Munca de noapte\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Munca de noapte, numai \u00een scop de remunerare, este considerat\u0103 munc\u0103 prestat\u0103 \u00eentre orele 22:00 \u0219i 06:00.<\/p>\n\n\n\n<p>\u201eMunca de noapte\u201d \u00een scop juridic se consider\u0103 a fi prestat\u0103 efectiv \u00een intervalul orar 22:00 &#8211; 05:00 \u00een raport cu ipoteza formulat\u0103 de art. 1, alin. 2, lit. d) din Decretul legislativ nr. 66\/2003.<\/p>\n\n\n\n<p>\u00cen scopuri legale, un \u201elucr\u0103tor de noapte\u201d este considerat a fi un lucr\u0103tor care:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>cu referire la programul s\u0103u zilnic, efectueaz\u0103 cel pu\u021bin trei ore din timpul s\u0103u de lucru, \u00een cadrul unui program normale continuu, \u00een perioada cuprins\u0103 \u00eentre orele 22:00 \u0219i 05:00; introducerea temporar\u0103 \u00eentr-un program de noapte, a\u0219a cum este specificat \u00een prezentul document, este considerat\u0103 \u201eutilizare excep\u021bional\u0103\u201d \u0219i, prin urmare, nu implic\u0103 asumarea calific\u0103rii de \u201elucr\u0103tor de noapte\u201d;<\/li>\n\n\n\n<li>cu referire la calendarul s\u0103u anual total, \u00ee\u0219i \u00eendepline\u0219te serviciul timp de cel pu\u021bin trei ore \u00een perioada cuprins\u0103 \u00eentre orele 22.00 \u0219i 5.00 pentru un minim de 80 de zile lucr\u0103toare pe an, care urmeaz\u0103 s\u0103 fie re-propor\u021bionate pentru frac\u021biunea de norm\u0103 vertical\u0103 \u0219i mixt\u0103, \u00een conformitate cu art. 1, alin. 2, lit. e) din Decretul legislativ nr. 66\/2003.<\/li>\n<\/ul>\n\n\n\n<p>Nu este considerat\u0103 munc\u0103 de noapte \u00een sensul Decretului legislativ nr. 66\/2003, dar d\u0103 dreptul la major\u0103rile prev\u0103zute de actualul C.C.N.L. munca prestat\u0103 \u00een leg\u0103tur\u0103 cu urm\u0103toarele cazuri excep\u021bionale:<\/p>\n\n\n\n<p>a) concediul de odihn\u0103 cauzat de demisia subit\u0103 a unui salariat;<\/p>\n\n\n\n<p>b) necesitatea \u00eenlocuirii din cauza absen\u021bei pe termen scurt a personalului din motive de boal\u0103, accident \u0219i\/sau for\u021b\u0103 major\u0103;<\/p>\n\n\n\n<p>c) trebuie s\u0103 \u00eenlocuiasc\u0103 personalul pentru perioade scurte (concedii, libere pl\u0103tite \u0219i nepl\u0103tite de orice fel);<\/p>\n\n\n\n<p>d) pentru executarea unor lucr\u0103ri urgente \u0219i excep\u021bionale de scurt\u0103 durat\u0103.<\/p>\n\n\n\n<p>Munca de noapte se desf\u0103\u0219oar\u0103 cu prioritate absolut\u0103 de c\u0103tre lucr\u0103torii care o solicit\u0103, \u021bin\u00e2nd cont de nevoile organizatorice ale companiei.<br><\/p>\n\n\n\n<p>\u00cen conformitate cu art. 13, alin. 1, din Decretul legislativ nr. 66\/2003, \u00een cazul adopt\u0103rii unui calendar \u00eemp\u0103r\u021bit \u00een mai multe s\u0103pt\u0103m\u00e2ni, perioada de referin\u021b\u0103 pe baza c\u0103reia se calculeaz\u0103 limita de 8 ore \u00een 24 de ore, \u00een absen\u021ba unei reglement\u0103ri specifice la nivel de societate, este definit\u0103 ca medie trimestrial\u0103.<\/p>\n\n\n\n<p>\u00cen conformitate cu art. 15 din Decretul legislativ nr. 66\/2003, care garanteaz\u0103 transferul de la munca de noapte la cea de zi, se prevede c\u0103, \u00een cazul nepotrivirii pentru munca de noapte certificat\u0103 de medicul competent \u0219i \u00een absen\u021ba unor solu\u021bii \u00een cadrul aceluia\u0219i nivel, lucr\u0103torul poate fi mutat la sarcini de nivel inferior pentru a facilita solu\u021bii menite s\u0103 protejeze ocuparea for\u021bei de munc\u0103.<\/p>\n\n\n\n<p>\u00cen sensul dispozi\u021biilor art. 13 alin. (2) din Decretul legislativ nr. 66\/2003, se confirm\u0103 dispozi\u021biile anterioare ale C.C.N.L.<\/p>\n\n\n\n<p>Introducerea muncii de noapte este precedat\u0103 de consultarea reprezentan\u021bei R.S.U. sau, \u00een cazul \u00een care nu a fost stabilit\u0103, a R.S.A. sau, \u00een lipsa acestora, a organiza\u021biilor OO.SS teritoriale;
