Drepturile sindicale\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p><strong>A) AUTORIZA\u021aII PENTRU BIROURILE SINDICALE \u0218I A\u0218TEPT\u0102RI<\/strong><\/p>\n\n\n\n<p>Lucr\u0103torilor care sunt membri ai comitetelor de conducere ale Confedera\u021biilor sindicale, ai comitetelor de conducere ale Federa\u021biilor sindicale na\u021bionale care prev\u0103d prezenta C.C.N.L. \u0219i ai Sindicatelor provinciale apar\u021bin\u0103toare, li se pot acorda zile libere pl\u0103tite de scurt\u0103 durat\u0103 compatibil cu cerin\u021bele de serviciu pentru exercitarea func\u021biilor lor atunci c\u00e2nd absen\u021ba de la locul de munc\u0103 este solicitat\u0103 \u00een mod expres \u00een scris de c\u0103tre organiza\u021biile men\u021bionate mai sus.<\/p>\n\n\n\n<p>Aceste zile libere vor fi acordate pentru o perioad\u0103 maxim\u0103 de 25 de zile pe an pentru fiecare organiza\u021bie sindical\u0103.<\/p>\n\n\n\n<p>\u00cen cazul \u00een care exist\u0103 mai mul\u021bi angaja\u021bii de la acelea\u0219i companie care pot beneficia de aceasta, zilele libere care vor fi acordate persoanelor vor fi \u00eensumate \u0219i, \u00een general, nu pot dep\u0103\u0219i un maxim de 60 de zile pe an.<\/p>\n\n\n\n<p>Liberele pentru membrii organelor de conducere ale sindicatelor vor fi acordate la prezentarea scrisorii de convocare c\u0103tre societate cu cel pu\u021bin 24 de ore \u00eenainte.<\/p>\n\n\n\n<p>Calific\u0103rile men\u021bionate mai sus \u0219i modific\u0103rile aferente trebuie comunicate \u00een scris de c\u0103tre organiza\u021biile men\u021bionate mai sus asocia\u021biilor patronale teritoriale care le vor comunica societ\u0103\u021bii din care face parte lucr\u0103torul.<\/p>\n\n\n\n<p>Pentru \u00eendeplinirea func\u021biilor sindicale men\u021bionate mai sus, precum \u0219i pentru cele inerente func\u021biilor publice elective, se poate acorda o perioad\u0103 de concediu f\u0103r\u0103 plat\u0103 pe \u00eentreaga durat\u0103 a mandatului acestora, timp \u00een care raportul de munc\u0103 r\u0103m\u00e2ne suspendat cu toate efectele.<\/p>\n\n\n\n<p>Directorii reprezentan\u021belor sindicale ale societ\u0103\u021bii au dreptul la zile libere pl\u0103tite pentru \u00eendeplinirea mandatului lor.<\/p>\n\n\n\n<p>Au dreptul la aceste zile libere cel pu\u021bin:<\/p>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-container-core-group-is-layout-990f8f10 wp-block-group-is-layout-constrained\">\n<p>a) 1 director pentru fiecare reprezentan\u021b\u0103 sindical\u0103 a societ\u0103\u021bii in unit\u0103\u021bile de produc\u021bie care de\u021bin un num\u0103r de p\u00e2n\u0103 la 200 de salaria\u021bi din categoria pentru care este organizata;<\/p>\n\n\n\n<p>b) 1 director pentru fiecare 300 sau frac\u021biune din 300 de angaja\u021bi pentru fiecare reprezentan\u021b\u0103 sindical\u0103 a societ\u0103\u021bii \u00een unit\u0103\u021bile de produc\u021bie care de\u021bin un num\u0103r de p\u00e2n\u0103 la 3.000 de angaja\u021bi din categoria pentru care este organizat\u0103;<\/p>\n\n\n\n<p>c) 1 director pentru fiecare 500 sau frac\u021biuni de 500 de angaja\u021bi din categoria pentru care este organizat\u0103 reprezentarea sindical\u0103 a societ\u0103\u021bii \u00een cele mai mari unit\u0103\u021bi de produc\u021bie, \u00een plus fa\u021b\u0103 de num\u0103rul minim men\u021bionat la litera b) de mai sus.<\/p>\n<\/div>\n\n\n\n<p>Num\u0103rul de zile pl\u0103tite pentru directorii sindicali ai societ\u0103\u021bii nu poate fi mai mic de 10 ore pe lun\u0103 \u00een societ\u0103\u021bile prev\u0103zute la lit. b) \u0219i c) din alineatul precedent; \u00een societ\u0103\u021bile prev\u0103zute la lit. a) num\u0103rul de zile pl\u0103tite nu poate fi mai mic de 2 ore \u0219i jum\u0103tate pe an pentru fiecare salariat.