Absen\u021be, libere, concediu de casatorie\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Cu excep\u021bia cazurilor de impediment dovedit, toate absen\u021bele trebuie comunicate societ\u0103\u021bii \u00een ziua \u00een care apar. \u00cen cazul turelor de sear\u0103, aceasta \u00eenseamn\u0103 24 de ore de la \u00eenceputul turei.<\/p>\n\n\n\n<p>Absen\u021bele trebuie justificate \u00een urm\u0103toarele 2 zile, cu excep\u021bia cazurilor de impediment dovedit.<\/p>\n\n\n\n<p>Absen\u021bele nemotivate pot fi sanc\u021bionate \u00een conformitate cu articolele 47, 48 \u0219i 49 din prezentul C.C.N.L.<\/p>\n\n\n\n<p><strong>\u00ceNVOIRI<\/strong><\/p>\n\n\n\n<p>Companiile pot acorda libere scurte lucr\u0103torului care \u00eel solicit\u0103 din motive justificate, cu dreptul de a nu pl\u0103ti salariul respectiv.<\/p>\n\n\n\n<p>Cu ocazia na\u0219terii unui copil, lucr\u0103torului i se va acorda o zi de \u00eenvoire pl\u0103tit\u0103.<\/p>\n\n\n\n<p>Lucr\u0103torului afectat de doliul familiei pentru decesul unui p\u0103rinte, copil, frate sau so\u021b, societatea \u00eei va acorda 3 zile libere pl\u0103tite dac\u0103 evenimentul de doliu a avut loc \u00een ora\u0219ul \u00een care lucreaz\u0103 sau \u00een provincia sa \u0219i 5 zile, din care 3 pl\u0103tite, dac\u0103 evenimentul a avut loc \u00een afara provinciei.<\/p>\n\n\n\n<p>\u00cen cazul \u00een care doliul are loc \u00een timpul serviciului, lucr\u0103torului i se va permite s\u0103 p\u0103r\u0103seasc\u0103 imediat locul de munc\u0103 cu dreptul la \u00eentregul salariu na\u021bional, \u00een plus fa\u021b\u0103 de prevederile alineatului precedent.<\/p>\n\n\n\n<p>Aceste libere nu sunt luate \u00een calcul \u00een perioada de vacan\u021b\u0103 anual\u0103.<\/p>\n\n\n\n<p>Pentru orice nu este prev\u0103zut \u00een prezentul articol, se aplic\u0103 Legea 8 martie 2000, nr. 53.<\/p>\n\n\n\n<p><strong>CONCEDIU DE C\u0102S\u0102TORIE<\/strong><\/p>\n\n\n\n<p>Lucr\u0103torul c\u0103s\u0103torit va beneficia de un concediu de odihn\u0103 de 15 zile lucr\u0103toare, cu deducerea oric\u0103rei sume pl\u0103tite pentru aceast\u0103 perioad\u0103 de c\u0103tre Institutul Na\u021bional de Asigur\u0103ri Sociale.<\/p>\n\n\n\n<p>Pentru noii angaja\u021bi \u00eencep\u00e2nd cu 1 iunie 2001, concediul este egal cu 15 zile calendaristice. Acest concediu nu este luat \u00een calcul \u00een perioada concediului de odihn\u0103 anual.<\/p>\n\n\n\n<p style=\"text-transform:uppercase\"><strong>LIBERELE CONFORM LEGII nr. 104, din 5 februarie 1992<\/strong><\/p>\n\n\n\n<p>Cu condi\u021bia ca persoana cu handicap s\u0103 nu fie spitalizat\u0103 cu norm\u0103 \u00eentreag\u0103, lucr\u0103torul care asist\u0103 o persoan\u0103 cu handicap aflat\u0103 \u00eentr-o situa\u021bie grav\u0103, so\u021bul\/so\u021bia, ruda sau ruda de gradul al doilea sau \u00een gradul al treilea, dac\u0103 p\u0103rin\u021bii sau so\u021bul\/so\u021bia persoanei cu handicap aflate \u00eentr-o situa\u021bie grav\u0103 au \u00eemplinit v\u00e2rsta de \u0219aizeci \u0219i cinci de ani sau sufer\u0103 \u0219i de boli cu handicap sau au decedat sau lipsesc, are dreptul la trei zile libere lunar pl\u0103tite acoperit de contribu\u021biile de asigur\u0103ri sociale, chiar \u0219i \u00een mod continuu.<\/p>\n\n\n\n<p>Dreptul men\u021bionat mai sus nu poate fi acordat mai multor angaja\u021bi pentru asisten\u021ba aceleia\u0219i persoane cu handicap \u00eentr-o situa\u021bie grav\u0103.