Dans le cas des postes du soir, on entend les 24 heures pr\u00e9c\u00e9dant le d\u00e9but du poste.<\/p>\n\n\n\n<p>Les absences doivent \u00eatre justifi\u00e9es dans les deux jours suivants, sauf en cas d\u2019emp\u00eachement prouv\u00e9.<\/p>\n\n\n\n<p>Les absences non justifi\u00e9es pourront \u00eatre sanctionn\u00e9es conform\u00e9ment aux articles 47, 48 et 49 de la pr\u00e9sente C.C.N.T..<\/p>\n\n\n\n<p><strong>PERMIS DE TRAVAIL<\/strong><\/p>\n\n\n\n<p>Si le travailleur en fait la demande, les entreprises peuvent accorder de br\u00e8ves autorisations pour des raisons justifi\u00e9es, avec la facult\u00e9 de ne pas payer la r\u00e9mun\u00e9ration correspondante.<\/p>\n\n\n\n<p>\u00c0 l\u2019occasion de la naissance d\u2019un enfant, une journ\u00e9e de cong\u00e9 r\u00e9mun\u00e9r\u00e9 sera accord\u00e9e au travailleur.<\/p>\n\n\n\n<p>Au travailleur touch\u00e9 par le d\u00e9c\u00e8s d\u2019un parent, d\u2019un enfant, d\u2019un fr\u00e8re ou d\u2019un conjoint, l\u2019entreprise accordera un cong\u00e9 r\u00e9mun\u00e9r\u00e9 de 3 jours si le deuil a eu lieu dans la ville de travail ou dans sa province et de 5 jours, dont 3 pay\u00e9s, si l\u2019\u00e9v\u00e9nement s\u2019est produit en dehors de la province.<\/p>\n\n\n\n<p>Si le deuil survient au cours de la prestation, le travailleur sera autoris\u00e9 \u00e0 s\u2019absenter imm\u00e9diatement du poste de travail avec droit \u00e0 la totalit\u00e9 du salaire journalier, en plus de ce qui est pr\u00e9vu \u00e0 l\u2019alin\u00e9a pr\u00e9c\u00e9dent.<\/p>\n\n\n\n<p>Ces permis ne sont pas comptabilis\u00e9s dans la p\u00e9riode annuelle de cong\u00e9.<\/p>\n\n\n\n<p>Pour ce qui n\u2019est pas pr\u00e9vu dans le pr\u00e9sent article, la loi n\u00b053 du 8\u00a0mars\u00a02000 est applicable.<\/p>\n\n\n\n<p><strong>CONG\u00c9 MATRIMONIAL<\/strong><\/p>\n\n\n\n<p>Le travailleur qui se marie se verra accorder un cong\u00e9 de 15 jours ouvrables, avec retenue de ce qui pourrait \u00eatre pay\u00e9 pour cette p\u00e9riode par l\u2019Institut National de la S\u00e9curit\u00e9 Sociale.<\/p>\n\n\n\n<p>Pour les nouveaux embauch\u00e9s \u00e0 partir du 1er\u00a0juin\u00a02001, le cong\u00e9 est de 15 jours civils. Ce cong\u00e9 n\u2019est pas pris en compte dans la p\u00e9riode annuelle de cong\u00e9.<\/p>\n\n\n\n<p><strong>PERMIS LOI 5\u00a0f\u00e9vrier\u00a01992, n\u00b0104<\/strong><\/p>\n\n\n\n<p>\u00c0 condition que la personne handicap\u00e9e ne soit pas hospitalis\u00e9e \u00e0 temps plein, le travailleur qui assiste la personne handicap\u00e9e en situation de gravit\u00e9, conjoint, parent ou apparent\u00e9 au second degr\u00e9, ou au troisi\u00e8me degr\u00e9 lorsque les parents ou le conjoint de la personne handicap\u00e9e en situation de gravit\u00e9 ont atteint l\u2019\u00e2ge de soixante-cinq ans ou sont \u00e9galement atteints de maladies invalidantes ou sont d\u00e9c\u00e9d\u00e9s ou manquants, a droit \u00e0 trois jours de cong\u00e9 mensuel r\u00e9mun\u00e9r\u00e9 couvert par la cotisation imput\u00e9e, m\u00eame de mani\u00e8re continue.<\/p>\n\n\n\n<p>Ce droit ne peut \u00eatre accord\u00e9 \u00e0 plus d\u2019un salari\u00e9 pour l\u2019assistance \u00e0 la m\u00eame personne handicap\u00e9e en situation de gravit\u00e9.