Preaviz\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Raportul de munc\u0103 permanent nu poate fi reziliat de niciuna dintre p\u0103r\u021bi f\u0103r\u0103 un preaviz prealabil\u0103, ale c\u0103rei condi\u021bii sunt stabilite dup\u0103 cum urmeaz\u0103:<\/p>\n\n\n\n<p><strong>FUNC\u021aIONARI<\/strong><\/p>\n\n\n\n<p>a) pentru func\u021bionarii care, dup\u0103 trecerea perioadei de prob\u0103, nu au dep\u0103\u0219it 5 ani de serviciu:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>2 luni \u0219i 15 zile pentru func\u021bion\u0103rii de nivel 7 \u0219i manageri;<\/li>\n\n\n\n<li>1 lun\u0103 \u0219i 15 zile pentru func\u021bionarii de nivel 6;<\/li>\n\n\n\n<li>1 lun\u0103 pentru func\u021bionarii de la nivelul 5 la nivelul 2;<\/li>\n<\/ol>\n\n\n\n<p>b) pentru func\u021bionarii care au dep\u0103\u0219it 5 ani de serviciu \u0219i nu 10:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>3 luni \u0219i 15 zile pentru func\u021bionarii de nivel 7 \u0219i manageri;<\/li>\n\n\n\n<li>2 luni pentru func\u021bionarii de nivelul 6;<\/li>\n\n\n\n<li>1 lun\u0103 \u0219i 15 zile pentru func\u021bionarii de la nivelul 5 la nivelul 2;<\/li>\n<\/ol>\n\n\n\n<p>c) pentru func\u021bionarii care au dep\u0103\u0219it 10 ani de serviciu:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>4 luni \u0219i 15 zile pentru func\u021bionarii de nivel 7 \u0219i manageri;<\/li>\n\n\n\n<li>2 luni \u0219i 15 zile pentru func\u021bionarii de nivel 6;<\/li>\n\n\n\n<li>2 luni pentru angaja\u021bii de la nivelul 5 la nivelul 2.\u00a0<\/li>\n<\/ol>\n\n\n\n<p><strong>MUNCITORI<\/strong><\/p>\n\n\n\n<p>15 zile calendaristice pentru muncitorii de orice nivel, indiferent de vechimea \u00een munc\u0103.<\/p>\n\n\n\n<p>Perioadele de preaviz la care se face referire \u00een prezentul articol se reduc la 50% pentru func\u021bionari \u0219i, respectiv, la 7 zile calendaristice pentru muncitori dac\u0103 este lucr\u0103torul cel care d\u0103 preaviz.<\/p>\n\n\n\n<p>Termenele de reziliere \u00eencep de la mijlocul \u0219i sf\u00e2r\u0219itul fiec\u0103rei luni.<\/p>\n\n\n\n<p>Partea care reziliaz\u0103 rela\u021bia f\u0103r\u0103 a respecta termenii de preaviz men\u021biona\u021bi mai sus trebuie s\u0103 pl\u0103teasc\u0103 celuilalt o indemniza\u021bie egal\u0103 cu valoarea remunera\u021biei forfetare pentru perioada de preaviz care lipse\u0219te.<\/p>\n\n\n\n<p>Angajatorul are dreptul s\u0103 re\u021bin\u0103, din suma care i se datoreaz\u0103 lucr\u0103torului, o sum\u0103 corespunz\u0103toare salariului pentru perioada de preaviz care nu este acordat\u0103 de acesta din urm\u0103.<\/p>\n\n\n\n<p>Perioada de preaviz, chiar dac\u0103 este \u00eenlocuit\u0103 cu indemniza\u021bia corespunz\u0103toare, va fi prelungit\u0103 ca vechime pentru indemniza\u021bia de concediere.<\/p>\n\n\n\n<p>Partea care prime\u0219te rezilierea \u00een conformitate cu alineatul (1) are dreptul de a \u00eentrerupe raportul, at\u00e2t la \u00eenceputul, c\u00e2t \u0219i \u00een timpul perioadei de preaviz, f\u0103r\u0103 nicio obliga\u021bie de compensare pentru perioada de preaviz nefinalizat\u0103.<\/p>\n\n\n\n<p>Pe parcursul perioadei de preaviz, angajatorul va acorda lucr\u0103torului zile libere pentru c\u0103utarea unui nou loc de munc\u0103;
