Heures suppl\u00e9mentaires, de nuit et festif\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Si des exigences particuli\u00e8res de service l\u2019exigent, le salari\u00e9 est tenu de travailler m\u00eame au-del\u00e0 de l\u2019horaire normal \u00e9tabli, de jour comme de nuit, sauf motif individuel\u00a0d\u2019emp\u00eachement justifi\u00e9.<\/p>\n\n\n\n<p>L\u2019entreprise ne pourra pas demander une prolongation horaire et une prestation extraordinaire exc\u00e9dant 150 heures par an.<\/p>\n\n\n\n<p>Est consid\u00e9r\u00e9 comme heures suppl\u00e9mentaires, et donne lieu \u00e0 une r\u00e9mun\u00e9ration, celui pr\u00e9vu par l\u2019entreprise et ex\u00e9cut\u00e9 au-del\u00e0 de la dur\u00e9e normale du travail vis\u00e9 \u00e0 l\u2019article 30, sous r\u00e9serve des dispositions de l\u2019article 31.<\/p>\n\n\n\n<p>Les heures suppl\u00e9mentaires sont pay\u00e9es par tranches horaires de la r\u00e9mun\u00e9ration mensuelle globale.<\/p>\n\n\n\n<p>Les heures suppl\u00e9mentaires ainsi que les heures travaill\u00e9es les jours f\u00e9ri\u00e9s et de nuit sont compens\u00e9es par les majorations suivantes:<\/p>\n\n\n\n<p><\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td>Heures suppl\u00e9mentaires de jour<\/td><td>25%<\/td><\/tr><tr><td>Heures suppl\u00e9mentaires de nuit<\/td><td>50%<\/td><\/tr><tr><td>Heures suppl\u00e9mentaires jour f\u00e9ri\u00e9<\/td><td>65%<\/td><\/tr><tr><td>Heures suppl\u00e9mentaires de nuit f\u00e9ri\u00e9<\/td><td>75%<\/td><\/tr><tr><td>Travail accompli les jours f\u00e9ri\u00e9s<\/td><td>50%<\/td><\/tr><tr><td>Travail de nuit, y compris en alternance<\/td><td>20%<\/td><\/tr><tr><td>Travail de nuit, non compris le travail post\u00e9<\/td><td>30%<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Les pourcentages ci-dessus seront calcul\u00e9s sur la part horaire de la r\u00e9mun\u00e9ration de base au moment de leur liquidation.<\/p>\n\n\n\n<p>Ces taux de majoration ne sont pas cumulables, en ce sens que la plus \u00e9lev\u00e9e absorbe la plus faible.<\/p>\n\n\n\n<p>On entend par travail de nuit, aux fins de ce qui pr\u00e9c\u00e8de, celui compris entre 22 heures et 6 heures du matin.<\/p>\n\n\n\n<p>Dans les seuls cas de prestation de nuit continue, la majoration correspondante devra \u00eatre prise en compte dans les \u00e9tablissements contractuels suivants\u00a0:<\/p>\n\n\n\n<p>a) cong\u00e9s;<\/p>\n\n\n\n<p>b) jours f\u00e9ri\u00e9s;<\/p>\n\n\n\n<p>c) 13e mensualit\u00e9;<\/p>\n\n\n\n<p>d) 14e mensualit\u00e9;<\/p>\n\n\n\n<p>e) TFR (indemnit\u00e9 de fin de contrat);<\/p>\n\n\n\n<p>f)\u00a0 indemnit\u00e9 de pr\u00e9avis de remplacement;<\/p>\n\n\n\n<p>g)\u00a0maladie et accident.<\/p>\n\n\n\n<p>Pour le personnel employ\u00e9, les conditions de faveur restent inchang\u00e9es.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRetour en haut\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Article 38 &#8211;
