u00eb se 25% t\u00eb mesatares vjetore, q\u00eb i referohet vitit kalendarik para pun\u00ebsimit, t\u00eb numrit t\u00eb pun\u00ebtor\u00ebve me koh\u00eb t\u00eb pacaktuar me rrumbullakim t\u00eb numrit dhjetor n\u00eb nj\u00ebsin\u00eb m\u00eb t\u00eb lart\u00eb n\u00ebse ai \u00ebsht\u00eb e barabart\u00eb ose m\u00eb i madh se 0,5. P\u00ebr pun\u00ebdh\u00ebn\u00ebsit q\u00eb pun\u00ebsojn\u00eb deri n\u00eb pes\u00eb punonj\u00ebs \u00ebsht\u00eb gjithmon\u00eb e mundur t\u00eb lidhet nj\u00eb kontrat\u00eb pune me afat t\u00eb caktuar.<\/p>\n\n\n\n<p>N\u00eb lidhje me ve\u00e7orit\u00eb e sektorit dhe n\u00eb zbatim t\u00eb referenc\u00ebs legjislative p\u00ebr kontraktimet kolektive t\u00eb parashikuar nga neni 19, paragrafi 2, D.Lgjs. n. 81\/2015, p\u00ebr aktivitetet sezonale, t\u00eb p\u00ebrcaktuara n\u00eb k\u00ebt\u00eb nen dhe atyre t\u00eb parashikuara n\u00eb D.P.R. (Dekretin e Presidentit t\u00eb Republik\u00ebs) 1525\/1963, nuk aplikohet caku kohor dhe p\u00ebrqindja e p\u00ebrmendur n\u00eb paragraf\u00ebt e m\u00ebparsh\u00ebm.<\/p>\n\n\n\n<p>Njihet natyra sezonale e aktiviteteve t\u00eb kontrollit t\u00eb deratizimit (zhdukja e minjve) dhe dezinfestimit (zhdukja e parazit\u00ebve).<\/p>\n\n\n\n<p>N\u00eb rastet e evidentuara m\u00eb sip\u00ebr, me rastin e krijimit t\u00eb nj\u00eb marr\u00ebdh\u00ebnie pune me afat t\u00eb caktuar, do t\u00eb specifikohet n\u00eb kontrat\u00ebn individuale \u201csezonal\u201d si arsye p\u00ebr t\u00eb cil\u00ebn \u00ebsht\u00eb vendosur afati.<\/p>\n\n\n\n<p>Pal\u00ebt bien dakord q\u00eb sezonaliteti si\u00e7 p\u00ebrcaktohet n\u00eb paragraf\u00ebt e m\u00ebsip\u00ebrm \u00ebsht\u00eb n\u00eb p\u00ebrputhje me k\u00ebrkesat ligjore t\u00eb k\u00ebrkuara nga D.Lgjs. (Dekreti legjislativ) 81\/2015 n\u00eb p\u00ebrputhje me aplikimin e normativave specifike.<\/p>\n\n\n\n<p>N\u00eb zbatim t\u00eb nenit 23 t\u00eb D.Lgjs. 81\/2015, p\u00ebrjashtohen nga kufiri i p\u00ebrqindjes s\u00eb m\u00ebsip\u00ebrme kontratat me afat t\u00eb caktuar t\u00eb lidhura:<\/p>\n\n\n\n<p>a) me faz\u00ebn fillestare t\u00eb aktiviteteve t\u00eb reja. P\u00ebr faz\u00ebn e fillimit t\u00eb nj\u00eb aktiviteti t\u00eb ri n\u00ebnkuptohet nj\u00eb periudh\u00eb kohe deri n\u00eb 6 muaj. Nuk mund t\u00eb p\u00ebrfshihen n\u00eb k\u00ebt\u00eb norm\u00eb punonj\u00ebsit me koh\u00eb t\u00eb pacaktuar q\u00eb vijn\u00eb nga ndryshimet e kontratave nga kantieret e tjera. N\u00eb nivel territorial, me organizatat sindikale (OO.SS.) n\u00ebnshkruese t\u00eb kontrat\u00ebs C.C.N.L., do t\u00eb jet\u00eb e mundur t\u00eb bien dakord p\u00ebr pun\u00ebsime me kontrat\u00eb me afat t\u00eb caktuar n\u00eb fazat e fillimit t\u00eb nj\u00eb aktiviteti t\u00eb ri q\u00eb tejkalon periudh\u00ebn e p\u00ebrmendur;<\/p>\n\n\n\n<p>b) me kryerjen e aktiviteteve sezonale, t\u00eb p\u00ebrcaktuara si m\u00eb sip\u00ebr, dhe t\u00eb veprimtarive t\u00eb parashikuara D.P.R. 1525\/1963;<\/p>\n\n\n\n<p>c) me z\u00ebvend\u00ebsimin e punonj\u00ebsve q\u00eb mungojn\u00eb;<\/p>\n\n\n\n<p>d) me punonj\u00ebs me mosh\u00eb m\u00eb t\u00eb madhe se 50 vje\u00e7.