Ndryshimi i tenderit\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Duke pasur parasysh se sektori karakterizohet, n\u00eb shumic\u00ebn e rasteve, nga prodhimi i sh\u00ebrbimeve n\u00ebp\u00ebrmjet kontratave t\u00eb tenderave dhe se kjo gj\u00eb \u00e7on n\u00eb ndryshime t\u00eb shpeshta t\u00eb administrimit nd\u00ebrmjet nd\u00ebrmarrjeve me nd\u00ebrprerje t\u00eb marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs nga ana e nd\u00ebrmarrjes transferuese dhe p\u00ebrgatitjen e burimeve t\u00eb nevojshme t\u00eb pun\u00ebs, me pun\u00ebsime rishtazi, nga ana e nd\u00ebrmarrjes hyr\u00ebse apo z\u00ebvend\u00ebsuese, Pal\u00ebt synojn\u00eb t\u00eb marrin parasysh, nga nj\u00ebra an\u00eb, karakteristikat strukturore t\u00eb vet\u00eb sektorit dhe t\u00eb aktiviteteve t\u00eb nd\u00ebrmarrjeve dhe, nga ana tjet\u00ebr, t\u00eb objektivit p\u00ebr t\u00eb futur n\u00ebn tutel\u00eb n\u00eb m\u00ebnyr\u00ebn m\u00eb konkrete nivelet e p\u00ebrgjithshme t\u00eb pun\u00ebsimit.<\/p>\n\n\n\n<p>Prandaj, Pal\u00ebt bien dakord p\u00ebr disiplin\u00ebn e m\u00ebposhtme p\u00ebr rastet e ndryshimit t\u00eb kontrat\u00ebs s\u00eb tenderit, t\u00eb vlefshme p\u00ebr \u00e7do tipologji juridike t\u00eb nd\u00ebrmarrjes q\u00eb prodhon sh\u00ebrbime, qoft\u00eb transferuese ose z\u00ebvend\u00ebsuese apo hyr\u00ebse n\u00eb vend t\u00eb saj (shoq\u00ebri, kooperativ\u00eb, etj.), gjithashtu edhe n\u00eb p\u00ebrputhje me nenin 7, paragrafi 4 bis, t\u00eb Dekretit legjislativ 31.12.2007, n. 248, i konvertuar n\u00eb ligj me dat\u00ebn 28.2.2008 n. 31.<\/p>\n\n\n\n<p>N\u00eb \u00e7do rast ndryshimi t\u00eb kontrat\u00ebs s\u00eb tenderit, Nd\u00ebrmarrja q\u00eb mbyllet do t\u2019u jap\u00eb nj\u00eb komunikim paraprak, me p\u00ebrjashtim t\u00eb rasteve kur kjo nuk \u00ebsht\u00eb objektivisht e mundur, t\u00eb pakt\u00ebn 15 dit\u00eb p\u00ebrpara se t\u00eb hyj\u00eb n\u00eb fuqi kontrata e re, strukturave sindikale territoriale kompetente, duke dh\u00ebn\u00eb edhe informacion gjithashtu p\u00ebr:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>forcat numerike t\u00eb punonj\u00ebsve t\u00eb p\u00ebrfshir\u00eb, duke treguar ata q\u00eb jan\u00eb t\u00eb pun\u00ebsuar n\u00eb kontrat\u00ebn e tenderit n\u00eb fjal\u00eb, q\u00eb kan\u00eb hyr\u00eb n\u00eb forc\u00eb dhe t\u00eb pun\u00ebsuar n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrhershme p\u00ebr t\u00eb pakt\u00ebn 4 muaj;<\/li>\n\n\n\n<li>orarin p\u00ebrkat\u00ebs t\u00eb kontraktimit javor;<\/li>\n\n\n\n<li>nivelin e inkuadrimit dhe dat\u00ebn e caktimit;<\/li>\n\n\n\n<li>dat\u00ebn e pun\u00ebsimit n\u00eb sektor;<\/li>\n\n\n\n<li>dat\u00ebn e pun\u00ebsimit n\u00eb nd\u00ebrmarrjen q\u00eb po largohet;<\/li>\n\n\n\n<li>pun\u00ebsimin e mundsh\u00ebm t\u00eb rastit ose me kontrat\u00eb n\u00eb tendera t\u00eb tjer\u00eb;<\/li>\n\n\n\n<li>caktimin e mundsh\u00ebm t\u00eb funksioneve t\u00eb koordinimit dhe planifikimit, me p\u00ebrcaktimin e kryerjes eventuale t\u00eb k\u00ebtyre funksioneve n\u00eb kontrata tenderash t\u00eb tjer\u00eb.