Cong\u00e9s pour les femmes victimes de violences sexistes\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Les travailleuses inscrites dans les parcours de protection relatifs \u00e0 la violence li\u00e9e au genre, au sens et aux effets de l\u2019article 24 du d\u00e9cret l\u00e9gislatif 80\/2015 et des modifications et compl\u00e9ments ult\u00e9rieurs, d\u00fbment certifi\u00e9s par les services sociaux de la commune de r\u00e9sidence ou par les centres antiviolence ou les refuges, ont le droit de s\u2019abstenir de travailler pour des raisons li\u00e9es au parcours de protection pendant une p\u00e9riode maximale de 90 jours ouvrables, conform\u00e9ment \u00e0 cette disposition l\u00e9gale.<\/p>\n\n\n\n<p>Aux fins de l\u2019exercice du droit vis\u00e9 au pr\u00e9sent article, la travailleuse est tenue, sauf cas d\u2019impossibilit\u00e9 objective, de pr\u00e9venir l\u2019employeur au moins sept jours \u00e0 l\u2019avance, avec l\u2019indication du d\u00e9but et de la fin de la p\u00e9riode de cong\u00e9 et \u00e0 produire la certification attestant l\u2019insertion dans les parcours vis\u00e9s \u00e0 l\u2019alin\u00e9a pr\u00e9c\u00e9dent.<\/p>\n\n\n\n<p>La p\u00e9riode de cong\u00e9 vis\u00e9e \u00e0 l\u2019alin\u00e9a 1 est prise en compte pour l\u2019anciennet\u00e9 de service \u00e0 part enti\u00e8re ainsi que pour l\u2019accomplissement des cong\u00e9s, la treizi\u00e8me mensualit\u00e9, la quatorzi\u00e8me mensualit\u00e9 et le traitement de fin de contrat.<\/p>\n\n\n\n<p>Pendant la p\u00e9riode de cong\u00e9, la travailleuse, apr\u00e8s avoir pris les dispositions de l\u2019alin\u00e9a 3, a droit \u00e0 une indemnit\u00e9 correspondant au dernier salaire et cette p\u00e9riode est\u00a0couverte par la cotisation imput\u00e9e. L\u2019indemnit\u00e9 est avanc\u00e9e par l\u2019employeur et mise en balance avec les cotisations dues \u00e0 l\u2019INPS, selon les modalit\u00e9s pr\u00e9vues pour le versement des traitements \u00e9conomiques de maternit\u00e9.<\/p>\n\n\n\n<p>Le cong\u00e9 peut \u00eatre pris sur une base horaire ou journali\u00e8re sur une p\u00e9riode de trois ans, la travailleuse peut choisir entre la consommation journali\u00e8re et horaire, \u00e9tant entendu que la consommation \u00e0 l\u2019heure est autoris\u00e9e pour moiti\u00e9 de l\u2019horaire moyen journalier du mois pr\u00e9c\u00e9dant imm\u00e9diatement celui au cours duquel le cong\u00e9 commence.<\/p>\n\n\n\n<p>Sous r\u00e9serve des conditions pr\u00e9vues \u00e0 l\u2019alin\u00e9a 1 de l\u2019article 24 du d\u00e9cret l\u00e9gislatif pr\u00e9cit\u00e9 et \u00e0 la demande de la travailleuse, le cong\u00e9 vis\u00e9 \u00e0 l\u2019alin\u00e9a 1 sera prolong\u00e9 de 90 jours suppl\u00e9mentaires avec droit au paiement d\u2019une indemnit\u00e9 \u00e9gale \u00e0 70\u00a0% du salaire courant.<\/p>\n\n\n\n<p>La travailleuse a droit \u00e0 la transformation du travail \u00e0 temps plein en travail \u00e0 temps partiel, vertical ou horizontal. \u00c0 la demande de la travailleuse, la relation de travail \u00e0 temps partiel doit \u00e0 nouveau \u00eatre transform\u00e9e en relation de travail \u00e0 temps plein.<\/p>\n\n\n\n<p>La travailleuse inscrite sur les parcours de protection vis\u00e9s \u00e0 l&rsquo;alin\u00e9a 1 peut demander \u00e0 \u00eatre transf\u00e9r\u00e9e vers un autre march\u00e9, \u00e9galement situ\u00e9 dans une autre commune. Dans les 7 jours suivant cette communication, l\u2019entreprise, apr\u00e8s avoir v\u00e9rifi\u00e9 la disponibilit\u00e9 des postes dans d\u2019autres march\u00e9s, s\u2019engage \u00e0 transf\u00e9rer la travailleuse.<\/p>\n\n\n\n<p>La travailleuse peut, \u00e0 l\u2019issue de son parcours de protection, demander \u00e0 \u00eatre exempt\u00e9e des postes difficiles pendant une p\u00e9riode d\u2019un an.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRetour en haut\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Article 52-bis &#8211;
