Licenciement pour faute\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p style=\"text-transform:uppercase\"><strong>A) \u00a0Licenciement avec pr\u00e9avis<\/strong><\/p>\n\n\n\n<p>Cette mesure est impos\u00e9e au travailleur qui commet des infractions \u00e0 la discipline et \u00e0 la diligence du travail qui, tout en \u00e9tant plus importantes que celles vis\u00e9es \u00e0 l\u2019article 47, ne soient pas d\u2019une gravit\u00e9 telle que la sanction pr\u00e9vue au point B) du pr\u00e9sent article s\u2019applique.<\/p>\n\n\n\n<p>\u00c0 titre indicatif, les infractions vis\u00e9es ci-dessus concernent:<\/p>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-container-core-group-is-layout-990f8f10 wp-block-group-is-layout-constrained\">\n<p>a) insubordination aux sup\u00e9rieurs;<\/p>\n\n\n\n<p>b) endommagement d\u00e9lib\u00e9r\u00e9 sensible du mat\u00e9riel de l\u2019entreprise ou du ma\u00eetre d\u2019ouvrage;<\/p>\n\n\n\n<p>c) bagarre sur le lieu de travail;<\/p>\n\n\n\n<p>d) abandon du poste de travail par le personnel sp\u00e9cifiquement charg\u00e9 de la surveillance, de la garde et du contr\u00f4le, en dehors des cas pr\u00e9vus au point e) de la lettre B);<\/p>\n\n\n\n<p>e) absences injustifi\u00e9es prolong\u00e9es au-del\u00e0 de quatre jours cons\u00e9cutifs ou absences r\u00e9p\u00e9t\u00e9es trois fois dans une ann\u00e9e le jour suivant les vacances ou les cong\u00e9s;<\/p>\n\n\n\n<p>f) condamne \u00e0 une peine privative de libert\u00e9 prononc\u00e9e \u00e0 l\u2019encontre du travailleur, par un jugement ayant force de chose jug\u00e9e, pour une action commise, apr\u00e8s l\u2019embauche, qui n\u2019est pas en rapport avec l\u2019exercice de la relation de travail et qui porte atteinte \u00e0 la personnalit\u00e9 morale du travailleur;<\/p>\n\n\n\n<p>g) r\u00e9cidive en cas de manquement vis\u00e9 \u00e0 l\u2019article 47, lorsque deux mesures de suspension vis\u00e9es \u00e0 l\u2019article 47 ont \u00e9t\u00e9 prises, sans pr\u00e9judice du dernier alin\u00e9a de l\u2019article 46.<\/p>\n\n\n\n<p><\/p>\n<\/div>\n\n\n\n<p style=\"text-transform:uppercase\"><strong>B) Licenciement sans pr\u00e9avis<\/strong><\/p>\n\n\n\n<p>Dans cette mesure, le travailleur encourt la responsabilit\u00e9 du fait qu\u2019il cause \u00e0 l\u2019entreprise une atteinte morale ou mat\u00e9rielle grave ou qu\u2019il accomplit, en liaison avec l\u2019accomplissement de la relation de travail, des actions qui constituent un d\u00e9lit \u00e0 terme.<\/p>\n\n\n\n<p>\u00c0 titre indicatif, les infractions vis\u00e9es ci-dessus concernent:<\/p>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-container-core-group-is-layout-990f8f10 wp-block-group-is-layout-constrained\">\n<p>a) insubordination grave aux sup\u00e9rieurs;<\/p>\n\n\n\n<p>b) vol dans l&rsquo;entreprise ou aupr\u00e8s du donneur d\u2019ordre;<\/p>\n\n\n\n<p>c) le vol d\u2019objets ou de documents de l\u2019entreprise ou du donneur d\u2019ordre;<\/p>\n\n\n\n<p>d) d\u00e9t\u00e9rioration volontaire du mat\u00e9riel de l\u2019entreprise ou du donneur d\u2019ordre;<\/p>\n\n\n\n<p>e) l\u2019abandon d\u2019un poste de travail susceptible de porter pr\u00e9judice \u00e0 la s\u00e9curit\u00e9 des personnes ou \u00e0 la s\u00e9curit\u00e9 des f) installations ou d\u2019autres actions impliquant les m\u00eames pr\u00e9judices;<\/p>\n\n\n\n<p>g) fumer l\u00e0 o\u00f9 cela peut nuire \u00e0 la s\u00e9curit\u00e9 des personnes ou \u00e0 la s\u00e9curit\u00e9 des installations;<\/p>\n\n\n\n<p>h) ex\u00e9cution sans permis de travail dans l\u2019entreprise pour compte propre ou pour compte de tiers, non mineure et\/ou avec l\u2019utilisation de mat\u00e9riel de l\u2019entreprise;<\/p>\n\n\n\n<p>i) bagarre \u00e0 l\u2019int\u00e9rieur des ateliers.<\/p>\n\n\n\n<p><\/p>\n<\/div>\n\n\n\n<p style=\"text-transform:uppercase\"><strong>C)\u00a0Licenciement sans pr\u00e9avis et avec retenue<\/strong><\/p>\n\n\n\n<p>Dans cette mesure, le travailleur qui, sans aucune justification, ne se pr\u00e9sente pas sur le lieu de travail pendant dix jours cons\u00e9cutifs \u00e0 compter du dernier jour de pr\u00e9sence constat\u00e9e, en se rendant introuvable.<\/p>\n\n\n\n<p>Dans ce cas de licenciement sans pr\u00e9avis, l\u2019employeur retiendra, \u00e0 titre de p\u00e9nalit\u00e9, une somme \u00e9gale \u00e0 l\u2019indemnit\u00e9 de remplacement du pr\u00e9avis d\u00fb pour le licenciement.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRetour en haut\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Article 48 &#8211;