<\/li>\n<\/ul>\n\n\n\n<p>Ky komunikim i d\u00ebrgohet nj\u00ebkoh\u00ebsisht nd\u00ebrmarrjes z\u00ebvend\u00ebsuese hyr\u00ebse.<\/p>\n\n\n\n<p>Nd\u00ebrmarrja hyr\u00ebse, me shpejt\u00ebsi maksimale dhe t\u00eb pakt\u00ebn 15 dit\u00eb p\u00ebrpara se kontrata t\u00eb hyj\u00eb n\u00eb fuqi, dhe at\u00ebher\u00eb kur kjo gj\u00eb nuk \u00ebsht\u00eb objektivisht e mundur, n\u00eb koh\u00ebn e duhur, do t&#8217;ua komunikoj\u00eb hyrjen e saj n\u00eb marrjen e kontrat\u00ebs s\u00eb tenderit Organizatave sindikale territoriale t\u00eb n\u00ebnshkrueseve t\u00eb kontrat\u00ebs C.C.N.L. Me k\u00ebrkes\u00ebn e k\u00ebtyre t\u00eb fundit, Pal\u00ebt do t\u00eb takohen p\u00ebrpara marrjes n\u00eb dor\u00ebzim p\u00ebr t\u00eb siguruar aplikimin korrekt t\u00eb kushteve p\u00ebr transferimin e punonj\u00ebsve. Me skadimin e kontrat\u00ebs s\u00eb tenderit mund t\u00eb verifikohen 2 raste:<\/p>\n\n\n\n<p>a) n\u00eb rast t\u00eb zgjidhjes s\u00eb kontrat\u00ebs s\u00eb tenderit me t\u00eb nj\u00ebjtat kushte, modalitete dhe sh\u00ebrbime kontraktuese, shoq\u00ebria n\u00eb hyrje merr p\u00ebrsip\u00ebr t\u00eb garantoj\u00eb pun\u00ebsimin, pa periudh\u00eb prove, t\u00eb personelit ekzistues n\u00eb organik\u00eb p\u00ebr tenderin q\u00eb rezulton nga dokumentacioni provues q\u00eb e p\u00ebrcakton k\u00ebt\u00eb p\u00ebr t\u00eb pakt\u00ebn 4 muaj para vet\u00eb mbylljes, me p\u00ebrjashtim t\u00eb rasteve t\u00eb ve\u00e7anta si dor\u00ebheqjet, pensionet, vdekjet;<\/p>\n\n\n\n<p>b) n\u00eb rast t\u00eb zgjidhjes s\u00eb kontrat\u00ebs s\u00eb tenderit me modifikime t\u00eb afateve, modaliteteve dhe sh\u00ebrbimeve kontraktuese, nd\u00ebrmarrja q\u00eb futet n\u00eb vend t\u00eb saj &#8211; edhe n\u00ebse \u00ebsht\u00eb e nj\u00ebjta q\u00eb ka administruar sh\u00ebrbimin &#8211; do t\u00eb thirret pran\u00eb Shoqat\u00ebs territoriale t\u00eb cil\u00ebs i jep mandatin, ose n\u00eb munges\u00eb t\u00eb saj pran\u00eb Inspektoratit Territorial t\u00eb Pun\u00ebs ose ndonj\u00eb institucioni eventual analog territorial kompetent, ku \u00ebsht\u00eb e mundur n\u00eb 15 dit\u00ebt e m\u00ebparshme me p\u00ebrfaq\u00ebsin\u00eb sindikale t\u00eb nd\u00ebrmarrjes dhe Organizatat sindikaliste, q\u00eb kan\u00eb lidhur marr\u00ebveshjen, territoriale kompetente p\u00ebr shqyrtimin e situat\u00ebs, p\u00ebr t\u00eb harmonizuar k\u00ebrkesat e ndryshuara tekniko-organizative t\u00eb kontrat\u00ebs s\u00eb tenderit duke ruajtur nivelet e pun\u00ebsimit, duke pasur parasysh kushtet profesionale dhe p\u00ebrdorimin e personelit t\u00eb pun\u00ebsuar, gjithashtu duke iu drejtuar proceseve t\u00eb mobilitetit nga vendi i pun\u00ebs brenda fush\u00ebveprimit t\u00eb aktivitetit t\u00eb sip\u00ebrmarrjes ose t\u00eb instrumenteve si p.sh. part-time (orar t\u00eb reduktuar), zvog\u00eblimi i orarit t\u00eb pun\u00ebs, fleksibiliteti i dit\u00ebve t\u00eb pun\u00ebs, mobiliteti (l\u00ebvizshm\u00ebria).