Pensie suplimentar\u0103\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>P\u0103r\u021bile contractante convin asupra oportunit\u0103\u021bii de a favoriza pensiile suplimentare pentru lucr\u0103torii din sector \u0219i, \u00een acest scop, convin s\u0103 caute cele mai potrivite solu\u021bii de implementare \u00een acest scop prin implementarea unei discipline definite de contribu\u021bie \u0219i capitalizare individual\u0103, f\u0103r\u0103 profit \u0219i cu scopul exclusiv de a oferi beneficii suplimentare de pensie, \u00een conformitate cu Decretul legislativ 252\/2005 \u0219i modific\u0103rile \u0219i complet\u0103rile ulterioare.<\/p>\n\n\n\n<p>Lucr\u0103torii care nu sunt \u00een perioada de prob\u0103, cei angaja\u021bi pe termen nelimitat sau cu contracte mixte \u0219i al c\u0103ror raport de munc\u0103 este reglementat de prezenta C.C.N.L. se pot al\u0103tura.<\/p>\n\n\n\n<p>Lucr\u0103torii angaja\u021bi cu contract pe durat\u0103 determinat\u0103, care acumuleaz\u0103 \u00een cursul anului solar (1ianuarie-31 decembrie) perioade de munc\u0103 de cel pu\u021bin \u0219ase luni, pot s\u0103 adere la finalizarea acestei perioade. P\u0103r\u021bile \u00ee\u0219i rezerv\u0103 dreptul de a stabili, \u00een cadrul dispozi\u021biilor legale\/de reglementare respective, condi\u021biile \u0219i metodele privind men\u021binerea pozi\u021biilor acestor lucr\u0103tori.<\/p>\n\n\n\n<p>Adeziunea lucr\u0103torului va avea loc voluntar, sau prin mecanismul consim\u021birii prin t\u0103cere, \u00een conformitate cu prevederile articolului 8, al \u0219aptelea paragraf, din Decretul legislativ nr. 252\/2005.<\/p>\n\n\n\n<p>Contribu\u021biile, \u00een limitele deductibilit\u0103\u021bii fiscale prev\u0103zute de legisla\u021bia relevant\u0103, vor consta \u00een:<\/p>\n\n\n\n<p>a) 1%, suportat\u0103 de societate, calculat\u0103 pe o scar\u0103 minim\u0103 \u0219i o indemniza\u021bie privind costul vie\u021bii \u00eencep\u00e2nd cu 1\/1\/2001; (conform tabelului ata\u0219at);<\/p>\n\n\n\n<p>b) 1%, suportat\u0103 de lucr\u0103tor, calculat\u0103 pe o scar\u0103 minim\u0103 \u0219i indemniza\u021bie privind costul vie\u021bii \u00eencep\u00e2nd cu 01.01.2001;<\/p>\n\n\n\n<p>c) lichidarea pentru \u00eencheierea raportului de munc\u0103 acumulat\u0103 \u00een cursul anului de c\u0103tre lucr\u0103torii \u00een cauz\u0103 \u00een conformitate cu reglement\u0103rile legale \u00een vigoare.<\/p>\n\n\n\n<p>Lucr\u0103torul poate opta pentru plata unei contribu\u021bii suplimentare, pe cheltuiala sa, \u00een cuantumul \u0219i cu criteriile stabilite prin Statutul \u0219i Regulamentul fondurilor respective men\u021bionate la alineatul (9) din prezentul articol.<\/p>\n\n\n\n<p>Contribu\u021biile men\u021bionate mai sus, inclusiv sumele retrase din lichidarea pentru \u00eencetarea raportului, vor fi re\u021binute cu ocazia pl\u0103\u021bii taxelor \u00een fiecare lun\u0103 timp de dou\u0103sprezece luni \u0219i vor fi pl\u0103tite \u00een conformitate cu termenii \u0219i condi\u021biile care vor fi stabilite \u00een acordul men\u021bionat mai sus.<\/p>\n\n\n\n<p>Contribu\u021biile care trebuie pl\u0103tite de companii vor fi datorate numai pentru lucr\u0103torii care ader\u0103, f\u0103r\u0103 a da na\u0219tere la tratamente de substitu\u021bie sau alternative \u00een cazul ne\u00eenregistr\u0103rii lucr\u0103torului.<\/p>\n\n\n\n<p>Pentru a evita dispersarea lucr\u0103torilor \u00een diferitele fonduri existente \u0219i pentru a ob\u021bine diseminarea maxim\u0103 a pensiei suplimentare \u00een sector, asigur\u00e2nd \u00een acela\u0219i timp omogenitatea tratamentului \u00een r\u00e2ndul tuturor poten\u021bialilor lucr\u0103tori, p\u0103r\u021bile contractante convin c\u0103 fondurile de pensii la care societ\u0103\u021bile vor fi obligate s\u0103 pl\u0103teasc\u0103 contribu\u021bii, pe baza sumelor men\u021bionate \u00een prezentul articol, vor fi, \u0219i \u00een sensul dispozi\u021biilor articolului 8 alineatul (7) litera b) din Decretul legislativ 252\/2005, numai urm\u0103toarele:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>PREVIAMBIENTE, pentru lucr\u0103torii companiilor care ader\u0103 la ANIP, conform prevederilor acordului din 8 iunie 2007 (<strong>Anexa nr. 18<\/strong> la prezentul C.C.N.L.);<\/li>\n\n\n\n<li>FONDAPI, pentru lucr\u0103torii companiilor participante la CONFAPI, conform prevederilor acordului din 23 februarie 2005 (<strong>Anexa nr. 19 <\/strong>la prezentul C.C.N.L.);<\/li>\n\n\n\n<li>PREVIDENZA COOPERATIVA pentru lucr\u0103torii \u00eentreprinderilor cooperatiste din sector prev\u0103zute de protocolul adi\u021bional din 16 februarie 2007 (<strong>Anexa nr. 17<\/strong> la prezentul C.C.N.L.).<\/li>\n<\/ul>\n\n\n\n<p>\u00cen cazul \u00een care o companie sau o cooperativ\u0103 nu se al\u0103tur\u0103 niciuneia dintre asocia\u021biile de afaceri care semneaz\u0103 prezentul C.C.N.L., lucr\u0103torii au dreptul s\u0103 se al\u0103ture unuia dintre fondurile men\u021bionate mai sus.<\/p>\n\n\n\n<p>\u00cen ceea ce prive\u0219te cota de pensie suplimentar\u0103 suportat\u0103 de angajator, aceasta va fi \u00een orice caz recunoscut\u0103 \u00een cazul angaj\u0103rii lucr\u0103torilor deja \u00eenscri\u0219i \u00eentr-unul din fondurile enumerate mai sus \u00een urma unui transfer de contract de achizi\u021bii.<\/p>\n\n\n\n<p>Cota va fi recunoscut\u0103 \u0219i \u00een cazul angaj\u0103rii unui lucr\u0103tor \u00eenscris \u00eentr-un alt fond \u00eenchis din sector, cu condi\u021bia ca acordurile referitoare la acest alt fond s\u0103 prevad\u0103 condi\u021bia reciprocit\u0103\u021bii \u00een ceea ce prive\u0219te lucr\u0103torii \u00eenscri\u0219i \u00eentr-unul dintre fondurile enumerate mai sus.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRevino sus\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Articolul 54 &#8211;
