dans le cas d\u2019une semaine courte, le deuxi\u00e8me jour de repos est<\/p>\n\n\n\n<p>consid\u00e9r\u00e9 comme f\u00e9ri\u00e9;<\/p>\n\n\n\n<p>b) les jours f\u00e9ri\u00e9s des 25 avril, 1 mai et 2 juin, fix\u00e9s par la l\u00e9gislation en vigueur, \u00e0<\/p>\n\n\n\n<p>l\u2019exception de tout remplacement ou ajout intervenant en raison de dispositions<\/p>\n\n\n\n<p>g\u00e9n\u00e9rales;<\/p>\n\n\n\n<p>c) les jours f\u00e9ri\u00e9s suivants:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Nouvel An (1 janvier);<\/li>\n\n\n\n<li>\u00c9piphanie du Seigneur (6 janvier);<\/li>\n\n\n\n<li>P\u00e2ques (selon l\u2019ann\u00e9e);<\/li>\n\n\n\n<li>Lundi apr\u00e8s P\u00e2ques (selon l\u2019ann\u00e9e);<\/li>\n\n\n\n<li>Assomption (15 ao\u00fbt);<\/li>\n\n\n\n<li>Toussaint (1 novembre);<\/li>\n\n\n\n<li>Immacul\u00e9e Conception (8 d\u00e9cembre);<\/li>\n\n\n\n<li>Saint No\u00ebl (25 d\u00e9cembre);<\/li>\n\n\n\n<li>Saint \u00c9tienne (26 d\u00e9cembre);<\/li>\n\n\n\n<li>F\u00eate du Patron de la localit\u00e9 o\u00f9 le travailleur pr\u00eate son \u0153uvre (pour la commune de Rome, les Saints Pierre et Paul 29 juin).<\/li>\n<\/ol>\n\n\n\n<p>Dans les localit\u00e9s o\u00f9 la f\u00eate du Patron co\u00efncide avec d\u2019autres f\u00eates vis\u00e9es aux points b) et c), les Associations territoriales \u00e9tabliront une journ\u00e9e de f\u00eate rempla\u00e7ant celle du Patron, afin de maintenir le nombre de jours f\u00e9ri\u00e9s vis\u00e9s aux points b) et c).<\/p>\n\n\n\n<p>Uniquement dans le cas o\u00f9 les jours f\u00e9ri\u00e9s vis\u00e9s aux points b) et c) tombent en jour de repos hebdomadaire (article 40) outre le traitement \u00e9conomique normal, un montant \u00e9gal aux cotisations journali\u00e8res des \u00e9l\u00e9ments de la r\u00e9mun\u00e9ration mensuelle globale est vers\u00e9.<\/p>\n\n\n\n<p style=\"text-transform:uppercase\"><strong>JOURS F\u00c9RI\u00c9S ABOLIS PAR LA LOI du 5\u00a0mars\u00a01977, n\u00b0 54<\/strong><\/p>\n\n\n\n<p>En ce qui concerne la f\u00eate civile (4\u00a0novembre) dont la c\u00e9l\u00e9bration a lieu le premier dimanche de novembre, le travailleur b\u00e9n\u00e9ficiera du traitement pr\u00e9vu pour les f\u00eates co\u00efncidant avec le dimanche, \u00e9tant entendu qu\u2019aucune r\u00e9mun\u00e9ration suppl\u00e9mentaire n\u2019est due en cas de prestation effectu\u00e9e le 4\u00a0novembre.<\/p>\n\n\n\n<p>Dans le cas o\u00f9 l\u2019entreprise dispose de la prestation de travail pour les 4 jours f\u00e9ri\u00e9s supprim\u00e9s, au travailleur qui, au cours de ces journ\u00e9es, preste son travail, ne per\u00e7oit aucune r\u00e9mun\u00e9ration suppl\u00e9mentaire par rapport au salaire mensuel normal et des cong\u00e9s compensatoires r\u00e9mun\u00e9r\u00e9s seront attribu\u00e9s pour le nombre de jours travaill\u00e9s correspondant aux jours f\u00e9ri\u00e9s pr\u00e9cit\u00e9s.<\/p>\n\n\n\n<p>Les permis susmentionn\u00e9s ne seront pas cumulables avec la p\u00e9riode de travail et seront attribu\u00e9s en fonction des besoins de service, compte tenu des attentes du travailleur, et devront \u00eatre utilis\u00e9s dans l\u2019ann\u00e9e au cours de laquelle ils se rapportent; au cas o\u00f9 le travailleur ne b\u00e9n\u00e9ficie pas dans les d\u00e9lais susmentionn\u00e9s des permis, il y aura autant de cotisations journali\u00e8res de salaire global mensuel que de jours f\u00e9ri\u00e9s religieux travaill\u00e9s.<\/p>\n\n\n\n<p>Dans le cas o\u00f9 les 4 f\u00eates religieuses tombent pendant la p\u00e9riode de vacances, il y aura une prolongation correspondante de la p\u00e9riode de semaine.<\/p>\n\n\n\n<p>En cas de co\u00efncidence des 4 f\u00eates religieuses avec le repos hebdomadaire vis\u00e9 \u00e0 l\u2019article 40, le travailleur ne recevra aucun permis compensatoire, mais b\u00e9n\u00e9ficiera du traitement pr\u00e9vu \u00e0 l\u2019alin\u00e9a 3 du pr\u00e9sent article.<\/p>\n\n\n\n<p>Le traitement de tous les jours f\u00e9ri\u00e9s non travaill\u00e9s, vis\u00e9 au pr\u00e9sent article, est inclus dans le traitement salarial mensuel.<\/p>\n\n\n\n<p>Dans le cas o\u00f9 les institutions de s\u00e9curit\u00e9 sociale versent aux travailleurs absents pour cause de maladie, d\u2019accident, de grossesse et de maternit\u00e9, un traitement pour les jours f\u00e9ri\u00e9s vis\u00e9s au pr\u00e9sent article, l\u2019entreprise ne devra payer que la diff\u00e9rence entre ce traitement et la totalit\u00e9 de la r\u00e9mun\u00e9ration des jours f\u00e9ri\u00e9s.<\/p>\n\n\n\n<p><strong>D\u00c9CLARATION\u00a0AU PROC\u00c8S-VERBAL<\/strong><\/p>\n\n\n\n<p>Pour les travailleurs d\u2019entreprises op\u00e9rant dans la commune de Rome, si au-del\u00e0 de la f\u00eate des Saints Pierre et Paul soit pris un jour de repos suppl\u00e9mentaire pour le Saint Patron, le nombre des permis vis\u00e9s aux paragraphes 5, 6 et 7 du pr\u00e9sent article est r\u00e9duit \u00e0 3.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRetour en haut\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Article 41 &#8211;
