l\u2019insertion temporaire dans un horaire nocturne tel que sp\u00e9cifi\u00e9 ici est consid\u00e9r\u00e9e comme \u00abexceptionnelle\u00bb et n\u2019implique donc pas la prise en charge de la qualification de \u201ctravailleur de nuit\u201d;<\/li>\n\n\n\n<li>en ce qui concerne son horaire annuel total, effectue, \u00e0 titre exceptionnel, sa prestation pendant au moins trois heures pendant la p\u00e9riode comprise entre 22 heures et 5 heures, pour un minimum de 80 jours ouvrables par an, \u00e0 reproportionner, pour le temps partiel \u2013 vertical et mixte, au sens de l\u2019article 1, alin\u00e9a 2, point e) du d\u00e9cret l\u00e9gislatif n\u00b066\/2003.<\/li>\n<\/ul>\n\n\n\n<p>Le travail effectu\u00e9 en relation avec les cas exceptionnels suivants n&rsquo;est pas consid\u00e9r\u00e9 comme du travail de nuit selon le d\u00e9cret l\u00e9gislatif n\u00b066\/2003, mais donne droit aux majorations pr\u00e9vues par la C.C.N.T en vigueur.<\/p>\n\n\n\n<p>a) vacance due \u00e0 une d\u00e9mission soudaine d\u2019un salari\u00e9;<\/p>\n\n\n\n<p>b)\u00a0n\u00e9cessit\u00e9 d\u2019un remplacement d\u00fb \u00e0 une courte absence de personnel pour cause de maladie, d\u2019accident et\/ou de force majeure;<\/p>\n\n\n\n<p>c)\u00a0n\u00e9cessit\u00e9 de remplacer du personnel de courte dur\u00e9e (cong\u00e9s, cong\u00e9s pay\u00e9s et non pay\u00e9s de toute nature);<\/p>\n\n\n\n<p>d)\u00a0pour l\u2019ex\u00e9cution de travaux urgents et exceptionnels de courte dur\u00e9e.<\/p>\n\n\n\n<p>Le travail de nuit est effectu\u00e9 en priorit\u00e9 par les travailleurs et les travailleuses qui en font la demande, compte tenu des besoins organisationnels de l\u2019entreprise.<\/p>\n\n\n\n<p>Conform\u00e9ment \u00e0 l\u2019article 13, alin\u00e9a 1, du d\u00e9cret l\u00e9gislatif n\u00b066\/2003, en cas d\u2019adoption d\u2019un horaire sur plusieurs semaines, la p\u00e9riode de r\u00e9f\u00e9rence sur laquelle calculer la limite de 8 heures dans les 24 heures, en l\u2019absence d\u2019une r\u00e9glementation sp\u00e9cifique au niveau de l\u2019exploitation, est d\u00e9fini comme une moyenne trimestrielle.<\/p>\n\n\n\n<p>Conform\u00e9ment \u00e0 l\u2019article 15 du d\u00e9cret l\u00e9gislatif n\u00b066\/2003, qui garantit le transfert du travail de nuit au travail de jour, il est pr\u00e9vu qu\u2019en cas d\u2019inaptitude au travail de nuit sanctionn\u00e9e par le m\u00e9decin comp\u00e9tent et en l\u2019absence de solutions au sein du m\u00eame niveau, le travailleur puisse \u00eatre transf\u00e9r\u00e9 \u00e0 des t\u00e2ches de niveau inf\u00e9rieur afin de faciliter des solutions visant \u00e0 prot\u00e9ger l\u2019emploi.<\/p>\n\n\n\n<p>Aux fins de l\u2019article 13, alin\u00e9a 2, du d\u00e9cret l\u00e9gislatif n\u00b066\/2003, il est confirm\u00e9\u00a0ce qui est pr\u00e9vu en mati\u00e8re par la pr\u00e9c\u00e9dente C.C.N.T.<\/p>\n\n\n\n<p>L\u2019introduction du travail de nuit est pr\u00e9c\u00e9d\u00e9e de la consultation des R.S.U. ou, si elle n\u2019a pas \u00e9t\u00e9 constitu\u00e9e, des R.S.E. ou, \u00e0 d\u00e9faut, des Organisations syndicales territoriales;
