P\u00e9riode probatoire\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>Le travailleur engag\u00e9 peut \u00eatre soumis \u00e0 une p\u00e9riode probatoire n\u2019exc\u00e9dant pas:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>6 mois pour les travailleurs encadr\u00e9s au niveau Cadre;<\/li>\n\n\n\n<li>4 mois pour les travailleurs encadr\u00e9s au niveau 7;<\/li>\n\n\n\n<li>3 mois pour les travailleurs encadr\u00e9s au niveau 6;<\/li>\n\n\n\n<li>2 mois pour les travailleurs occupant des emplois de bureau encadr\u00e9s aux niveaux 5, 4, 3 et 2;<\/li>\n\n\n\n<li>30 jours de travail effectif, pour les travailleurs ayant des t\u00e2ches d\u2019ouvrier encadr\u00e9s aux niveaux 4 et 5;<\/li>\n\n\n\n<li>26 jours de travail effectif, pour les travailleurs ayant des t\u00e2ches d\u2019ouvrier encadr\u00e9s aux niveaux 1, 2 et 3.<\/li>\n<\/ul>\n\n\n\n<p>Sans pr\u00e9judice des limites maximales vis\u00e9es \u00e0 l\u2019alin\u00e9a pr\u00e9c\u00e9dent, pour les travailleurs ouvriers engag\u00e9s sous contrat de travail \u00e0 temps partiel de type vertical, la p\u00e9riode d\u2019essai ne pourra en aucun cas d\u00e9passer le d\u00e9lai de trois mois.<\/p>\n\n\n\n<p>Cette p\u00e9riode d\u2019essai devra r\u00e9sulter de la lettre de recrutement vis\u00e9e \u00e0 l\u2019article 5. Pendant la p\u00e9riode d\u2019essai, tous les droits et obligations du pr\u00e9sent contrat s\u2019appliquent entre les parties, sauf disposition contraire du contrat.<\/p>\n\n\n\n<p>Pendant la p\u00e9riode d\u2019essai, la r\u00e9siliation de la relation de travail pourra \u00eatre effectu\u00e9e par chacune des parties \u00e0 tout moment sans pr\u00e9avis ni indemnit\u00e9 de r\u00e9siliation.<\/p>\n\n\n\n<p>Si la r\u00e9siliation intervient par d\u00e9mission \u00e0 tout moment ou par licenciement pendant les deux premiers mois d\u2019essai pour les travailleurs de 7 ans et pendant le premier mois pour les travailleurs de 6 ans, la r\u00e9mun\u00e9ration sera vers\u00e9e pour la seule p\u00e9riode de service prest\u00e9e.<\/p>\n\n\n\n<p>Si le licenciement intervient au-del\u00e0 des d\u00e9lais susmentionn\u00e9s, le travailleur recevra sa r\u00e9mun\u00e9ration jusqu\u2019\u00e0 la moiti\u00e9 ou \u00e0 la fin du mois en cours, selon que la r\u00e9siliation intervient avant la premi\u00e8re ou la deuxi\u00e8me quinzaine du mois en cours.<\/p>\n\n\n\n<p>Si, \u00e0 l\u2019expiration de la p\u00e9riode d\u2019essai, l\u2019entreprise ne proc\u00e8de pas \u00e0 la r\u00e9siliation du rapport, le travailleur est r\u00e9put\u00e9 confirm\u00e9 en service et cette p\u00e9riode est prise en compte aux fins de la d\u00e9termination de l\u2019anciennet\u00e9.<\/p>\n\n\n\n<p>Seront exempt\u00e9s de la p\u00e9riode d\u2019essai les travailleurs qualifi\u00e9s qui l\u2019auront d\u00e9j\u00e0 d\u00e9pass\u00e9 dans la m\u00eame entreprise et pour les m\u00eames t\u00e2ches au cours des 12 mois pr\u00e9c\u00e9dents ou en cas de passage direct et imm\u00e9diat.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tRetour en haut\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Article 8 &#8211;