<\/p>\n\n\n\n<p>Pal\u00ebt bien dakord q\u00eb punonj\u00ebsit q\u00eb kan\u00eb ofruar aktivitetin e tyre n\u00eb ekzekutimin e nj\u00eb ose m\u00eb shum\u00eb kontratave me afat t\u00eb caktuar, tek i nj\u00ebjti pun\u00ebdh\u00ebn\u00ebs, p\u00ebr nj\u00eb periudh\u00eb m\u00eb t\u00eb gjat\u00eb se 12 muaj, kan\u00eb t\u00eb drejt\u00ebn e p\u00ebrpar\u00ebsis\u00eb n\u00eb pun\u00ebsimet me koh\u00eb t\u00eb pacaktuar t\u00eb b\u00ebra nga pun\u00ebdh\u00ebn\u00ebsi n\u00eb 12 muajt pas skadimit t\u00eb kontrat\u00ebs s\u00eb tij, p\u00ebr detyrat e kryera tashm\u00eb n\u00eb marr\u00ebdh\u00ebniet e m\u00ebparshme me afat t\u00eb caktuar. E drejta, p\u00ebrve\u00e7se p\u00ebrmendet n\u00eb kontrat\u00ebn e pun\u00ebsimit, mund t\u00eb ushtrohet me kusht q\u00eb punonj\u00ebsi t\u00eb b\u00ebj\u00eb k\u00ebrkes\u00eb me shkrim brenda 6 muajve nga skadimi i kontrat\u00ebs. P\u00ebr punonj\u00ebsit e pun\u00ebsuar me afat t\u00eb caktuar p\u00ebr t\u00eb kryer aktivitete sezonale, e drejta e p\u00ebrpar\u00ebsis\u00eb mund t\u00eb ushtrohet me kusht q\u00eb punonj\u00ebsi ta k\u00ebrkoj\u00eb me shkrim brenda 3 muajve nga skadimi i kontrat\u00ebs.<\/p>\n\n\n\n<p>Pal\u00ebt, n\u00eb p\u00ebrputhje me nenin 24, paragrafi 1, D.Lgjs. n. 81\/2015, vendosin se e drejta e p\u00ebrpar\u00ebsis\u00eb do t\u00eb aplikohet, aty ku \u00ebsht\u00eb e mundur, brenda kantierit ku ai ka ofruar sh\u00ebrbimin e tij.<\/p>\n\n\n\n<p>Pal\u00ebt synojn\u00eb t\u00eb disiplinojn\u00eb rastet e dh\u00ebna p\u00ebr t\u00eb cilat nuk gjenden aplikimet e intervaleve kohore n\u00eb rast t\u00eb rimarrjes n\u00eb pun\u00eb me kontrat\u00eb me afat t\u00eb caktuar t\u00eb t\u00eb nj\u00ebjtit punonj\u00ebs sipas nenit 21 D.Lgjs. n. 81\/2015. Kushtet e nd\u00ebrprerjes t\u00eb parashikuara sipas ligjit nuk gjejn\u00eb aplikim n\u00eb rastet e dh\u00ebna si m\u00eb posht\u00eb:<\/p>\n\n\n\n<p>a) n\u00eb pun\u00ebsimin e punonj\u00ebsve t\u00eb pun\u00ebsuar n\u00eb aktivitetet sezonale t\u00eb paraqitura n\u00eb paragraf\u00ebt e m\u00ebparsh\u00ebm;<\/p>\n\n\n\n<p>b) n\u00eb z\u00ebvend\u00ebsimin e punonj\u00ebsve q\u00eb mungojn\u00eb, kur pun\u00ebsimi i m\u00ebpassh\u00ebm b\u00ebhet p\u00ebr arsye t\u00eb z\u00ebvend\u00ebsimit t\u00eb punonj\u00ebsve t\u00eb tjer\u00eb;<\/p>\n\n\n\n<p>c) n\u00eb pun\u00ebsimin e punonj\u00ebsve t\u00eb vendosur me pages\u00eb p\u00ebr papun\u00ebsi, fitime n\u00eb nj\u00eb nd\u00ebrmarrje tjet\u00ebr;<\/p>\n\n\n\n<p>d) n\u00eb pun\u00ebsimin e p\u00ebrfituesve t\u00eb NaspI-t (kompensim mujor p\u00ebr ata q\u00eb kan\u00eb humbur pun\u00ebn);<\/p>\n\n\n\n<p>e) n\u00eb pun\u00ebsimin e punonj\u00ebsve t\u00eb papun\u00eb me mosh\u00eb mbi 50 vje\u00e7.<\/p>\n\n\n\n<p>Pun\u00ebsimi i punonj\u00ebsve me afat t\u00eb caktuar p\u00ebr t\u00eb z\u00ebvend\u00ebsuar punonj\u00ebsit me leje lindje, ose me leje p\u00ebr f\u00ebmij\u00ebt n\u00eb p\u00ebrputhje me Dekretin legjislativ t\u00eb dat\u00ebs 26 Mars 2001 n. 151, mund t\u00eb b\u00ebhet edhe para kohe deri n\u00eb 3 muaj n\u00eb krahasim me periudh\u00ebn e fillimit t\u00eb munges\u00ebs, si\u00e7 parashikohet n\u00eb nenin 4, paragrafi i dyt\u00eb, i Dekretit legjislativ t\u00eb lartp\u00ebrmendur n. 151\/2001.<\/p>\n\n\n\n<p>Pun\u00ebsimi me afat t\u00eb caktuar mund t\u00eb b\u00ebhet para kohe, gjithashtu, deri n\u00eb 3 muaj n\u00eb rastet e mungesave nga puna t\u00eb programuara me q\u00ebllim q\u00eb t\u00eb garantohet mbulimi i vendit t\u00eb punonj\u00ebsit q\u00eb do t\u00eb mungoj\u00eb.
