Mesures disciplinaires\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Le non-respect par le travailleur des dispositions du pr\u00e9sent contrat peut donner lieu, selon la gravit\u00e9 de l\u2019infraction, \u00e0 l\u2019application des mesures suivantes:<\/p>\n\n\n\n<p>a)\u00a0rappel verbal;<\/p>\n\n\n\n<p>b)\u00a0avertissement \u00e9crit;<\/p>\n\n\n\n<p>c)\u00a0amende ne d\u00e9passant pas trois heures de salaire horaire, calcul\u00e9e sur le bar\u00e8me minimal;<\/p>\n\n\n\n<p>d)\u00a0suspension du travail et de la r\u00e9mun\u00e9ration jusqu\u2019\u00e0 un maximum de trois jours;<\/p>\n\n\n\n<p>e)\u00a0licenciement pour faute au sens de l\u2019article 48.<\/p>\n\n\n\n<p>L\u2019employeur ne pourra prendre aucune mesure disciplinaire \u00e0 l\u2019encontre du travailleur sans lui avoir pr\u00e9alablement contest\u00e9 le d\u00e9bit et sans l\u2019avoir entendu pour sa d\u00e9fense.<\/p>\n\n\n\n<p>Sauf pour rappel verbal, la contestation devra \u00eatre faite par \u00e9crit et les mesures disciplinaires ne pourront pas \u00eatre prises avant 5 jours, au cours desquels le travailleur pourra pr\u00e9senter ses justifications.<\/p>\n\n\n\n<p>Si la mesure n\u2019est pas prise dans les 15 jours ouvrables \u00e0 ces justifications, celles-ci seront consid\u00e9r\u00e9es comme accept\u00e9es.<\/p>\n\n\n\n<p>Le travailleur pourra pr\u00e9senter ses justifications m\u00eame verbalement, avec l\u2019\u00e9ventuelle assistance d\u2019un repr\u00e9sentant de l\u2019Association syndicale auquel il adh\u00e8re, ou d\u2019un membre de la Repr\u00e9sentation syndicale unitaire.<\/p>\n\n\n\n<p>Si, dans un d\u00e9lai de cinq jours \u00e0 compter de la contestation, le travailleur d\u00e9clare formellement son intention de recourir \u00e0 l\u2019assistance d\u2019un repr\u00e9sentant syndical, l\u2019\u00e9ventuelle rencontre entre travailleur et repr\u00e9sentant syndical avec l\u2019entreprise devra se tenir dans le d\u00e9lai p\u00e9remptoire de 30 jours \u00e0 compter de la contestation, dans la province ou la commune o\u00f9 il insiste sur le march\u00e9 (dont le travailleur est charg\u00e9) au terme de laquelle les justifications ne peuvent \u00eatre pr\u00e9sent\u00e9es que par \u00e9crit, dans les trois jours qui suivent.\u00a0<\/p>\n\n\n\n<p>Ce d\u00e9lai expire si la rencontre ne peut avoir lieu pour cause imputable \u00e0 l\u2019employeur. La d\u00e9cision doit \u00eatre motiv\u00e9e et notifi\u00e9e par \u00e9crit.<\/p>\n\n\n\n<p>Les mesures disciplinaires vis\u00e9es aux points b), c) et d) ci-dessus pourront \u00eatre contest\u00e9es par le travailleur au niveau syndical, selon les r\u00e8gles contractuelles relatives aux litiges.\u00a0<\/p>\n\n\n\n<p>Le licenciement pour faute vis\u00e9e aux points A) et B) de l\u2019article 48 pourra \u00eatre attaqu\u00e9 selon les proc\u00e9dures pr\u00e9vues \u00e0 l\u2019article 7 de la loi n\u00b0604\/1966 confirm\u00e9es par l\u2019article 18 de la loi n\u00b0300\/1970.<\/p>\n\n\n\n<p>Il ne sera tenu compte d\u2019aucun effet des mesures disciplinaires deux ans apr\u00e8s leur adoption.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRetour en haut\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Article 46 &#8211;