<\/p>\n\n\n\n<p>N\u00eb procedurat e ndryshimit t\u00eb tenderit nd\u00ebrmarrja z\u00ebvend\u00ebsuese, duke pasur parasysh p\u00ebrcaktimet n\u00eb shkronjat a) dhe b) si m\u00eb sip\u00ebr, do t\u00eb pun\u00ebsoj\u00eb si vart\u00ebs punonj\u00ebsit dhe punonj\u00ebsit ortak\u00eb me marr\u00ebdh\u00ebnie pune n\u00eb vart\u00ebsi sipas marr\u00ebdh\u00ebnieve q\u00eb jan\u00eb transferuar nga nd\u00ebrmarrja q\u00eb ka mbyllur.<\/p>\n\n\n\n<p>Kur nd\u00ebrmarrja z\u00ebvend\u00ebsuese \u00ebsht\u00eb e krijuar n\u00eb form\u00eb kooperative, mbetet e paprekur e drejta e m\u00ebvonshme e punonj\u00ebsit p\u00ebr t\u00eb paraqitur nj\u00eb k\u00ebrkes\u00eb formale p\u00ebr t&#8217;u bashkuar si ortak.<\/p>\n\n\n\n<p>Ortakut megjithat\u00eb do t&#8217;i garantohet nj\u00eb trajtim ekonomik i p\u00ebrgjithsh\u00ebm jo m\u00eb i vog\u00ebl se ai q\u00eb \u00ebsht\u00eb parashikuar n\u00eb k\u00ebt\u00eb kontrat\u00eb C.C.N.L.<\/p>\n\n\n\n<p>K\u00ebto pun\u00ebsime nuk p\u00ebrb\u00ebjn\u00eb pun\u00ebsim shtes\u00eb.<\/p>\n\n\n\n<p>N\u00eb rast se jan\u00eb marr\u00eb masa, n\u00eb momentin e nd\u00ebrprerjes s\u00eb marr\u00ebdh\u00ebnieve, p\u00ebr pezullime nga puna t\u00eb cilat n\u00eb \u00e7do rast \u00e7ojn\u00eb n\u00eb ruajtjen e vendit t\u00eb pun\u00ebs, marr\u00ebdh\u00ebnia do t\u00eb vazhdoj\u00eb n\u00ebn vart\u00ebsin\u00eb e nd\u00ebrmarrjes q\u00eb ka mbyllur dhe punonj\u00ebsi do t\u00eb pun\u00ebsohet nga nd\u00ebrmarrja z\u00ebvend\u00ebsuese n\u00eb momentin n\u00eb t\u00eb cilin pushon shkaku i pezullimit.<\/p>\n\n\n\n<p>Punonj\u00ebsit n\u00eb pritje t\u00eb pun\u00ebsimit sipas nenit 31 i ligjit n. 300\/1970 do t\u00eb pun\u00ebsohen nga nd\u00ebrmarrja z\u00ebvend\u00ebsuese me kalim direkt dhe t\u00eb menj\u00ebhersh\u00ebm.<\/p>\n\n\n\n<p>Punonj\u00ebsit e pun\u00ebsuar me kontrat\u00eb me afat t\u00eb caktuar do t\u00eb pun\u00ebsohen nga nd\u00ebrmarrja z\u00ebvend\u00ebsuese n\u00eb skadimin e kontrat\u00ebs s\u00eb marr\u00ebdh\u00ebnies s\u00eb pun\u00ebs s\u00eb p\u00ebrcaktuar fillimisht.<\/p>\n\n\n\n<p>N\u00eb \u00e7do rast t\u00eb transferimit t\u00eb punonj\u00ebsve nga nj\u00eb nd\u00ebrmarrje n\u00eb tjetr\u00ebn, sipas nenit 4 t\u00eb k\u00ebsaj kontrate C.C.N.L., periudha e praktik\u00ebs (stazhit) q\u00eb \u00ebsht\u00eb kryer, p\u00ebr t\u00eb cil\u00ebn nd\u00ebrmarrja e mbyllur ka p\u00ebr detyr\u00eb t\u2019i jap\u00eb dokumentacionin e duhur nd\u00ebrmarrjes z\u00ebvend\u00ebsuese, llogaritet e plot\u00eb dhe duhet p\u00ebr llogaritjen e vjet\u00ebrsis\u00eb n\u00eb pun\u00eb.