Programul de lucru multiperioad\u0103 pentru lucratorii cu norma intreaga \u0219i orele acumulate\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Pentru a r\u0103spunde nevoilor legate de modific\u0103rile intensit\u0103\u021bii muncii, durata orelor de lucru poate rezulta \u0219i dintr-o medie multi-s\u0103pt\u0103m\u00e2nal\u0103 pe parcursul anului, cu limite maxime de 45 de ore pe s\u0103pt\u0103m\u00e2n\u0103 \u0219i 10 ore pe zi \u0219i cu o durat\u0103 minim\u0103 de 35 de ore pe s\u0103pt\u0103m\u00e2n\u0103.<\/p>\n\n\n\n<p>Abaterile de la program cu motivele relative vor fi aduse la cuno\u0219tin\u021ba R.S.U. \u0219i, dac\u0103 nu a fost \u00eenc\u0103 stabilite, la R.S.A..<\/p>\n\n\n\n<p>\u00cen astfel de cazuri, presta\u021biile care dep\u0103\u0219esc programul normal de lucru zilnic \u0219i s\u0103pt\u0103m\u00e2nal nu vor da na\u0219tere la compensa\u021bii pentru munca suplimentar\u0103 p\u00e2n\u0103 c\u00e2nd orele care trebuie compensate nu coincid.<\/p>\n\n\n\n<p>\u00cen cadrul flexibilit\u0103\u021bilor prev\u0103zute mai sus, lucr\u0103torii \u00een cauz\u0103 vor primi remunera\u021bia referitoare la orele contractuale normale at\u00e2t \u00een perioadele de dep\u0103\u0219ire, c\u00e2t \u0219i \u00een cele cu performan\u021be mai sc\u0103zute.<\/p>\n\n\n\n<p>Fiecare lucr\u0103tor poate combina \u00eentr-o \u201ebanc\u0103 de ore individuale\u201d orele de munc\u0103 care dep\u0103\u0219esc 45 de ore, care, la cererea p\u0103r\u021bii interesate, vor fi recuperate sub form\u0103 de repaus compensatoriu, f\u0103r\u0103 a aduce atingere major\u0103rilor relative care vor fi pl\u0103tite cu salariul aferent \u00een luna urm\u0103toare celei \u00een care au fost efectuate aceste presta\u021bii.<\/p>\n\n\n\n<p>Pentru implementarea acumul\u0103rii de ore, lucr\u0103torul trebuie s\u0103 declare \u00een prealabil, p\u00e2n\u0103 \u00een luna ianuarie a fiec\u0103rui an, \u00een scris, dorin\u021ba de a recupera orele acumulate \u00een banc\u0103; \u00een acest caz, perioadele de odihn\u0103 prev\u0103zute la paragraful anterior pot fi luate \u00een termen de 6 luni de la luna \u00een care a fost prestat\u0103 serviciul, cu condi\u021bia ca persoana \u00een cauz\u0103 s\u0103 o solicite cu un preaviz de cel pu\u021bin cinci zile \u0219i s\u0103 nu lipseasc\u0103 \u00een acela\u0219i timp din acela\u0219i motiv mai mult de 3% din personal, iar in acel moment s\u0103 nu fie \u00eempiedicate nevoile obiective si dovedite ale companiei prin ne\u00eendeplinirea sarcinilor.<\/p>\n\n\n\n<p>\u00cen cazul \u00een care perioada de preaviz nu este respectat\u0103, orele de odihn\u0103 necesare vor fi acordate \u00een mod compatibil cu nevoile companiei.<\/p>\n\n\n\n<p>\u00cen cazul \u00een care, \u00een mod excep\u021bional \u0219i pentru necesit\u0103\u021bile tehnice \u0219i de produc\u021bie, este imposibil s\u0103 se recupereze orele astfel acumulate prin repaus compensatoriu, \u00een termen de 12 luni, suma corespunz\u0103toare va fi pl\u0103tit\u0103 lucr\u0103torului \u00een cauz\u0103 pe baza remunera\u021biei orare \u00een vigoare la acea dat\u0103.<\/p>\n\n\n\n<p>Se \u00een\u021belege c\u0103, \u00een cazul transferului contractului de achizi\u021bie, orele aferente indemniza\u021biei compensatorii pentru odihn\u0103 neutilizate vor fi remunerate.<\/p>\n\n\n\n<p>\u00cen ceea ce prive\u0219te articularea programului de lucru pe mai multe perioade pentru serviciile de cur\u0103\u021benie \u00een instala\u021biile industriale, condi\u021biile existente cele mai favorabile nu sunt afectate.<br><\/p>\n\n\n\n<p>\u00cen cazul \u00een care apare \u00een societate, necesitatea de a activa institu\u021bia Orelor acumulate pentru alte nevoi dec\u00e2t cele identificate mai sus, pe fond, aceea\u0219i societate cu reprezentan\u021ba R.S.U. \u0219i, dac\u0103 nu este \u00eenc\u0103 \u00eenfiin\u021bat\u0103, cu R.S.A. \u00eempreun\u0103 cu organiza\u021bia OO.SS. care stipuleaz\u0103 acest C.C.N.L. sau cu OO.SS. care stipuleaz\u0103 acest C.C.N.L., pot defini acorduri specifice ale societ\u0103\u021bii. \u00cen orice caz, astfel de acorduri trebuie stabilite \u00een deplin\u0103 conformitate cu scopurile \u0219i con\u021binutul stabilite \u00een acest articol.