<\/p>\n\n\n\n<p>Pour la prise en charge d\u2019un m\u00eame enfant handicap\u00e9 en situation de gravit\u00e9, le droit est reconnu aux deux parents, y compris les parents adoptifs et d\u2019accueil, qui peuvent en b\u00e9n\u00e9ficier alternativement.<\/p>\n\n\n\n<p>Afin de concilier le droit aux autorisations mensuelles vis\u00e9es aux alin\u00e9as pr\u00e9c\u00e9dents avec les exigences organisationnelles et techniques et productives normales de l\u2019entreprise, le travailleur titulaire des permis mensuels communique par \u00e9crit \u00e0 l\u2019employeur le calendrier pr\u00e9vu de leur utilisation sur une base trimestrielle, si possible, ou au moins mensuelle, afin de concilier le droit du travailleur avec les besoins organisationnels de l\u2019entreprise.<\/p>\n\n\n\n<p>Le travailleur a la facult\u00e9 de modifier, pour des raisons justifi\u00e9es, la date communiqu\u00e9e en donnant un pr\u00e9avis \u00e9crit \u00e0 l\u2019employeur d\u2019au moins deux jours ouvrables, sauf en cas d\u2019urgence soudaine et grave.<\/p>\n\n\n\n<p>L\u2019employeur peut, dans le cadre du mois de r\u00e9f\u00e9rence, en cas d\u2019exigences techniques, organisationnelles ou productives justifi\u00e9es, qu\u2019il communique au travailleur, diff\u00e9rer l\u2019utilisation des permis en respectant le d\u00e9lai du mois. En tout \u00e9tat de cause, les situations dans lesquelles des raisons justifi\u00e9es du travailleur ont un caract\u00e8re d\u2019absolue indiff\u00e9rabilit\u00e9 et urgence sont r\u00e9serv\u00e9es.<\/p>\n\n\n\n<p>Le travailleur b\u00e9n\u00e9ficiaire des permis vis\u00e9s aux alin\u00e9as pr\u00e9c\u00e9dents a le droit de choisir, si possible, le lieu de travail le plus proche du domicile de la personne \u00e0 assister et ne peut \u00eatre transf\u00e9r\u00e9 sans son consentement \u00e0 un autre lieu.<\/p>\n\n\n\n<p>En cas de concentration excessive de travailleurs ayant droit au m\u00eame march\u00e9, de nature \u00e0 entraver leur bonne gestion et leur bon fonctionnement, au niveau de l\u2019entreprise et des repr\u00e9sentants syndicaux se r\u00e9uniront afin d\u2019\u00e9valuer toute solution alternative possible.<\/p>\n\n\n\n<p>Sans pr\u00e9judice de la v\u00e9rification des conditions de la constatation de la responsabilit\u00e9 disciplinaire vis\u00e9e aux articles 46 et suivants de la pr\u00e9sente C.C.N.T., le travailleur b\u00e9n\u00e9ficiaire des permis vis\u00e9s aux alin\u00e9as pr\u00e9c\u00e9dents devient caduque des droits vis\u00e9s au pr\u00e9sent article, lorsque l\u2019employeur ou l\u2019INPS (Institut national de s\u00e9curit\u00e9 sociale) constate que les conditions requises pour l\u2019exercice l\u00e9gitime des ces droits ne sont pas remplies.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRetour en haut\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Article 35 &#8211; Absences, permis de travail, cong\u00e9s matrimoniaux Sauf en cas d\u2019emp\u00eachement prouv\u00e9, toutes les absences doivent \u00eatre communiqu\u00e9es \u00e0 la Soci\u00e9t\u00e9 le jour o\u00f9 elles se produisent.
