Preaviso\t\t\t<\/h4>\n\n\t\t<\/div>\n\n\t\t<div class='ewd-ufaq-clear'><\/div>\n\n\t<\/a>\n\t\n<\/div>\n\t\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t\n<p>La relaci\u00f3n laboral de duraci\u00f3n indefinida no podr\u00e1 ser rescindida por ninguna de las partes sin preaviso, cuyos t\u00e9rminos son los siguientes:<\/p>\n\n\n\n<p><strong>EMPLEADOS<\/strong><\/p>\n\n\n\n<p>a) para los empleados que, habiendo superado el per\u00edodo de prueba, no hayan prestado m\u00e1s de cinco a\u00f1os de servicio:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>meses 2 y 15 d\u00edas para los empleados de 7\u00ba nivel y Directivos intermedios (Q);<\/li>\n\n\n\n<li>meses 1 y 15 d\u00edas para los empleados de 6\u00ba nivel;<\/li>\n\n\n\n<li>meses 1 para empleados del 5\u00ba al 2\u00ba nivel;<\/li>\n<\/ol>\n\n\n\n<p>b) para los trabajadores con m\u00e1s de 5 a\u00f1os de servicio y menos de 10:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>meses 3 y 15 d\u00edas para los empleados de 7\u00ba nivel y Directivos intermedios (Q);<\/li>\n\n\n\n<li>meses 2 para los empleados de 6\u00ba nivel;<\/li>\n\n\n\n<li>meses 1 y 15 d\u00edas para empleados del 5\u00ba al 2\u00ba nivel;<\/li>\n<\/ol>\n\n\n\n<p>c) para los trabajadores con m\u00e1s de 10 a\u00f1os de servicio:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>meses 4 y 15 d\u00edas para los empleados de 7\u00ba nivel y Directivos intermedios (Q);<\/li>\n\n\n\n<li>meses 2 y 15 d\u00edas para los empleados de 6\u00ba nivel;<\/li>\n\n\n\n<li>meses 2 para empleados del 5\u00ba al 2\u00ba nivel. OBREROS<\/li>\n<\/ol>\n\n\n\n<p><strong>OBREROS<\/strong><\/p>\n\n\n\n<p>15 d\u00edas naturales para los obreros de cualquier nivel, independientemente de su antig\u00fcedad.<\/p>\n\n\n\n<p>Los plazos de preaviso a los que se refiere este art\u00edculo se reducen al 50% para los trabajadores por cuenta ajena y a 7 d\u00edas naturales para los trabajadores por cuenta ajena si el trabajador da el preaviso.<\/p>\n\n\n\n<p>Los plazos de preaviso van de mediados a finales de cada mes.<\/p>\n\n\n\n<p>La parte que ponga fin a la relaci\u00f3n sin respetar los plazos de preaviso mencionados deber\u00e1 abonar a la otra parte una indemnizaci\u00f3n igual al importe de la remuneraci\u00f3n total correspondiente al plazo de preaviso no respetado.\u00a0<\/p>\n\n\n\n<p>El empresario tiene derecho a retener, de la cantidad que adeuda al trabajador, un importe correspondiente a la retribuci\u00f3n por el per\u00edodo de preaviso que el trabajador no haya cumplido.<\/p>\n\n\n\n<p>El periodo de preaviso, aunque sea sustituido por la indemnizaci\u00f3n correspondiente, se computar\u00e1 como antig\u00fcedad a efectos de indemnizaci\u00f3n por despido.<\/p>\n\n\n\n<p>Queda a elecci\u00f3n de la parte que recibe el preaviso en virtud del apartado (1) poner fin a la relaci\u00f3n, ya sea al principio o durante el periodo de preaviso, sin obligaci\u00f3n de pagar indemnizaci\u00f3n alguna por el periodo de preaviso incumplido.<\/p>\n\n\n\n<p>Durante el periodo de preaviso, el empresario conceder\u00e1 al trabajador un permiso para buscar un nuevo empleo; la distribuci\u00f3n y la duraci\u00f3n del permiso ser\u00e1n determinadas por el empresario en funci\u00f3n de las necesidades de la empresa.<\/p>\n\n\n\n<p>Tanto el despido como la dimisi\u00f3n se comunicar\u00e1n por escrito, de conformidad con lo dispuesto en la legislaci\u00f3n vigente.<\/p>\n<\/div>\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-back-to-top'>\n\t\n\t<a class='ewd-ufaq-back-to-top-link'>\n\t\tVolver a la parte superior\t<\/a>\n\n<\/div>\n\t\t\n\t<\/div>\n\n<\/div>\n\t<\/div>\n\n\t\n<\/div>","protected":false},"excerpt":{"rendered":"<p>B Art\u00edculo 57 &#8211;
