Droit d&rsquo;\u00e9tude\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Compte tenu de la modification du cadre r\u00e9glementaire en mati\u00e8re de formation professionnelle et continue, les travailleurs recrut\u00e9s \u00e0 dur\u00e9e ind\u00e9termin\u00e9e et non stagiaires, qui, afin d\u2019am\u00e9liorer leur \u00e9ducation et leur pr\u00e9paration, ainsi que leurs comp\u00e9tences et connaissances professionnelles, y compris en ce qui concerne l\u2019activit\u00e9 de l\u2019entreprise, sont inscrits et fr\u00e9quentent r\u00e9guli\u00e8rement des cours dans des \u00e9coles primaires, secondaire ou de qualification professionnelle, homolog\u00e9es, \u00e9galis\u00e9es, ou l\u00e9galement reconnues et en tout cas habilit\u00e9es \u00e0 la d\u00e9livrance de titres d\u2019\u00e9tudes juridiques ont droit, avec les pr\u00e9cisions indiqu\u00e9es aux alin\u00e9as suivants, de b\u00e9n\u00e9ficier de cong\u00e9s pay\u00e9s \u00e0 la charge d\u2019un volume horaire triennal mise \u00e0 la disposition de tous les salari\u00e9s.<\/p>\n\n\n\n<p>Les parties s\u2019engagent \u00e0 contr\u00f4ler la bonne application du droit pr\u00e9vu au pr\u00e9sent article. Les heures de permis \u00e0 utiliser sur une p\u00e9riode de trois ans peuvent \u00e9galement \u00eatre utilis\u00e9es en une seule ann\u00e9e.<\/p>\n\n\n\n<p>Au d\u00e9but de chaque p\u00e9riode de trois ans, le nombre d\u2019heures disponibles pour l\u2019exercice du droit \u00e0 l\u2019\u00e9tude sera d\u00e9termin\u00e9 en multipliant par trois heures 10 heures par an et par le nombre total de salari\u00e9s employ\u00e9s dans l\u2019entreprise ou l\u2019unit\u00e9 de production \u00e0 cette date,\u00a0sauf les ajustements ult\u00e9rieurs li\u00e9s aux variations du nombre de salari\u00e9s.<\/p>\n\n\n\n<p>Les travailleurs qui pourront en m\u00eame temps s\u2019absenter de l\u2019entreprise ou de l\u2019unit\u00e9 de production pour l\u2019exercice du droit \u00e0 l\u2019\u00e9tude ne devront pas d\u00e9passer 2% du total de la force employ\u00e9e; le d\u00e9roulement de l\u2019activit\u00e9 productive devra \u00eatre garanti dans chaque d\u00e9partement, par des accords avec les repr\u00e9sentants syndicaux de l\u2019entreprise ou la R.S.U.<\/p>\n\n\n\n<p>Les cong\u00e9s pay\u00e9s pourront \u00eatre demand\u00e9s pour un maximum de 150 heures par personne et par p\u00e9riode de trois ans, utilisables m\u00eame en une seule ann\u00e9e, pour autant que le cours auquel le travailleur concern\u00e9 a l\u2019intention de participer se d\u00e9roule pour un nombre d\u2019heures deux fois sup\u00e9rieur \u00e0 celui requis comme cong\u00e9 r\u00e9mun\u00e9r\u00e9. \u00c0 cet effet, le travailleur int\u00e9ress\u00e9 devra pr\u00e9senter une demande \u00e9crite \u00e0 l\u2019entreprise dans les d\u00e9lais et selon les modalit\u00e9s qui seront convenus au niveau de l\u2019entreprise. Ces d\u00e9lais ne seront normalement pas inf\u00e9rieurs au trimestre.<\/p>\n\n\n\n<p>Si le nombre des demandeurs entra\u00eene le d\u00e9passement de 1\/3 du nombre d\u2019heures de trois ans et entra\u00eene l\u2019apparition de situations contradictoires avec les conditions vis\u00e9es \u00e0 l\u2019alin\u00e9a 5, la direction et les repr\u00e9sentants syndicaux d\u2019entreprise, ou la R.S.U., \u00e9tabliront, compte tenu des exigences exprim\u00e9es par les travailleurs en ce qui concerne la fr\u00e9quentation des cours, les crit\u00e8res objectifs pour l\u2019identification des b\u00e9n\u00e9ficiaires des permis, sans pr\u00e9judice de ce qui est pr\u00e9vu \u00e0 l&rsquo;alin\u00e9a 4, tels que l\u2019\u00e2ge, l\u2019anciennet\u00e9, les caract\u00e9ristiques des cours, etc.<\/p>\n\n\n\n<p>Seront admis aux cours ceux qui remplissent les conditions n\u00e9cessaires et qui remplissent les conditions objectives indiqu\u00e9es aux alin\u00e9as pr\u00e9c\u00e9dents.<\/p>\n\n\n\n<p>Les travailleurs devront fournir \u00e0 l\u2019entreprise un certificat d\u2019inscription au cours et ensuite des certificats de fr\u00e9quence avec l\u2019indication des heures relatives.<\/p>\n\n\n\n<p>Toute divergence quant au respect des conditions sp\u00e9cifi\u00e9es par le pr\u00e9sent article fera l\u2019objet d\u2019un examen conjoint entre la Direction et les repr\u00e9sentations syndicales d\u2019entreprise, ou la R.S.U..<\/p>\n\n\n\n<p>Les entreprises verseront, pendant la fr\u00e9quentation des cours, des acomptes mensuels proportionnels aux heures de permis utilis\u00e9es, \u00e9tant entendu que la condition pour le paiement de ces heures, dans les limites et conditions indiqu\u00e9es \u00e0 l&rsquo;alin\u00e9a 4, est constitu\u00e9 par la fr\u00e9quentation r\u00e9guli\u00e8re de l\u2019ensemble du cours.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRetour en haut\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Article 36 &#8211;
