M\u0103suri disciplinare\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Nerespectarea de c\u0103tre lucr\u0103tor a prevederilor cuprinse \u00een prezentul contract poate da na\u0219tere, \u00een func\u021bie de gravitatea \u00eenc\u0103lc\u0103rii, la aplicarea urm\u0103toarelor m\u0103suri:<\/p>\n\n\n\n<p>a) avertisment verbal;<\/p>\n\n\n\n<p>b) avertisment scris;<\/p>\n\n\n\n<p>c) amend\u0103 care nu dep\u0103\u0219e\u0219te trei ore de plat\u0103 orar\u0103 calculat\u0103 pe baza cuantumului minim tabelar;<\/p>\n\n\n\n<p>d) suspendare din munc\u0103 \u0219i de la plat\u0103 de p\u00e2n\u0103 la maxim trei zile;<\/p>\n\n\n\n<p>e) concedierea pentru deficien\u021be \u00een temeiul art. 48.<\/p>\n\n\n\n<p>Angajatorul nu poate adopta nicio m\u0103sur\u0103 disciplinar\u0103 \u00eempotriva lucr\u0103torului f\u0103r\u0103 a-i fi contestat \u00een prealabil suma \u0219i f\u0103r\u0103 a-l fi ascultat \u00een ap\u0103rarea sa.<\/p>\n\n\n\n<p>Cu excep\u021bia rechem\u0103rii verbale, contestarea trebuie f\u0103cut\u0103 \u00een scris, iar m\u0103surile disciplinare nu pot fi adoptate \u00eenainte de trecerea a 5 zile, timp \u00een care lucr\u0103torul \u00ee\u0219i poate prezenta justific\u0103rile.<\/p>\n\n\n\n<p>Dac\u0103 m\u0103sura nu este adoptat\u0103 \u00een termen de 15 zile lucr\u0103toare, aceste justific\u0103ri vor fi considerate acceptate.<\/p>\n\n\n\n<p>De asemenea, lucr\u0103torul \u00ee\u0219i poate prezenta justific\u0103rile verbal, cu eventuala asisten\u021b\u0103 a unui reprezentant al Asocia\u021biei Sindicale la care ader\u0103, sau a unui membru al Reprezentan\u021bei Unitare a Sindicatelor.<\/p>\n\n\n\n<p>\u00cen cazul \u00een care lucr\u0103torul, \u00een termen de 5 zile de la disput\u0103, \u00ee\u0219i declar\u0103 \u00een mod oficial inten\u021bia de a se prevala de asisten\u021ba unui reprezentant sindical, orice \u00eent\u00e2lnire \u00eentre lucr\u0103tor \u0219i reprezentantul sindical cu societatea trebuie s\u0103 aib\u0103 loc \u00een perioada obligatorie de 30 de zile de la disput\u0103, \u00een provincia sau municipiul unde exist\u0103 contractul de achizi\u021bie relativ (la care este repartizat lucr\u0103torul), dup\u0103 care justific\u0103rile pot fi prezentate numai \u00een scris, \u00een urm\u0103toarele 3 zile.<\/p>\n\n\n\n<p>Aceast\u0103 perioad\u0103 expir\u0103 dac\u0103 \u0219edin\u021ba nu poate avea loc din motive imputabile angajatorului. Adoptarea m\u0103surii trebuie justificat\u0103 \u0219i comunicat\u0103 \u00een scris.<\/p>\n\n\n\n<p>M\u0103surile disciplinare men\u021bionate mai sus la literele b), c) \u0219i d) pot fi aplicate de c\u0103tre lucr\u0103torul din sindicat, potrivit normelor contractuale referitoare la litigii. Concedierea pentru deficien\u021bele men\u021bionate la punctele A) \u0219i B) ale art. 48 poate fi contestat\u0103 conform procedurilor prev\u0103zute de art. 7 din Legea nr. 604\/1966 confirmat\u0103 de art. 18 din Legea nr. 300\/1970.<\/p>\n\n\n\n<p>M\u0103surile disciplinare la doi ani de la adoptarea lor nu vor fi luate \u00een considerare \u00een niciun scop.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRevino sus\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Articolul 46 &#8211;
