Orele suplimentare, munca de noapte \u0219i s\u0103rb\u0103torile\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>\u00cen cazul \u00een care nevoile speciale de servicii impun acest lucru, angajatul este obligat s\u0103 \u00ee\u0219i desf\u0103\u0219oare activitatea chiar \u0219i \u00een afara orelor normale stabilite, at\u00e2t \u00een timpul zilei, c\u00e2t \u0219i \u00een timpul nop\u021bii, cu excep\u021bia cazului \u00een care acest lucru este justificat de un motiv individual de impediment.<\/p>\n\n\n\n<p>Societatea nu poate solicita o prelungire orar\u0103 \u0219i un presta\u021bie suplimentar\u0103 care dep\u0103\u0219e\u0219te 150 de ore pe an.<\/p>\n\n\n\n<p>Se consider\u0103 munc\u0103 suplimentar\u0103, \u0219i d\u0103 na\u0219tere la remunera\u021bii, cea dispus\u0103 de societate \u0219i efectuat\u0103 peste durata normal\u0103 a muncii prev\u0103zute la art. 30, f\u0103r\u0103 a aduce atingere prevederilor art. 31.<\/p>\n\n\n\n<p>Munca suplimentar\u0103 trebuie pl\u0103tit\u0103 cu cote orare din salariul lunar total.<\/p>\n\n\n\n<p>Munca suplimentar\u0103 \u0219i munca efectuat\u0103 \u00een zilele de s\u0103rb\u0103toare legal\u0103 \u0219i pe timp de noapte trebuie pl\u0103tit\u0103 cu urm\u0103toarele major\u0103ri procentuale:<\/p>\n\n\n\n<p><\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td>Munc\u0103 suplimentar\u0103 \u00een timpul s\u0103pt\u0103m\u00e2nii<\/td><td>25%<\/td><\/tr><tr><td>Munc\u0103 peste program pe timp de noapte<\/td><td>50%<\/td><\/tr><tr><td>Ore suplimentare de s\u0103rb\u0103toare<\/td><td>65%<\/td><\/tr><tr><td>Ore suplimentare de noapte de s\u0103rb\u0103toare<\/td><td>75%<\/td><\/tr><tr><td>Munc\u0103 efectuat\u0103 \u00een zilele considerate s\u0103rb\u0103tori legale<\/td><td>50%<\/td><\/tr><tr><td>Munc\u0103 de noapte, inclusiv schimburi alternative<\/td><td>20%<\/td><\/tr><tr><td>Munca de noapte, neinclus\u0103 \u00een ture alternative<\/td><td>30%<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Procentele de mai sus vor fi calculate pe cota orar\u0103 a salariului de baz\u0103 la momentul decont\u0103rii.<br><\/p>\n\n\n\n<p>Procentele de cre\u0219tere men\u021bionate mai sus nu pot fi cumulate, \u00een sensul c\u0103 cel mai mare \u00eel va absorbi pe cel mai mic.<\/p>\n\n\n\n<p>\u00cen sensul celor de mai sus, munca de noapte este definit\u0103 ca munc\u0103 \u00eentre orele 22:00 \u0219i 06:00.<\/p>\n\n\n\n<p>\u00cen singurele cazuri de serviciu de noapte continuu, cre\u0219terea relativ\u0103 trebuie luat\u0103 \u00een considerare \u00een urm\u0103toarele elemente contractuale instituite:<\/p>\n\n\n\n<p>a) concediul;<\/p>\n\n\n\n<p>b) s\u0103rb\u0103toare;<\/p>\n\n\n\n<p>c) a 13-a plat\u0103 lunar\u0103;<\/p>\n\n\n\n<p>d) a 14-a plat\u0103 lunar\u0103;<\/p>\n\n\n\n<p>e) Lichidarea la \u00eencheierea raportului de munc\u0103;<\/p>\n\n\n\n<p>f) lichidarea pentru lipsa preavizului;<\/p>\n\n\n\n<p>g) boal\u0103 \u0219i accident.<\/p>\n\n\n\n<p>Pentru personalul cu rol de func\u021bionari, condi\u021biile cele mai favorabile r\u0103m\u00e2n neschimbate.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRevino sus\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Articolul 38 &#8211;
