Cong\u00e9s\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Le travailleur qui a une anciennet\u00e9 de 12 mois dans l\u2019entreprise a droit chaque ann\u00e9e \u00e0 une p\u00e9riode de cong\u00e9s pay\u00e9s:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>soit 22 jours ouvrables en cas de prestation hebdomadaire r\u00e9partie sur 5 jours (semaine courte);<\/li>\n\n\n\n<li>soit 26 jours en cas de prestation hebdomadaire r\u00e9partie sur 6 jours.<\/li>\n<\/ul>\n\n\n\n<p>En cas de licenciement dans tous les cas ou de d\u00e9mission, le travailleur, s\u2019il a acquis le droit aux cong\u00e9s complets, aura droit \u00e0 la compensation de ces cong\u00e9s.<\/p>\n\n\n\n<p>S\u2019il n\u2019a pas acquis le droit aux cong\u00e9s complets, le travailleur aura droit \u00e0 autant de douzi\u00e8mes de cong\u00e9s qu\u2019il y a de mois entiers d\u2019anciennet\u00e9.<\/p>\n\n\n\n<p>Les fractions de mois ne d\u00e9passant pas 15 jours ne seront pas calcul\u00e9es, alors qu\u2019elles seront consid\u00e9r\u00e9es comme mois entier si elles d\u00e9passent 15 jours.<\/p>\n\n\n\n<p>Le travailleur qui, au moment des cong\u00e9s, n\u2019a pas acquis le droit \u00e0 la totalit\u00e9 de la p\u00e9riode de cong\u00e9 pour ne pas avoir une anciennet\u00e9 de service d\u2019au moins 12 mois cons\u00e9cutifs dans l\u2019entreprise aura droit \u00e0 1\/12 des cong\u00e9s pour chaque mois de service accompli.<\/p>\n\n\n\n<p>En cas de cong\u00e9 collectif pour le travailleur qui n\u2019a pas acquis le droit au cong\u00e9 complet,\u00a0les cong\u00e9s seront pris par rapport aux douzi\u00e8mes mois d\u2019anciennet\u00e9.<\/p>\n\n\n\n<p>En cas de jours f\u00e9ri\u00e9s ou de vacances en milieu de semaine, cette p\u00e9riode sera prolong\u00e9e pour le nombre de ces jours f\u00e9ri\u00e9s.<\/p>\n\n\n\n<p>La p\u00e9riode de pr\u00e9avis ne peut pas \u00eatre consid\u00e9r\u00e9e comme une p\u00e9riode de vacances.<\/p>\n\n\n\n<p>La p\u00e9riode des vacances sera fix\u00e9e selon les exigences de travail, d\u2019un commun accord entre les parties, simultan\u00e9ment par d\u00e9partement, par tranche ou individuellement.<\/p>\n\n\n\n<p>Dans tous les cas, l\u2019entreprise assurera au travailleur, pour chaque ann\u00e9e civile (1\u00a0janvier &#8211; 31\u00a0d\u00e9cembre), la jouissance de 2 semaines de cong\u00e9s au cours de la p\u00e9riode 1 er juin &#8211; 30\u00a0septembre.<\/p>\n\n\n\n<p>La disposition de l\u2019alin\u00e9a pr\u00e9c\u00e9dent ne s\u2019applique pas aux entreprises de d\u00e9sinfection-d\u00e9sinsectisation et d\u00e9ratisation.<\/p>\n\n\n\n<p>Le paiement de la p\u00e9riode de travail doit \u00eatre effectu\u00e9 \u00e0 l\u2019avance.<\/p>\n\n\n\n<p>Compte tenu du but hygi\u00e9nique et social des cong\u00e9s, aucune renonciation expresse ou tacite de ceux-ci n\u2019est admise, ni le remplacement par quelque compensation que ce soit.
