Zile de s\u0103rb\u0103toare\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Sunt considerate s\u0103rb\u0103tori legale urm\u0103toarele:<\/p>\n\n\n\n<p>a) toate duminicile sau zilele de repaus compensatoriu prev\u0103zute la art. 40 (repaus s\u0103pt\u0103m\u00e2nal); \u00een cazul unei s\u0103pt\u0103m\u00e2ni scurte, a doua zi de repaus este considerat\u0103 zi de s\u0103rb\u0103toare;<\/p>\n\n\n\n<p>b) s\u0103rb\u0103torile din 25 aprilie, 1 mai \u0219i 2 iunie, stabilite prin dispozi\u021biile legale \u00een vigoare, cu excep\u021bia eventualelor \u00eenlocuiri sau complet\u0103ri care pot interveni datorit\u0103 dispozi\u021biilor generale;<\/p>\n\n\n\n<p>c) urm\u0103toarele s\u0103rb\u0103tori:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Ziua Anului Nou (1 ianuarie);<\/li>\n\n\n\n<li>Boboteaza (6 ianuarie);<\/li>\n\n\n\n<li>Pa\u0219te (mobil);<\/li>\n\n\n\n<li>Luni dup\u0103 Pa\u0219ti (mobil);<\/li>\n\n\n\n<li>\u00cen\u0103l\u021barea (15 august);<\/li>\n\n\n\n<li>Ziua Tuturor Sfin\u021bilor (1 noiembrie);<\/li>\n\n\n\n<li>Imaculata Concep\u021bie (8 decembrie);<\/li>\n\n\n\n<li>Cr\u0103ciun (25 decembrie);<\/li>\n\n\n\n<li>S. \u0218tefan (26 decembrie);<\/li>\n\n\n\n<li>S\u0103rb\u0103toarea Protectorului locului \u00een care lucreaz\u0103 lucr\u0103torul (pentru municipalitatea Roma, SS. Pietro \u0219i Paolo 29 iunie).<\/li>\n<\/ol>\n\n\n\n<p>\u00cen acele loca\u021bii \u00een care s\u0103rb\u0103toarea Protectorului coincide cu alte s\u0103rb\u0103tori men\u021bionate la literele b) \u0219i c), Asocia\u021biile Teritoriale vor stabili o zi de s\u0103rb\u0103toare care s\u0103 o \u00eenlocuiasc\u0103 pe cea a Protectorului, pentru a p\u0103stra neschimbat num\u0103rul de s\u0103rb\u0103tori al literelor men\u021bionate mai sus b) \u0219i c).<\/p>\n\n\n\n<p>Numai \u00een cazul \u00een care evenimentele festive men\u021bionate la literele b) \u0219i c) cad \u00eentr-o zi de repaus s\u0103pt\u0103m\u00e2nal (art. 40) se pl\u0103te\u0219te o sum\u0103 egal\u0103 cu cotele zilnice ale elementelor din salariul lunar total datorat, \u00een plus fa\u021b\u0103 de tratamentul economic normal.<\/p>\n\n\n\n<p><strong><strong>S\u0102RB\u0102TORI ABROGATE PRIN LEGEA CONCEDIILOR, NR. 54 DIN 5 MARTIE 1977<\/strong><\/strong><\/p>\n\n\n\n<p>\u00cen ceea ce prive\u0219te s\u0103rb\u0103toarea civil\u0103 (4 noiembrie) a c\u0103rei celebrare are loc \u00een prima duminic\u0103 a lunii noiembrie, lucr\u0103torul va beneficia de tratamentul economic prev\u0103zut pentru s\u0103rb\u0103torile care coincid cu duminica, \u00een\u021beleg\u00e2ndu-se c\u0103 nu se pl\u0103te\u0219te nicio compensa\u021bie suplimentar\u0103 \u00een cazul serviciilor prestate \u00een ziua calendaristic\u0103 4 noiembrie.<\/p>\n\n\n\n<p>\u00cen cazul \u00een care societatea presteaz\u0103 serviciul de munc\u0103 pentru cele 4 s\u0103rb\u0103tori religioase suprimate, lucr\u0103torul care \u00een zilele men\u021bionate \u00ee\u0219i presteaz\u0103 munca nu are nicio remunera\u021bie suplimentar\u0103 fa\u021b\u0103 de remunera\u021bia lunar\u0103 normal\u0103 \u0219i va primi \u00een schimb indemniza\u021bii compensatorii pl\u0103tite pentru num\u0103rul de zile lucrate, \u00een coresponden\u021b\u0103 cu s\u0103rb\u0103torile men\u021bionate mai sus.<\/p>\n\n\n\n<p>Zilele libere de mai sus nu vor fi cumulate zilele de concediu \u0219i vor fi atribuite \u00een mod compatibil cu nevoile de servicii, \u021bin\u00e2nd cont de a\u0219tept\u0103rile lucr\u0103torului \u0219i trebuie luate \u00een anul \u00een care se refer\u0103; \u00een cazul \u00een care lucr\u0103torul nu profit\u0103 de zilele libere men\u021bionate mai sus, acesta va avea dreptul la tot at\u00e2tea por\u021bii zilnice din salariul lunar total pentru c\u00e2te s\u0103rb\u0103tori religioase anterioare au fost lucrate.<\/p>\n\n\n\n<p>\u00cen cazul \u00een care cele 4 s\u0103rb\u0103tori religioase se \u00eencadreaz\u0103 \u00een perioada de concediu, va avea loc o prelungire corespunz\u0103toare a perioadei de concediu.<\/p>\n\n\n\n<p>\u00cen cazul coinciden\u021bei celor 4 s\u0103rb\u0103tori religioase cu repausul s\u0103pt\u0103m\u00e2nal prev\u0103zut la art. 40, lucr\u0103torul nu va avea dreptul la niciun liber compensatoriu, ci va beneficia de tratamentul prev\u0103zut la alin. 3 din prezentul articol.<\/p>\n\n\n\n<p>Remunerarea tuturor s\u0103rb\u0103torilor nelucrate men\u021bionate \u00een acest articol este inclus\u0103 \u00een remunera\u021bia lunar\u0103.<\/p>\n\n\n\n<p>\u00cen cazul \u00een care institu\u021biile de securitate social\u0103 pl\u0103tesc lucr\u0103torilor absen\u021bi din cauza bolii, accidentelor, sarcinii \u0219i cre\u0219terii copiilor, o sum\u0103 pentru s\u0103rb\u0103torile men\u021bionate \u00een acest articol, compania trebuie s\u0103 pl\u0103teasc\u0103 numai diferen\u021ba dintre un astfel de tratament economic \u0219i \u00eentreaga remunera\u021bie pentru s\u0103rb\u0103tori.<\/p>\n\n\n\n<p><strong>DECLARA\u021aIE LA PROCESUL VERBAL<\/strong><\/p>\n\n\n\n<p>Pentru lucr\u0103torii companiilor care \u00ee\u0219i desf\u0103\u0219oar\u0103 activitatea \u00een municipiul Roma, dac\u0103 dincolo de s\u0103rb\u0103toarea de SS.