<\/p>\n\n\n\n<p>Lucr\u0103torul care inten\u021bioneaz\u0103 s\u0103 \u00ee\u0219i exercite dreptul men\u021bionat la alineatul (7) trebuie s\u0103 notifice societatea \u00een scris, de regul\u0103 cu 24 de ore \u00eenainte, prin reprezentan\u021bii sindicali ai societ\u0103\u021bii. Directorii sindicali ai societ\u0103\u021bii au dreptul la zile libere f\u0103r\u0103 plat\u0103 pentru participarea la negocieri sindicale \u0219i congrese \u0219i conven\u021bii sindicale, \u00een m\u0103sur\u0103 de cel pu\u021bin 8 zile pe an.<\/p>\n\n\n\n<p>Lucr\u0103torii care inten\u021bioneaz\u0103 s\u0103 \u00ee\u0219i exercite dreptul men\u021bionat la alineatul precedent trebuie s\u0103 notifice \u00een scris societatea, de regul\u0103 cu 3 zile \u00eenainte, prin reprezentan\u021bii sindicali ai societ\u0103\u021bii.<\/p>\n\n\n\n<p><strong>B) ADUNAREA ANGAJA\u021aILOR<\/strong><\/p>\n\n\n\n<p>\u00cen conformitate cu art. 20 din Legea nr. 300\/1970, societ\u0103\u021bile garanteaz\u0103 exercitarea dreptului de \u00eentrunire la locul de munc\u0103.<\/p>\n\n\n\n<p>\u00cen cazul unui deficit dovedit de spa\u021bii la locul de munc\u0103, societatea va pune la dispozi\u021bie un alt spa\u021biu sau o alt\u0103 zon\u0103 adecvat\u0103 care urmeaz\u0103 s\u0103 fie convenit\u0103 cu structurile sindicale ale societ\u0103\u021bii.<\/p>\n\n\n\n<p>Adunarea poate fi convocat\u0103 \u0219i de organiza\u021biile sindicale teritoriale ale Federa\u021biilor lucr\u0103torilor care stipuleaz\u0103 C.C.N.L.<br><\/p>\n\n\n\n<p><strong>C) PLATA CONTRIBU\u021aIILOR SINDICALE<\/strong><\/p>\n\n\n\n<p>Societatea va re\u021bine din salariul lunar al lucr\u0103torului, care face o \u00eemputernicire scris\u0103, cuantumul contribu\u021biilor asociative care urmeaz\u0103 s\u0103 fie pl\u0103tite organiza\u021biei sindicale, semnatar\u0103 a prezentului contract \u0219i indicat\u0103 de c\u0103tre lucr\u0103tor, \u00een valoare de 1% din cuantumul salariului din tabel \u0219i indemniza\u021bia privind costul vie\u021bii pentru o perioad\u0103 de 14 luni.<\/p>\n\n\n\n<p>Societatea nu va proceda cu acele \u00eemputerniciri care nu con\u021bin elementele prezentate \u00een schema standard la care se face referire \u00een scrisoarea anexat\u0103 la prezentul contract.<\/p>\n\n\n\n<p>\u00cemputernicirea, datat\u0103 \u0219i semnat\u0103 de lucr\u0103tor, trebuie s\u0103 includ\u0103 luna de \u00eencepere.<\/p>\n\n\n\n<p>\u00cen cazul \u00een care salariul lunar nu este pl\u0103tit, nu poate avea loc nicio re\u021binere sau recuperare ulterioar\u0103.<\/p>\n\n\n\n<p>\u00cen cazul \u00een care \u00eemputernicirea ajunge la companie dup\u0103 a 5-a zi a lunii de \u00eencepere indicat\u0103 de lucr\u0103tor, deducerea se va face numai din luna urm\u0103toare lunii de primire, f\u0103r\u0103 a pune \u00een aplicare nicio recuperare pentru perioada anterioar\u0103.<\/p>\n\n\n\n<p>Orice revocare a \u00eemputernicirii \u00een cursul anului calendaristic trebuie, de asemenea, s\u0103 fie \u00eentocmit\u0103 \u00een scris \u0219i s\u0103 indice luna din care nu se mai poate face re\u021binerea.<\/p>\n\n\n\n<p>\u00cen cazul \u00een care revocarea este primit\u0103 dup\u0103 data de 5 a lunii indicate de lucr\u0103tor, \u00eencetarea re\u021binerii va intra \u00een vigoare din luna urm\u0103toare f\u0103r\u0103 nicio ajustare.<\/p>\n\n\n\n<p>At\u00e2t \u00eemputernicirea, c\u00e2t \u0219i revocarea sunt acte de liber\u0103 exprimare a voin\u021bei \u0219i, prin urmare, strict personale, prin urmare, acestea trebuie s\u0103 fie individuale \u0219i nu cumulative.<\/p>\n\n\n\n<p>\u00cen cazul \u00een care revocarea este \u00eenso\u021bit\u0103 de o nou\u0103 \u00eemputernicire semnat\u0103 \u00een favoarea unei alte organiza\u021bii sindicale, data primeia trebuie s\u0103 fie anterioar\u0103 sau \u00een acela\u0219i timp cu cea a celei de-a doua.<\/p>\n\n\n\n<p>\u00eemputernicirea \u0219i revocarea vor fi transmise sau trimise \u00eentreprinderii de c\u0103tre partea interesat\u0103.<\/p>\n\n\n\n<p>Contribu\u021biile re\u021binute vor fi pl\u0103tite lunar de c\u0103tre societate organiza\u021biei sindicale \u00een cauz\u0103.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRevino sus\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Articolul 61 &#8211;
