Pr\u00e9avis\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>La relation de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e ne peut \u00eatre r\u00e9sili\u00e9e par aucune des deux parties sans pr\u00e9avis, dont les d\u00e9lais sont fix\u00e9s comme suit:<\/p>\n\n\n\n<p><strong>EMPLOY\u00c9S<\/strong><\/p>\n\n\n\n<p>a) pour les employ\u00e9s qui, ayant d\u00e9pass\u00e9 la p\u00e9riode d\u2019essai, n\u2019ont pas d\u00e9pass\u00e9 cinq ann\u00e9es de service:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>2 mois et 15 jours pour les employ\u00e9s de niveau 7 et Cadres;<\/li>\n\n\n\n<li>1 mois et 15 jours pour les employ\u00e9s de niveau 6;<\/li>\n\n\n\n<li>1 mois pour les employ\u00e9s du 5\u00e8me au 2\u00e8me niveau;<\/li>\n<\/ol>\n\n\n\n<p>b) pour les employ\u00e9s de plus de cinq ans et non de dix ans:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>3 mois et 15 jours pour les employ\u00e9s de niveau 7 et Cadres;<\/li>\n\n\n\n<li>2 mois pour les employ\u00e9s de niveau 6;<\/li>\n\n\n\n<li>1 mois et 15 jours pour les employ\u00e9s du 5\u00e8me au 2\u00e8me niveau;<\/li>\n<\/ol>\n\n\n\n<p>c) pour les employ\u00e9s ayant plus de dix ans de service:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>4 mois et 15 jours pour les employ\u00e9s de niveau 7 et Cadres;<\/li>\n\n\n\n<li>2 mois et 15 jours pour les employ\u00e9s de niveau 6;<\/li>\n\n\n\n<li>2 mois pour les employ\u00e9s du 5\u00e8me au 2\u00e8me niveau.<\/li>\n<\/ol>\n\n\n\n<p><strong>OUVRIERS<\/strong><\/p>\n\n\n\n<p>15 jours civils pour les ouvriers de tout niveau, ind\u00e9pendamment de leur anciennet\u00e9.<\/p>\n\n\n\n<p>Les d\u00e9lais de pr\u00e9avis vis\u00e9s au pr\u00e9sent article sont r\u00e9duits respectivement \u00e0 50\u00a0% pour les employ\u00e9s et \u00e0 7 jours calendrier pour les ouvriers si le travailleur donne le pr\u00e9avis.<\/p>\n\n\n\n<p>Les d\u00e9lais de r\u00e9siliation commencent au milieu et \u00e0 la fin de chaque mois.<\/p>\n\n\n\n<p>La partie qui r\u00e9silie le rapport sans respecter les d\u00e9lais de pr\u00e9avis susmentionn\u00e9s doit verser \u00e0 l\u2019autre une indemnit\u00e9 \u00e9gale au montant de la r\u00e9mun\u00e9ration globale pour la p\u00e9riode de non-pr\u00e9sentation.<\/p>\n\n\n\n<p>L\u2019employeur a le droit de retenir, sur ce qu\u2019il doit au travailleur, un montant correspondant \u00e0 la r\u00e9mun\u00e9ration pour la p\u00e9riode de pr\u00e9avis que celui-ci peut ne pas avoir donn\u00e9e.<\/p>\n\n\n\n<p>Le d\u00e9lai de pr\u00e9avis, m\u00eame s\u2019il est remplac\u00e9 par l\u2019indemnit\u00e9 correspondante, sera pris en compte dans l\u2019anciennet\u00e9 aux fins de l\u2019indemnit\u00e9 de licenciement.<\/p>\n\n\n\n<p>La partie qui re\u00e7oit la r\u00e9siliation conform\u00e9ment \u00e0 l\u2019alin\u00e9a 1 peut tronquer le rapport, soit au d\u00e9but, soit au cours du pr\u00e9avis, sans que cela donne lieu \u00e0 une obligation d\u2019indemnisation pour la p\u00e9riode de pr\u00e9avis non accompli.<\/p>\n\n\n\n<p>Pendant la p\u00e9riode de pr\u00e9avis, l\u2019employeur accordera au travailleur des permis pour la recherche d\u2019un nouvel emploi;