<\/p>\n\n\n\n<p>Nd\u00ebrmarrja q\u00eb largohet, sapo t\u00eb ket\u00eb statusin zyrtar dhe, n\u00eb \u00e7do rast, brenda koh\u00ebs s\u00eb nevojshme p\u00ebr zbatimin e procedurave t\u00eb p\u00ebrcaktuara m\u00eb sip\u00ebr, i dor\u00ebzon shoq\u00ebris\u00eb pasardh\u00ebse dokumentacionin e m\u00ebposht\u00ebm, n\u00eb lidhje me \u00e7do punonj\u00ebs q\u00eb plot\u00ebson k\u00ebrkesat e parashikuara p\u00ebr pun\u00ebsim:<br><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>emrin, dat\u00ebn dhe vendin e lindjes, kodin fiskal dhe adres\u00ebn e rezidenc\u00ebs (ose vendbanimin, n\u00ebse \u00ebsht\u00eb i ndrysh\u00ebm nga rezidenca);<\/li>\n\n\n\n<li>lejeq\u00ebndrimin eventual dhe skadimin e tij;<\/li>\n\n\n\n<li>numrin e telefonit;<\/li>\n\n\n\n<li>ekstraktin e kat\u00ebr muajve t\u00eb fundit t\u00eb Librit Unik t\u00eb Pun\u00ebs;<\/li>\n\n\n\n<li>nivelin e inkuadrimit;<\/li>\n\n\n\n<li>tipologjin\u00eb e kontrat\u00ebs dhe, p\u00ebr koh\u00ebn e caktuar, dat\u00ebn e skadimit dhe shkakun;<\/li>\n\n\n\n<li>orarin javor;<\/li>\n\n\n\n<li>dat\u00ebn e pun\u00ebsimit n\u00eb sektor;<\/li>\n\n\n\n<li>dat\u00ebn e pun\u00ebsimit n\u00eb nd\u00ebrmarrjen q\u00eb po largohet;<\/li>\n\n\n\n<li>situat\u00ebn individuale n\u00eb lidhje me s\u00ebmundjen dhe aksidentet n\u00eb pun\u00eb, n\u00eb p\u00ebrputhje dhe brenda kufijve t\u00eb p\u00ebrcaktuar n\u00eb nenin 51, paragraf\u00ebt 4 e 5, t\u00eb kontrat\u00ebs C.C.N.L. n\u00eb fuqi;<\/li>\n<\/ul>\n\n\n\n<p>p\u00ebrve\u00e7 k\u00ebsaj<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>list\u00ebn e personelit t\u00eb pun\u00ebsuar detyrimisht n\u00eb p\u00ebrputhje me ligjin n. 68\/1999;<\/li>\n\n\n\n<li>masat e adoptuara sipas Dekretit legjislativ nr. 81\/2008 n\u00eb kuadrin e sh\u00ebndetit dhe siguris\u00eb n\u00eb pun\u00eb, n\u00eb lidhje me mbik\u00ebqyrjen sanitare dhe me mjekun kompetent, si dhe p\u00ebr iniciativat e formimit dhe informacionit, duke p\u00ebrfshir\u00eb gjendjen e zbatimit t\u00eb detyrimeve sipas Marr\u00ebveshjes s\u00eb dat\u00ebs 21.12.2011 nd\u00ebrmjet Ministris\u00eb s\u00eb Pun\u00ebs dhe Konferenc\u00ebs Shtet\/Rajone;<\/li>\n\n\n\n<li>iniciativat e formimit dhe\/ose ushtrimit, duke p\u00ebrfshir\u00eb ato q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me kontratat eventuale t\u00eb praktik\u00ebs profesionalizuese t\u00eb n\u00ebnshkruara, si dhe ato eventualet q\u00eb lidhen me Librez\u00ebn e formimit t\u00eb qytetarit &#8211; sipas nenit 2, germa i) e Dekretit legjislativ 10.9.2003, n. 276, dhe t\u00eb Dekretit t\u00eb Ministris\u00eb s\u00eb Pun\u00ebs 10.10.2005;<\/li>\n\n\n\n<li>regjistrimin e punonj\u00ebsve n\u00eb fondet e pensioneve suplementare dhe n\u00eb fondin e asistenc\u00ebs sanitare integruese sipas neveve 54 dhe 69 t\u00eb kontrat\u00ebs C.C.N.L. n\u00eb fuqi.<\/li>\n<\/ul>\n\n\n\n<p>P\u00ebr personelin e p\u00ebrfshir\u00eb n\u00eb transferimin e tenderit sipas k\u00ebtij neni nd\u00ebrmarrja e mbyllur \u00ebsht\u00eb e p\u00ebrjashtuar nga detyrimi p\u00ebr t\u00eb paguar shp\u00ebrblimin z\u00ebvend\u00ebsues t\u00eb paralajm\u00ebrimit t\u00eb p\u00ebrmendur n\u00eb nenin 57.<\/p>\n\n\n\n<p><strong>DEKLARAT\u00cb ME PROCESVERBAL<\/strong><\/p>\n\n\n\n<p>Pal\u00ebt pranojn\u00eb se normativa e p\u00ebrmendur n\u00eb k\u00ebt\u00eb nen, n\u00eb rastin e pun\u00ebsimit me transferim t\u00eb drejtp\u00ebrdrejt\u00eb dhe t\u00eb menj\u00ebhersh\u00ebm, nuk synon