<\/p>\n\n\n\n<p>Pentru asisten\u021ba acordat\u0103 aceluia\u0219i copil cu handicap aflat \u00eentr-o situa\u021bie grav\u0103, dreptul este recunoscut ambilor p\u0103rin\u021bi, inclusiv p\u0103rin\u021bilor adoptivi \u0219i asisten\u021bilor maternali, care pot beneficia alternativ de acesta.<\/p>\n\n\n\n<p>Pentru a echilibra dreptul la liberele lunare men\u021bionate la alineatele anterioare cu nevoile organizatorice \u0219i tehnico-productive normale ale companiei, lucr\u0103torul c\u0103ruia \u00eei sunt recunoscute liberele lunare comunic\u0103 \u00een scris angajatorului programul pentru utilizarea preconizat\u0103 a acestora trimestrial, dac\u0103 este posibil, sau \u00een orice caz cel pu\u021bin lunar, pentru a asigura reconcilierea dreptului lucr\u0103torului cu nevoile organizatorice ale companiei.<\/p>\n\n\n\n<p>Lucr\u0103torul are dreptul de a modifica, din motive dovedite, data comunicat\u0103 prin notificarea \u00een scris a angajatorului cu cel pu\u021bin dou\u0103 zile lucr\u0103toare \u00een avans, cu excep\u021bia cazurilor de urgen\u021b\u0103 grav\u0103 brusc\u0103.<\/p>\n\n\n\n<p>Angajatorul, \u00een luna de referin\u021b\u0103, \u00een cazul \u00een care exist\u0103 cerin\u021be tehnice, organizatorice sau de produc\u021bie justificate, pe care le comunic\u0103 lucr\u0103torului, poate am\u00e2na utilizarea liberelor cu respect\u00e2nd limita temporar\u0103 de o lun\u0103. Cu toate acestea, sunt excluse situa\u021biile \u00een care motivele dovedite ale lucr\u0103torului sunt de natur\u0103 absolut indiferent\u0103 \u0219i urgent\u0103.<br><\/p>\n\n\n\n<p>Lucr\u0103torul care beneficiaz\u0103 de liberele prev\u0103zute la alineatele precedente are dreptul de a alege, acolo unde este posibil, locul de munc\u0103 cel mai apropiat de domiciliul persoanei care urmeaz\u0103 s\u0103 fie asistat\u0103 \u0219i nu poate fi transferat f\u0103r\u0103 consim\u021b\u0103m\u00e2ntul s\u0103u \u00eentr-o alt\u0103 loca\u021bie.<\/p>\n\n\n\n<p>\u00cen cazurile de concentrare excesiv\u0103 a lucr\u0103torilor care au dreptul la acela\u0219i contract de achizi\u021bie, astfel \u00eenc\u00e2t s\u0103 \u00eempiedice gestionarea corect\u0103 \u0219i func\u021bionarea normal\u0103 a acestuia, la nivel de companie, companiile \u0219i reprezentan\u021bii sindicali se vor \u00eent\u00e2lni pentru a evalua orice posibil\u0103 solu\u021bie alternativ\u0103.<\/p>\n\n\n\n<p>F\u0103r\u0103 a aduce atingere verific\u0103rii condi\u021biilor de constatare a r\u0103spunderii disciplinare men\u021bionate la articolul 46 \u0219i urm\u0103toarele din prezenta C.C.N.L., lucr\u0103torul care beneficiaz\u0103 de zilele libere men\u021bionate la alineatele anterioare \u00ee\u0219i pierde drepturile men\u021bionate la prezentul articol, \u00een cazul \u00een care angajatorul sau INPS constat\u0103 inexisten\u021ba sau ne\u00eendeplinirea condi\u021biilor pentru utilizarea legitim\u0103 a acestor drepturi.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRevino sus\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Articolul 35 &#8211; Absen\u021be, libere, concediu de casatorie Cu excep\u021bia cazurilor de impediment dovedit, toate absen\u021bele trebuie comunicate societ\u0103\u021bii \u00een ziua \u00een care apar. \u00cen cazul turelor de sear\u0103, aceasta \u00eenseamn\u0103 24 de ore de la \u00eenceputul turei.
